Board members present were Chairman, Roger Rose; Vice Chairman, Ron Truex; Board Member, Don Goon; and Board Member, Sherry Fulton. Also in attendance were Fulton County Surveyor, Don Towne; Kosciusko County Surveyor, Richard Kemper; Fulton County Assistant Surveyor, Tom Chudzynski; and Joint Drainage Board Secretary, Jean Cloud. It is duly noted Joint Drainage Board Attorney, Greg Heller; and Fifth Member, Mike Tiede were absent. Chairman, Roger Rose, opened the Joint Board meeting to discuss Chippewanuck Creek. IN REF: CHIPPEWANUCK CREEK SURVEYORS REPORT CAUSE NO. 2-2009J #799 AND HEARING SET:ESTABLISH A MAINTENANCE RATE Fulton County Surveyor, Don Towne, explained to the Joint Board that Chippewanuck Creek runs from Lake 16 to the Tippecanoe River. Don stated the Bucher Open, Bryant Leininger and Arms of the A.A.Gast are set up on maintenance. Don explained the Bucher goes to the outskirts of Rock Lake. Don explained originally the proposed plan was to go up close to the Tippecanoe River. Don stated a meeting has been held with DNR, Fish and Wildlife and IDEM. Don explained the area next to the river is a floodplain area, so the proposal is to start the project west of 450 East and continue on to where the Bucher dumps into Chippewanuck Creek and keeps us downstream away from Lake 16. Chairman, Roger Rose, asked how far is it from the river? Don responded, About two and half miles. Don explained the proposed profile to the Board, and commented his office has shot the entire drain. Don stated he is proposing to put a silt trap at the beginning of the project, and go up stream. Don commented the plans are labeled as to which side the contractor can work from, because some of the areas have wetlands. Don commented it varies from two and a half to three foot to be taken out of the drain. Don further commented several silt traps would be put in throughout the drain. Don commented there are a couple of areas where there is a wetland adjacent to the drain on the side we wanted to work on, and the gentleman from IDEM was very understanding and worked with us on the issue. Don commented there are no old plans on this drain, but feel with the grades we will be going to the old existing, because the drain has not been cleaned forever. Don explained where the Bucher Open dumps into the Chippewanuck Creek; the last fifteen hundred (1500) feet will have to be a one step removal. Don explained that the spoil cannot touch the ground; it must be put in a truck and hauled to an upland site. Don stated the contractor will use track trucks and there are tillable acres close by, so we wont have to go down the road with the spoil. Tom Chudzynski commented the USGS map looks at the Bucher as part of the Chippewanuck Creek. Fulton County Surveyor, Don Towne, stated he has a permit from the Army Corp of Engineers. After further discussion, Fulton County Surveyor, Don Towne, commented the proposal is to brush everything and remove stumps on one side. Don explained in a wooded area, trees are removed enough to work and are piled. Don also commented the entire drain would be dredged. Fulton County Surveyor, Don Towne, commented there is fall from the starting point, but the logjams and sandbars need to be taken out. Kosciusko County Surveyor, Richard Kemper asked if only side would be brushed. Fulton County Surveyor, Don Towne, commented that is correct and also trees leaning out into the drain will be removed. Chairman, Roger Rose, asked about the brush on the drain, and Fulton County Surveyor, Don Towne, commented there is a lot of brush on the drain. Don stated the brushy areas range from fifty-five (55) to ninety (90) foot wide. After further discussion, Fulton County Surveyor, Don Towne, commented he is proposing to do the work under maintenance, because we are not lowering the drain; we are mainly just cleaning it out. Chairman, Roger Rose, asked Fulton County Surveyor if he had any numbers on this project. Fulton County Surveyor, Don Towne, commented he is estimating the project to be approximately three hundred and ninety thousand dollars ($390,000.00). Don commented he came up with a rate of thirteen dollars and eighty cents ($13.80) per benefited acre, and this is according to the number of acres in the watershed. Don further commented it depends on how long the Board wants the fund in the hole, two (2) or three (3) years. Don further explained once the work is done and the fund gets to a positive, then the Board could review the maintenance fund and possibly lower the rate. Assistant Surveyor, Tom Chudzynski, commented that a lot of the landowners are currently paying on other ditches at the present time, so this will be an additional assessment to landowners. After further discussion, Don stated if the Board wants to go out at least two (2) years, the rate would need to be at least seven dollars ($7.00) per benefited acre. Don further commented there is approximately thirty thousand five hundred (30,500) feet of dredging, brushing and that includes the fifteen hundred (1500) feet of one step removal. Don commented the cost is high per foot, but there is a lot of work to be done on the drain. Don commented he would rather be high, than too low. After much further discussion, the Board decided to set a proposed maintenance rate at seven dollars ($7.00) per benefited acre with a fifteen ($15.00) minimum. Ron Truex made a motion to set the proposed maintenance rate at seven dollars ($7.00) per benefited acre with a fifteen ($15.00) minimum. Sherry Fulton seconded the motion. Motion carried four to zero. The Board then discussed the date for the hearing. After brief discussion, the hearing date will be set for Tuesday, October 6, 2009 at 7:00 P.M. at the Fulton County 4-H Fairgrounds. The Board gave the Secretary an alternate date of October 27, 2009. Being no further discussion, Ron Truex made a motion to set the hearing date for October 6, 2009 with an alternate date of October 27, 2009 at 7 P.M. at the Fairgrounds. Sherry Fulton seconded the motion. Motion carried four to zero. Drainage Board Secretary, Jean Cloud, stated she would contact the Fairgrounds and see if the October 6th date is available and will let the Board know. COMES NOW, the Fulton County Surveyor presents to the Drainage Board a report for the Establishing a maintenance rate on the Chippewanuck Creek, Cause No. 2-2009J, #799 in Rochester, Newcastle and Henry Township in Fulton County and Franklin and Seward Township in Kosciusko County. Chairman, Roger Rose, entertained a motion to set the proposed maintenance rate at seven dollars ($7.00) per benefited acre with a fifteen dollars ($15.00) minimum. Motion carried four to zero. The Drainage Board now prepares its Schedule of Assessments which schedule contains a description, which has been taken from the Surveyors Report. The said Schedule of Assessments as passed by the Drainage Board in the captioned drain, which is attached hereto and made part hereof, shows the percent of estimated cost for establishing a maintenance rate for the landowners of the drain to be assessed of each tract of land for such proposed reconstruction rate. The percent allocated to all land benefited totals one hundred percent. Notices to be sent as per Indiana Statute, the hearing date to be set for Tuesday, October 6, 2009 at 7:00 P.M. D.S.T. at the Fulton County 4-H Fairgrounds, 1009 West Third Street, Rochester, Indiana.
