E.S.T. in the Conference Room of the Fulton County Office Building. Board Members present were Chairman, Roger D. Rose; Vice Chairman, Richard A. Powell; and Board Member, Mark J. Rodriguez. Also present were Don Towne, Fulton County Surveyor; Jean Cloud, Drainage Board Secretary; Bruce Beehler; Terry Weiss, R.E. Daake & Associates; and Bryan J. Clevenger, ForeSight Consulting, LLC. It is duly noted Drainage Board Attorney, Greg Heller, arrived at 10:15 A.M. E.S.T. It is duly noted Assistant Surveyor, Tom Chudzynski, was absent. Chairman, Roger Rose, called the meeting to order at 9:10 A.M. E.S.T. Chairman, Roger Rose, asked for any corrections or additions to the December 10, 2007 or January 14, 2008 Drainage Board Minutes. Chairman, Roger Rose, and Mark Rodriguez found one misspelled word in the January 14, 2008. Being no further additions or corrections, Chairman, Roger Rose, entertained a motion to approve the December 10, 2007 minutes as presented and the January 14, 2008 as amended. Richard Powell made a motion to approve the December 10, 2007 minutes as presented and the January 14, 2008 as amended. Mark Rodriguez seconded the motion. Motion carried three to zero. IN REF: HENRY GUISE ARM #1 TILE BID LETTING CAUSE NO. 6-2007 #798 Drainage Board Secretary, Jean Cloud, stated there were no bids received for the letting. Fulton County Surveyor, Don Towne, stated he would call Paul Guise and see if we could do the work in the summer. Don further stated he had invited Kirk Ingram, Allen Howe and Paul Slisher to bid on the project. IN REF: STONEY SLOPE DRAINAGE PLANS Fulton County Surveyor, Don Towne, stated the drainage plans involves the Mennonite School on County Road 325 West, just south of County Road 700 North, in Richland Township. Don further stated the school is included within the tract of ground and the taxes were high, so they are doing a split to put the school on a parcel. Don further stated in order to split it out, a subdivision has to be done. Don further stated when a subdivision is done, a drainage plan must be approved before it goes before the Plan Commission. Don stated the split contains two (2) acres with the school, which is all grass, and there is also a three (3) sided building on the site for horses. Don further stated the drainage plans shows that the parcel slopes to the north and west to the road, and there is a culvert under the drive. Don further stated that is the natural flow of the surface water. Don stated everything is existing. After further discussion, Chairman, Roger Rose, entertained a motion to accept the drainage plans for Stoney Slope in Richland Township. Richard Powell made a motion to accept the drainage plans for Stoney Slope. Mark Rodriguez seconded the motion. Motion carried three to zero. IN REF: JOE LEASURE TILE DISCUSSION FOR RECONSTRUCTION CAUSE NO. 5-1983 #577 Fulton County Surveyor, Don Towne, stated the said tile comes out of an open ditch on Maurice Smith’s property, then across Bruce Beehler’s property, and goes under the corner of Dan Sailor’s home and continues on. Don had an aerial on the tile. Don stated they have shot the entire drain. Don stated Bruce Beehler would like to have the tile reconstructed from the outlet to his pump station. Don further stated there is a lot fall coming up the hill. Don stated the tile is repaired a lot on the Lease farm and south of Dan Sailors this portion of the tile has been repaired a couple of times. Chairman, Roger Rose, asked if the tile is on maintenance and how much money is in the fund. Don responded the tile is currently on maintenance. Drainage Board Secretary, Jean Cloud, stated there a little over nine thousand dollars ($9,000.00) in the fund. Fulton County Surveyor, Don Towne, stated he does not have a proposed reconstruction cost for the project. Chairman, Roger Rose, asked, “What is the existing size of the tile?” Don responded it is a twenty (20) inch tile. Don stated the outlet pipe is twenty-four (24) inches. Bruce Beehler stated the tile across his property is a twenty (20) inch, and across Hanna’s he thought was a sixteen (16) inch. Don showed the Board on the aerial the portion of tile that has been replaced with eighteen (18) inch tile. Chairman, Roger Rose, asked Fulton County Surveyor, Don Towne, “How much are you proposing to reconstruct?” Don responded he had drawn the entire tile up, but would want to reconstruct from the open to the pump on Bruce Beehler’s property. Don further stated there is a hill once it leaves the pump. Chairman, Roger Rose, asked about the pump on Bruce Beehler’s property. Don responded the muck area on his property is drained into a tank, then pumped in to the tile. Vice Chairman, Richard Powell, asked, “If the tile is reconstructed, will it be deeper?” Fulton County Surveyor, Don Towne, stated it would be a little deeper in the one area. Chairman, Roger Rose, asked, “Would this eliminate the pump?” Don stated, “Yes, the new tile would come into the bottom of the tank.” After further discussion, Fulton County Surveyor, Don Towne, stated that Bruce Beehler brought in the petition today. Bruce Beehler commented that when he talked with the landowners in the watershed, most of them would not sign it. Chairman, Roger Rose, instructed the Surveyor to go ahead and get numbers put together and bring to next month’s meeting. Bruce Beehler asks if he could make a statement on this issue. Bruce stated his farm his in the middle of the watershed and receives the surface water from all the lands in the system, even the land from the south. Bruce also commented that the muck on his farm is too low for the main tile to drain, and that is why he pumps the water. Bruce stated through the years additional drainage has been added to the tile, and there is so much pressure in the tile, it backs out on his land. Bruce stated he is losing more crops every year. Bruce stated in the simplest way of saying this, the Beehler farm is serving as a cesspool for the watershed. Bruce further commented the pumping station was installed in 1979 and has worked pretty well up until the last year or so. Bruce stated there is just so much more additional drainage from the neighbors, that it is putting more pressure on the tile. Bruce further stated whether the whole system gets reconstructed or not is not my position. Bruce stated it needs it, but he personally would like to see it from the open up to the pumping station. IN REF: ROBBINS AND WALTERS TILE DISCUSSION CAUSE NO. 3-1982 #608 Fulton County Surveyor, Don Towne, stated the tile is located at the northeast corner of Country Meadows, and behind Schoolview Addition. Don stated that David Stowasser lives in Schoolview Addition. David remembered when the detention pond behind Wal-Mart did not work and flooded the subdivision and in the last two (2) rain events there was an area that did pond. Fulton County Surveyor, Don Towne, stated there is an earthen berm that Russell Egolf put in so that the water would not get into the addition. Fulton County Surveyor, Don Towne, further stated that Russell Egolf has purchased the lot east of Country Meadows, and tore the house down and is planning on developing the area and at that time a drainage plan will need to be submitted for approval. Don stated in order to put the landowners in Schoolview Addition at ease, a tile could be hooked into our tile and install a riser, and then development could hook into it. Don further stated when Country Meadows went in, the Drainage Board made them replace the tile across their property. Don stated there is a fifteen (15) inch tile across the property and ties in with a manhole at the corner of their property. Don stated the old existing tile is a ten (10) inch, and there is an old existing six (6) inch clay. Don stated an eight (8) or ten (10) inch lateral could be run, and it would take care of the ponding of water and would ease the concern of the landowners in Schoolview Addition. After further discussion, Chairman, Roger Rose, asked, “Who is going to pay for this work?” Don replied, “The maintenance fund.” Drainage Board Secretary, Jean Cloud commented that there is approximately fifteen hundred and forty-seven dollars ($1547.00) in the Robbins and Walters Tile fund. There was further discussion. Fulton County Surveyor, Don Towne, stated he drew it on the map and it would be no more than two hundred (200) feet, just far enough to get through the berm and install a riser. After further discussion, the Drainage Board gave their consensus to let the Surveyor proceed with installing the eight (8) or ten (10) inch tile to help eliminate the ponding of the water. IN REF: TROUTMAN HOGAN OPEN DISCUSSION ON WORK TO BE DONE CAUSE NO. 4-1995 #717 Fulton County Surveyor, Don Towne, stated there is quite a bit of fill in the whole ditch. Don stated at the upper end of the drain at County Road 250 South, the culvert is bad. Don stated he had Interim County Highway Superintendent, Mike Clark, looked at the culvert, and he agreed it is bad and the county highway will replace the culvert and lower it. Fulton County Surveyor, Don Towne, stated that Gale Field was concerned where we are proposing to start the project on County Road 1100 West that the culvert is too small. Don stated the culvert was two thirds full. Don stated he went out and checked the culvert and found it was too small, and Mike Clark checked the culvert and stated it was also too short. Don stated the culvert needs to be five (5) foot. Fulton County Surveyor, Don Towne, stated the project needs to start downstream on Gale Field to get a little fall. Don stated he feels approximately twelve hundred (1200) feet needs to be cleaned on Gale, and Gale feels we need to go completely across his property. Don further stated that Gale Field would like to bid on this project. Don stated he does not have a problem with him bidding on the project, as long as he has insurance. Don stated Gale is planning on renting equipment, if he would be the successful bidder. Don stated he explained to Gale that he would not be favored for the project, and he must have a Certificate of Insurance. After further discussion, Don stated the project would consist of eighty-four hundred (8400) feet plus the twelve hundred 1200 feet downstream as part of the bid. Gale Field stated he would like to go across his entire farm, which Don stated this would be a plus for the entire system. Drainage Board Secretary, Jean Cloud, asked if the maintenance fund would pay for the remainder of the work across his farm. Don responded “no, only the twelve hundred (1200) feet. Fulton County Surveyor, Don Towne, stated his estimate for the project is thirteen thousand four hundred and forty dollars ($13,440.00). Don stated with the 2008 assessment and the balance in the maintenance fund at the present, there would be approximately twelve thousand seven hundred dollars ($12,700.00) in the maintenance fund. Vice Chairman, Richard Powell, asked how do we justify doing the twelve hundred (1200) feet on Gale Field’s property. Fulton County Surveyor, Don Towne, stated none of Gale Field’s property is in the watershed, but we can justify the twelve hundred (1200) feet, because we need a good outlet. Fulton County Surveyor, Don Towne, stated there are no trees on area that we are proposing to clean. After further discussion, Chairman, Roger Rose, stated that the Surveyor should contact some of the landowners to get their opinion about allowing the landowner, Gale Field, to bid on the project, to make sure there is no opposition. Chairman, Roger Rose, stated the consensus of the Drainage Board is to allow the Fulton County Surveyor, Don Towne, to include in the project the twelve hundred (1200) feet downstream to be cleaned, which is not included in the maintenance. Chairman, Roger Rose, stated since Richard Powell owns ground within the Troutman Hogan Open watershed, he will abstain from any votes on the project. IN REF: AKRON COMMUNITY CENTER DRAINAGE PLANS Fulton County Surveyor, Don Towne, introduced Bryan Clevenger from ForeSight Consulting. Don stated he has drawn up the plans for the Akron Community Center, which includes drainage plans. Fulton County Surveyor, Don Towne, explained that the Sears Tile goes through the building site. Fulton County Surveyor, Don Towne, stated this is north of the intersection of State Road 14 and State Road 114. Don further explained the property is north of the housing addition on the west side of State Road 14. Fulton County Surveyor, Don Towne, stated the plans shows the proposed building and three (3) detention areas. Don stated there was concern about drainage being blocked in the northeast detention, so they are proposing to run a tile over to the Sears Tile. Fulton County Surveyor, Don Towne, stated the concern was the placement of sidewalks and the heating loop over the tile. Don further stated the plans show they are staying away from the tile as much as possible. Bryan Clevenger explained that the service lines of the heating system crosses the tile, but detectable warning tape will be installed and there are drawings for the geothermal heating system, so the area can be identified in the future. Vice Chairman, Richard Powell, asked if there is concern with the Sears Tile. Fulton County Surveyor, Don Towne, explained there have been holes fixed in the tile, but it is working ok. Don further stated the Sears Tile is an old tile. There was further discussion. Bryan Clevenger stated the majority of the area is lawn area. Bryan further stated the sidewalks at the back of the building are encroaching the tile and may have to be reworked if the tile is replaced. Bryan stated they tried to stay about thirty (30) feet from the tile. After further discussion, Fulton County Surveyor, Don Towne, stated the drainage plans for the Akron Community Center was sent to Jeff Healy at Banning Engineering, and there were comments made in reference to the plans, and ForeSight has addressed those issues. Fulton County Surveyor, Don Towne, stated the only concern he has is in the faint print on the plans are pines trees and deciduous trees. Bryan Clevenger explained along Rural Street there are existing trees. Fulton County Surveyor, Don Towne, stated he would not want trees planted in the easement. Bryan Clevenger stated someone else will be drawing the landscaping plans, and Bryan feels the focus will be on eastern side, which will be the front side of the building and the parking lot, and the back of the area would be natural or lawn/play area and there would not be any trees planted in that area. Bryan Clevenger stated they could coordinate with whoever is doing the landscaping plans that they need to pay attention to the tile easement. There was discussion about the Drainage Board reserving the right for approval of any trees being planted in the easement. Drainage Board Attorney, Greg Heller, stated that it could be made a condition of the approval. Chairman, Roger Rose, entertained a motion to approve the Drainage Plans for the Akron Community Center with the conditions discussed. Mark Rodriguez made a motion to approve the Drainage Plans for the Akron Community Center with the condition nothing can be done on the easement including but not limited to the planting of trees or building of structures, and the second condition would be that modifications could be made to the Sears Tile in the future. Richard Powell seconded the motion. Motion carried three to zero. IN REF: JUD L HUDKINS UPDATE CAUSE NO. 5-1998 #733 Drainage Board Attorney, Greg Heller, stated he had prepared an easement for the said drain. John Hancock Insurance owns the tract of ground where the easement is needed to restructure the ditch. Fulton County Surveyor, Don Towne, stated the easement is in Tract 5 on their deed. Drainage Board Attorney, Greg Heller, stated this easement agreement would go through the Fulton County Commissioners. Greg stated he wanted for the Fulton County Surveyor, Don Towne, to review the agreement and send it to the people involved in this issue. IN REF: ELIJAH MILLER MAIN ARM OPEN CHANGE AWARD CAUSE NO. 11-1982 #589 OF SPRAY BID Fulton County Surveyor, Don Towne, stated he had contacted Chadd Baker, Right of Way Mangement, who was awarded the spraying on said ditch. Don stated Right of Way was awarded two (2) projects at the letting, so he wanted to contact Chadd to see if wanted to accept the bids or give the work to the second lowest bidder. Right of Management is located in Auburn, Indiana and Don was not sure they would want to come this distance to do just two (2) projects. Don stated Chadd gave him verbal agreement to go ahead and award the work to the second lowest bidder. Drainage Board Secretary, Jean Cloud, stated she had sent a letter of bid results to Chadd Baker, and ask him to return a letter stating that he was releasing the projects to the second lowest bidder. Jean stated as of today, she had not received a letter giving us the release. The second lowest bidder on this drain is Shideler Spray. BOLLEY Fulton County Surveyor, Don Towne, stated Miami County Surveyor, Jeff Harvey, called and is trying to set up a meeting on said drain the week of February 25. Roger commented that Tuesday, the 26th or Wednesday the 27th in the morning would be good dates for him. IN REF: MUD CREEK DISCUSS WORK TO BE DONE CAUSE NO. 3-1980 #723 Fulton County Surveyor, Don Towne, stated the project on said drain is almost completed, except for the leveling. Don commented that Josh Enyart did a really nice job on the drain. Don stated Barry Lahman wants the next phase done as soon as possible. Don stated he has talked with a couple of contractor’s that might be interested in bidding on the next phase. Don stated when the work was done on the very upper end of the ditch a couple of years ago; the worse side of the drain was done and to the top of the bank on the other side was done at that time. Don stated when planning a project he tries to go from road to road in order to have it sprayed after the project is completed. Don explained that the worse side is on Barry Lahman’s side and the other side is on Kevin Smith. Don stated on Kevin’s side there is only brush on the north end, and he would also like to get his side done. Don also stated on Kevin’s side is where it was dredged years ago and there is high spoil on that side on the north end. Don stated this would be the last stretch of the real high spoil. Don stated he has talked with Barry Lahman and Kevin Smith and if the contractor would jump from one side to another to do work, it would be approximately an acre and a half outside the scope of the work. Don explained when the specs are written, we do the worse side and to the top of the bank on the other side, any thing else done is the landowner’s responsibility. Don stated if the landowners agree to pay for the work outside of the scope of the project, DNR would not have a problem with the work being done outside the scope of the project. Don stated he would like to contact three (3) contractors to get quotes for the project, because he would like to have the work completed by May 1. Don stated he does not want to wait and open bids at the next drainage board meeting. Don stated his estimate for the project is thirty-nine thousand dollars ($39,000.00). After further discussion, Don stated he would like to contact the contractors to have the bids in by the 22nd of February. Don further stated he would open the bids, and contact Chairman, Roger Rose, to discuss the bids and award the project to low bidder.
