Those present were Jeff Harvey, Miami County Surveyor; Gary Hawley, Miami County Drainage Board Member; Greg Deeds, Vice Chairman; Michael Tiede, Pulaski County Drainage Board Member; Don Towne, Fulton County Surveyor; Tom Chudzynski, Fulton County Assistant Surveyor; Roger Rose, Chairman; Richard Powell, Fulton County Drainage Board Member; Jean E. Cloud, Joint Drainage Board Secretary; and Greg Heller, Joint Drainage Board Attorney. Chairman, Roger Rose, opened the Joint Board meeting at 9:10 A.M. D.S.T. IN REF: LUCINDA SMITH OPEN DISCUSSION Chairman, Roger Rose, asked Fulton County Surveyor, Don Towne, to present the proposal. Fulton County Surveyor, Don Towne, stated the said drain dumps into Mud Creek. Don further explained that Mud Creek has been cleaned from State Road 25 to the dams on both lakes. Don further explained during the cleanout of Mud Creek, a couple of pipes were lowered to get the creek where it should be. Don explained the proposal for said project is to start at Mud Creek and go down past Old Highway 31 and also do the Miller Arm, Hannah DuBois Arm and a couple of branches that come off of the Hannah DuBois, which are all drains of county record. Don further stated that the Hannah DuBois Arm #2 is set up on maintenance. Don further explained the ditch is all filled in; it has never been cleaned. Don presented his proposed plan for the work to be done. Don explained at Station 7 there is a six (6) foot pipe, which is undersized. Don further stated at Station 78 there is a big multiplate and it is overkill because it extends up over the bank. Don also stated when the pipe was set the ditch was not cleaned. Don stated his proposal is to take that pipe and put it where the six (6) foot pipe is located and replace it so that the ditch can be maintained. Don further stated he originally planned to take out approximately four (4) foot through the ditch and pull the banks. Don stated he has revised his plans to take out only three (3) foot in order to cut the cost of the project. Don also stated there are several private crossings undersized. Richard Powell asked about the private crossings. Don explained that there are at least four (4) private crossings that will need to be replaced, resized and put back to grade. Don explained to the Board where he talked about the pipe that was put in too high, there is an arm shortly after the pipe, which the main ditch dumps into. Don stated it is an eight (8) foot pipe and it is about half full. Don also showed the Board on the map where the six (6) foot pipe is that is full and also Don stated there is a six (6) foot pipe setting on top of the ground. There was further discussion. Don stated the entire ditch is thirty-four thousand five hundred (34,500) feet. Don further stated his proposal is twelve dollars ($12.00) per benefited acre with twelve dollar ($12.00) minimum for three years, and then the Board could review and possibly lower the rate at the end of the three (3) years. There was discussion on putting the ditch on the spray program after the work has been completed. Don stated he is proposing to work on the north side of the ditch brushing and treating stumps. After further discussion, Greg Deeds commented the only thing he sees the people in Miami County have no problem with the tiles draining into the head wall, although they do have an obligation to help pay, but in the other area it appears we are reconstructing the ditch, actually lowering the ditch so those people would gain some farm ground that they did not have before. Greg further stated the people on the tile would not have any benefit until the tile is replaced, and there are no plans for that at the present time. Greg Deeds stated he could see there could be a problem at the hearing with benefits being the same. Don commented the one pipe is placed too high and that has been there for several years, but the other pipes are on grade. Greg commented there are branches being added on to the main ditch, which were never there when the main ditch was originally constructed. Greg further commented the cost of the project is increased to these people by adding branches that were not there before. Greg stated he could see that being a problem. After further discussion, Don commented that all the branches are drains of county record back to 1880 to 1900. After further discussion, Greg feels there would be less challenge if the rates would be set up by benefits. Greg also commented that there would be less chance of a challenge as long as there is some variation in the rate for the landowners. There was brief discussion on what needs to be done before a hearing is set. Secretary, Jean Cloud, stated that Miami County needs to go through the assessment role for their landowners and make sure names, addresses and benefited acres are correct. After further discussion, it was discussed about a proposed rate of eight dollars ($8.00) per benefited acre for Miami County landowners on the Lucinda Smith Tile and all other landowners a proposed rate of thirteen dollars ($13.00) per benefited acre for three (3) years, then review the fund at that time and lower if need be. Fulton County Surveyor, Don Towne, commented the Hannah DuBois Arm #2 is a ditch on maintenance in Fulton County and the fund is maxed out with approximately twenty-five hundred dollars ($2500.00) in the fund. Don further commented that the money could be put into the project. Mike Tiede suggested to clean both sides of the ditch for the landowners on the Hannah DuBois Arm #2. Vice Chairman, Greg Deeds, suggested the money could be credited to the landowners on the drain. Richard Powell asked Fulton County Surveyor for the cost to clean out that arm. Don responded approximately six thousand dollars ($6,000.00). Don stated if the entire project is not done, they would not benefit. Vice Chairman, Greg Deeds, made a motion to have Fulton County Surveyor, Don Towne, work up figures using the eight dollars ($8.00) and the thirteen dollars ($13.00) proposed rates in the assessement role and have another meeting to discuss the numbers and make additional adjustments if needed at that time. Richard Powell seconded the motion. Motion carried five to zero. The next Joint Board meeting will be Tuesday, July 22 at 9 A.M. Being no further discussion, Gary Hawley made a motion to adjourn the Joint Board meeting at 10:17 A.M. Richard Powell seconded the motion. Motion carried five to zero.
