D.S.T. in the Conference Room of the Fulton County Office Building. Board Members present were Chairman, Roger D. Rose; Vice Chairman, Richard A. Powell; and Board Member, Mark J. Rodriguez. Also present were Don Towne, Fulton County Surveyor; Tom Chudzynski Assistant Surveyor; Jean Cloud, Drainage Board Secretary; Greg Heller Drainage Board Attorney; and Norman Steigely. Chairman, Roger Rose, called the meeting to order at 9:04 A.M. D.S.T. Chairman, Roger Rose, asked for any corrections or additions to the February 11, 2008 Drainage Board minutes. Being no additions or corrections to the February 11, 2008 minutes, Chairman, Roger Rose, entertained a motion to approve the February 11, 2008 Drainage Board minutes as presented. Richard Powell made a motion to approve the February 11, 2008 Drainage Board minutes as presented. Mark Rodriguez seconded the motion. Motion carried three to zero. IN REF: APPOINTMENT OF LEGAL COUNSEL Drainage Board Secretary, Jean Cloud, stated the appointment of Legal Counsel was not made at the January 14th Drainage Board meeting. Jean stated this needs to be done today and made retroactive to January 1, 2008. Chairman, Roger Rose, entertained a motion to appoint Burke & Heller as the Drainage Board legal counsel for the 2008 year. Mark Rodriguez made a motion to appoint Burke & Heller as the Drainage Board legal counsel for the 2008 year. Richard Powell seconded the motion. Motion carried three to zero. IN REF: TROUTMAN HOGAN OPEN BIDS RECEIVED: CAUSE NO. 4-1995 #717 WORK AWARDED Drainage Board Secretary, Jean Cloud, stated the Surveyor’s estimate for said project is $13,440.00 with a completion date of April 30. Jean further stated that she had received five (5) bids. The Drainage Board determined that proper notice has been given to be bid on this drain. According to the Plans and Specifications set forth by the Surveyor, the following bids were opened and read aloud: CONTRACTOR LUMP SUM Overmyer Excavating LLC $ 9,800.00 Jesse Rude $10,400.00 Gale Field $11,997.00 Ingram Excavating $10,200.00 Grade A Excavating & Bulldozing LLC $13,200.00 Chairman, Roger Rose, entertained a motion to accept the low bid of nine thousand eight hundred dollars ($9,800.00) submitted by Overmyer Excavating LLC. Mark Rodriguez made a motion to award the work on the Troutman Hogan Open, Cause No. 4-1995, #717; in Union Township; to Overmyer Excavating LLC, with their low bid of nine thousand eight hundred dollars ($9,800.00). Chairman, Roger Rose seconded the motion. Motion carried two to zero. Richard A. Powell abstained from voting on this project, as he is a landowner on said drain. IN REF: JUD L HUDKINS UPDATE CAUSE NO. 5-1998 #733 Fulton County Surveyor, Don Towne, stated a letter had been sent to Mike Lauher, Farm Management for John Hancock Mutual Life Insurance Co. and have not received a response. Fulton County Surveyor, Don Towne, stated the Grant of Easement was sent with the letter. After further discussion, Drainage Board Attorney, Greg Heller, stated if we do not get a response, we may need to proceed with fixing the ditch at the present location. Fulton County Surveyor, Don Towne, stated it is the responsibility of the landowner to repair the ditch bank, and this was stated in the letter that was sent to them. Don further stated we could go ahead and repair the ditch bank and bill the landowner. Drainage Board Attorney, Greg Heller, in order to expedite this, we may just have to proceed to repair the ditch at its present location, because we cannot relocate it without permission. There was further discussion on this issue. Drainage Board Attorney, Greg Heller, stated this is a ditch on maintenance, “Why is the landowner responsible for the banks on an open ditch?” Fulton County Surveyor, Don Towne, stated the maintenance fund is used to brush and clean an open ditch. Don further stated anytime an outlet pipe, or an equalizer pipe in the bank for surface water coming across the bank, or erosion on the bank, it has always been the landowner’s responsibility to repair. Don further stated there is only one (1) ditch that the maintenance fund is used to take care of the banks, and that is Willow Creek, because that was included in the findings and order when the drain was set up. After further discussion on this issue, Richard Powell asked, “What would be a fair time for response on this situation?” There was discussion, if a response was not received by the next Commissioner’s meeting, then we proceed with doing the work on the ditch bank. Chairman, Roger Rose, asked, “When was the letter sent to the landowner?” Fulton County Surveyor, Don Towne, stated a letter and proposed drawing was mailed on Tuesday or Wednesday, March 4th or 5th. Drainage Board Attorney, Greg Heller, stated IC 36-9-27-46 would govern the Board’s decision on repairing the bank on said drain. Drainage Board Attorney, Greg Heller, stated a certified letter should be sent notifying the landowner the work would be done on the drain if no response is received from the landowner within ten (10) days. Greg further stated the letter needs to also state that the landowner will be billed for the work done on the bank of said drain. IN REF: DRAINAGE ISSUE ON SILVER MAPLE DRIVE AT BRUCE LAKE Landowner, Norman Steigely, stated back in the 80’s the County Highway put an open drain in on the north side of Silver Maple Drive at Lake Bruce, which connects to a ditch that empties south into the lake. Norm further stated the water had always drained across the road and that was the reason the drain was put in. Norm stated the landowner on the north side filled in the ditch. Norm further stated people cannot arbitrarily fill in ditches that the county has put in. Norm stated the water has created a problem under his home, and he has hired a company to come out and drain the water out from under his home. Norm stated there is a mold problem, which is unhealthy. Norm stated it is going to cost him ten thousand dollars ($10,000.00) to have the work done. Norm further stated he went across the road and dug a trench across the driveway, and that eliminated the water coming across the road onto his property. Norm stated it does not take much of a ditch to the culvert under the road. Norm stated the ditch along the easement and the west side of his property was full when we had all the rains. Fulton County Surveyor, Don Towne, provided a drawing of the area for the Board to review. Chairman, Roger Rose, stated it appears the drain would be within the easement of the road. Fulton County Surveyor, Don Towne, agreed with this. Fulton County Surveyor, Don Towne, stated Mike Clark, Interim County Highway Superintendent, went out and looked at the situation and will talk with the landowners about putting the swale back in. There was discussion that the landowners would have to pay for the culverts to be put in under their driveways. Norm Steigely stated the water also affects his septic system, which is at the front of his home. Fulton County Surveyor, Don Towne, stated the letter from Dan Pine is just confirming there was an open ditch there years ago. Fulton County Surveyor, Don Towne, stated that Norm Steigely is going to run a tile on the east side of his garage, which will give him additional help with the water. Chairman, Roger Rose, asked what was needed from this Board. Fulton County Surveyor, Don Towne, stated that himself and Richard Powell had met with Norm at the site, and Don stated the County Highway is basically going to take care of the issue. Don stated in case any of the neighbors complain then the Drainage Board is aware of the situation. Chairman, Roger Rose, stated the consensus of this Board is that Norm has a legitimate complaint. IN REF: STEPHEN BRUCE DISCUSSION CAUSE NO. 6-1967 #519 Norman Steigely stated the said drain is flooding across the road, because there is a tree down in the ditch. Fulton County Surveyor, Don Towne, stated we have looked at this drain and tried to clean it a few years ago and DNR was not going to let us do anything. Don further stated he would be having a SEA 368 meeting on Thursday with DNR, IDEM and Fish and Wildlife. Don stated he feels they will be able to clean it this year. IN REF: BRUCE LAKE SEWER PROJECT UPDATE Norman Steigely stated if there are any problems with the engineers doing the project; do not hesitate to call him, as they will meet once a month with the engineers. Norm further stated if there is a problem with the location of things, Norm commented Steve Fraslish at Wightman-Petrie should be called. Norm stated the wetland delineation has already been done. Norman Steigely also stated the Bruce Lake Association has received a grant for dredging the ditches/channels. There was brief discussion on this issue. IN REF: MUD CREEK WORK AWARDED CAUSE NO. 3-1980 #723 Fulton County Surveyor, Don Towne, stated he received two (2) bids on this project on Friday, February 22. Don stated the high bid was Grade A Excavating at forty-one thousand dollars ($41,000.00), and low bid was Kirk Ingram at twenty thousand dollars ($20,000.00). Fulton County Surveyor, Don Towne, stated his estimate for the project was thirty-nine thousand dollars ($39,000.00) and both contractors’ were informed of the estimate. Vice Chairman, Richard Powell, asked what the footage was on the project and where is it located. Fulton County Surveyor, Don Towne, responded the project is upstream on Kevin Smith’s and Barry Lahman’s property. Don further stated that the landowners are paying for the work outside our scope. Don further explained our scope of work is brushing one side of the ditch and to the top of the bank on the other side. Fulton County Surveyor, Don Towne, stated he talked with Chairman, Roger Rose, and the work was given to Kirk Ingram for his low bid of twenty thousand dollars ($20,000.00), and Kirk has already started on the project. IN REF: JOE LEASURE TILE HEARING SET: CAUSE NO. 5-1983 #577 PARTIAL RECONSTRUCTION Fulton County Surveyor, Don Towne, stated he had drawn the whole system of the said drain for reconstruction and the cost per benefited acre was over six hundred dollars ($600.00) per benefited acre. Fulton County Surveyor, Don Towne, stated the tile is twenty-four (24) inch down to ten (10) inch. Don stated he backed off of doing the entire system and concentrated on just doing the portion that landowner, Bruce Beehler, is concerned about, which would be a new tile from the outlet up to the area where he has his pump. Fulton County Surveyor, Don Towne, stated back in 1983 the County replaced a stretch on Beehler with twenty (20) inch concrete tile. Don stated his proposal is to bring a twenty-four (24) inch tile up to meet the twenty (20) inch tile and “y” off and bring a spur up to his pump, which would be a fifteen (15) inch tile. Fulton County Surveyor, Don Towne, stated the proposed rate to reconstruct that portion of the tile system would be three hundred dollars ($300.00) per benefited acre with a three hundred dollar ($300.00) minimum. Vice Chairman, Richard Powell, asked, “What about the remainder of the system?” Fulton County Surveyor, Don Towne, stated if the landowners ask, then we can tell them the cost, then another hearing would need to be held. Don stated he does not feel the landowners would not want the entire system reconstructed at six hundred dollars ($600.00) per benefited acre. Chairman, Roger Rose, asked if this would improve the drainage in the area discussed. Fulton County Surveyor, Don Towne, stated it is a problem area for landowner, Bruce Beehler, because he cannot get his water into the tile. Don further explained that Bruce’s property is in a bowl, and the problem is that all the other landowner’s property drains into that area. Chairman, Roger Rose, stated it sounds like the bowl on Bruce Beehler’s property is the outlet. Don agreed with this statement. Vice Chairman, Richard Powell, asked, “How many acres does this bowl consist of?” Fulton County Surveyor, Don Towne, responded “Approximately twenty-five (25) acres.” There was discussion on who owned the most acres in the watershed. Fulton County Surveyor, Don Towne, stated Maurice Smith Family owns the most acres in the watershed, and then Bruce Beehler comes in with the second largest acres. Vice Chairman, Richard Powell, suggested that we bring the entire reconstruction cost to the hearing, and then we could back off. After further discussion, Fulton County Surveyor, Don Towne, commented we normally do bring in an entire project, but feel it would be best to propose the portion where we know needs to be replaced in order to help the landowner. Being no further discussion, Chairman, Roger Rose, entertained a motion to set a partial reconstruction hearing for the low end of the Joe Leasure Tile, Cause No. 5-1983, #577 in Wayne Township, Fulton County; to be held on Monday, June 9, 2008 at 9:30 D.S.T. in the Conference Room of the Fulton County Office Building. Richard Powell made a motion to set a partial reconstruction hearing on the Joe Leasure Tile, Cause No. 5-1983, #577 in Wayne Township, Fulton County; to be held on Monday, June 9, 2008 at 9:30 D.S.T. in the Conference Room of the Fulton County Office Building. Mark Rodriguez seconded the motion. Motion carried three to zero. COMES NOW, the Fulton County Surveyor presents to the Drainage Board a report for the partial reconstruction of the Joe Leasure Tile, Cause No. 5-1983, #577 in Wayne Township. Richard Powell made a motion to set the proposed rate at three hundred dollars ($300.00) per benefited acre with a three hundred dollar ($300.00) minimum. Mark Rodriguez seconded the motion. Motion carried three to zero. The Drainage Board now prepares its Schedule of Assessments which schedule contains a description, which has been taken from the Surveyor’s Report. The said Schedule of Assessments as passed by the Drainage Board in the captioned drain, which is attached hereto and made a part hereof, shows the percent of the estimated cost for the partial reconstruction for the landowners of the drain to be assessed against each of the said tracts of land which percentage being based upon the benefit of each tract of land for such proposed partial reconstruction rate. The percent allocated to all land benefited totals one hundred percent. Notices to be sent as per Indiana Statute, the hearing date to be set for Monday, June 9, 2008 at 9:30 A.M. D.S.T. in the Conference Room in the Fulton County Office Building. IN REF: MUD CREEK DISCUSS CAUSE NO. 3-1980 #723 MAINTENANCE WORK Fulton County Surveyor, Don Towne, stated there is approximately twenty-two thousand dollars ($22,000.00) in the maintenance fund, and there is retainage to be paid. Don stated the annual assessment is approximately one hundred and sixteen thousand dollars ($116,000.00). Don stated he would like to go ahead and take bids for the next phase of work, which would be from County Road 200 North to County Road 100 North, approximately seventy-six hundred (7600) feet. Don further stated the work would not be done until fall after crops are harvested. Don stated the work that was given to Kirk Ingram to do was approximately thirty-one hundred (3100) feet, which is on Barry Lahman on one side and Kevin Smith on the other side. Don further stated his estimate for the project is seventy-four thousand dollars ($74,000.00). Vice Chairman, Richard Powell, asked the Surveyor if we had a preferred stump height in the specifications. Richard Powell stated some of them are pretty tall. After further discussion, the Drainage Board decided to put a standard height on stumps to be left on the ditch bank to be a maximum of eighteen (18) inches. Being no further discussion, Richard Powell made a motion to include in the specifications for bid work that the stumps are to be cut to a maximum height of eighteen (18) inches. Mark Rodriguez seconded the motion. Motion carried three to zero. Fulton County Surveyor, Don Towne, stated he would plan on taking bids on the seventy-six hundred (7600) feet for the work to be done this fall after crops, unless the landowners are willing to let us do the work this summer. IN REF: CLIFF MCGEE OPEN RIGHT OF WAY CAUSE NO. 3-1969 #581 DISCUSSION Fulton County Surveyor, Don Towne, stated Wheeler Conley Jr. (Tim) is going to put in a modular home on his property, which is located on County Road 450 North and County Road 200 West. The home will be located at the east end of the property, and the said drain will be at the back of the property. Mr. Conley does not have a site plan at this time, but he has had soil borings, which indicates that the leach field would need to be put into the seventy-five (75) foot of the right of way. Don stated he couldn’t see any reason for the right of way to be changed in order to put in a leach field. Don further stated the leach field would only encroach the right of way approximately twenty-five (25) feet, and that would leave fifty (50) feet. Don further stated we are more concerned about improvements and structures above ground in the seventy-five (75) foot right of way. Vice Chairman, Richard Powell, asked, “Which side do we normally clean?” Don responded, “his side.” Don further stated once the house is there and the yard is keep nice, we would go on the other side of ditch. Tom Chudzynski stated that Dale Overmyer owns the ground on the north side of the drain. Drainage Board Secretary, Jean Cloud, stated Tim is going to sell the house that is presently on the tract of land with ground and keep the small portion at the east end of the property which will be approximately be two (2) acres. Fulton County Surveyor, Don Towne, stated when he talked with Tim and felt nothing needed to be done in reference to the seventy-five (75) foot right of way on the ditch, since there would be no improvements or structures on the right of way. After further discussion, Drainage Board Attorney, Greg Heller, stated since there will be encroachment on the easement of the said drain, we need Mr. Conley to sign an agreement holding the Drainage Board harmless of any damage in the event when the drain is cleaned. The Drainage Board agreed a letter needs to be sent to Mr. Conley stating a site plan should be brought into the Board, and an easement agreement needs to be signed by the landowner holding the Drainage Board harmless from any damage that could be done in the event the drain is maintained on his property. The agreement should be recorded and attached to his deed. IN REF: THOMPSON DITCH DISCUSSION Fulton County Surveyor, Don Towne, stated the drain is located west of the intersection of State Road 110 and State Road 17 approximately one quarter of a mile. Don stated there is approximately four hundred (400) acres in Marshall County, which drains south into this small drain. Don stated the drain goes across Tim Overmyer’s property and on south into the Tippecanoe River. Don stated Tim Overmyer wants to put a tile in the open drain and fill it in, in order to farm and irrigate his farm ground. Don stated Tim wants to put in a ten (10) inch tile, because it never carries water. Don stated the drain is in bad shape and needs cleaned. Don stated at the road there is a four (4) foot culvert. Don stated after doing some calculations, the tile should be at least a twenty-four (24) inch tile, and on a big rain event there should be some type of waterway, so the storm event can pass on and not block the landowners upstream. Don stated he contacted Marshall County Surveyor, Larry Fisher, and he agreed with Don’s calculations, one hundred percent (100%). Fulton County Surveyor, Don Towne, stated Tim Overmyer is not happy with his recommendation. Fulton County Surveyor, Don Towne, stated he brought this to the Drainage Board in the event that the Board member would receive phone calls on this situation. IN REF: LUCINDA SMITH OPEN DISCUSSION Fulton County Surveyor, Don Towne, stated this drain is located north Nyona Lake. Don stated that Miami County would also be involved in this watershed, and would like set up a Joint Board meeting. Don stated his office has taken shots on the main ditch and arms. Don further stated he has not received any information from Miami County, but will send the information to them as to what we have compiled. Don further stated the drain has not been cleaned since 1975. Don further stated the outlet for this system is Mud Creek. Don stated this is a county drain of record, and there are several drains within the watershed that are on maintenance, but this drain needs to be cleaned in order to have a good outlet for the other drains. Chairman, Roger Rose, asked, “Who is promoting the work on said drain?” Don responded, “Carl Ault and Gilbert Keller.’’ Don stated we need to get a Joint Board established and get things started on this drain. Don further stated that Tom Chudzynski has worked up the watershed for our county and Miami County. Don stated Miami County had been contacted, but never sent us any information. There is approximately 3960 benefited acres in the watershed. Fulton County Surveyor, Don Towne, stated the Board may want to go ahead an appoint a member to the Board. Richard Powell made a motion to appoint Roger Rose to the Joint Board. Mark Rodriguez seconded the motion. Motion carried three to zero. Fulton County Surveyor, Don Towne, stated for your information when Mud Creek was set up, it was set up as a Fulton County drain, no one above the dam or the landowners in Miami County were included in the Mud Creek watershed. Drainage Board Attorney, Greg Heller, stated according to Statute 36-9-27-4 two (2) members needs to be appointed, when there are only two (2) counties involved in a Joint Board. Greg further stated the fifth member must reside in a county not affected by the drain. Mark Rodriguez made a motion to also appoint Richard Powell to the Joint Board. Roger Rose seconded the motion. Motion carried three to zero. IN REF: ELIJAH MILLER MAIN ARM OPEN CAUSE NO. 11-1982 #589 JUD L HUDKINS CAUSE NO. 5-1998 #733 Drainage Board Secretary, Jean Cloud, stated she had received a letter from Chadd Baker of Right of Way Management Co. releasing the projects to the second lowest bidder per the telephone conversation with Surveyor, Don Towne. IN REF: JUD L HUDKINS UPDATE CAUSE NO. 5-1998 #733 Chairman, Roger Rose, stated we need to get the road repaired as soon as possible. Roger further stated we need to get a letter sent to John Hancock Mutual Life Insurance Co. Farm Manager stating that the Drainage Board’s intention is to repair the ditch at its present location and the financial obligation will be their responsibility. Drainage Board Attorney, Greg Heller, stated the letter needs to be sent certified return receipt, which the Statute states the landowner has ten (10) days to respond. IN REF: NYONA LAKE WATER SITUATION Mark Rodriguez asked Surveyor, Don Towne, if he had contacted Mr. Taflinger. Don responded he did contact Mr. Taflinger and gave him some tile sizes and informed him that it would be up to him and his neighbors to pay to have a tile put in. Don stated Mr. Taflinger stated he really was not having that much problem, it is the neighbors. IN REF: CLAIMS Vice Chairman, Richard Powell asked Surveyor, Don Towne, about the costs for tile repair. Richard Powell stated some of the claims look high. Don stated that may be high, but if there was eight (8) hours labor with a backhoe at one hundred dollars ($100.00) an hour, that would be eight hundred dollars ($800.00). Don stated at least we have someone doing the repairs, because some of the repairs should have been done over a year ago, but could not get anyone to do them. There was further discussion on this issue. IN REF: HUNNESHAGEN ARM #1 TILE DISCUSS REPAIR Fulton County Surveyor, Don Towne, stated Interim County Highway Superintendent, Mike Clark, called about water being over County Road 600 North west of State Road 17. Don further stated the high end of the said drain was blocked and Don talked with the landowners, Don Good and Dixie Sefchek, and contacted Jesse Rude to go out and unplug the tile. Don stated he talked with Chairman, Roger Rose, about taking care of the tile and paying the claim out of the GDI fund. Chairman, Roger Rose, entertained a motion to pay for clearing the obstruction on the said drain out of the GDI fund. Mark Rodriguez made a motion to allow for the payment for clearing the obstruction on the said drain out of the GDI fund. Richard Powell seconded the motion. Motion carried three to zero. IN REF: WORK ON DRAINS DISCUSSION Fulton County Surveyor, Don Towne, stated he has been giving work to Dale Overmyer, Jesse Rude or Josh Enyart. Don stated Josh called and said he was not going to be able to do the repairs. Don stated he has not given any repairs to Kirk Ingram or Henry Smith, because they are behind some and have bid work to do. Don further stated that he gave Kirk work in Newcastle Township on the Yellow Creek, Mikesell & Mahoney and George Barkman, which are county drains on maintenance.
