D.S.T. in the Conference Room of the Fulton County Office Building. Board Members present were Chairman, Roger D. Rose; Vice Chairman, Richard A. Powell; and Board Member, Mark J. Rodriguez. Also present were Don Towne, Fulton County Surveyor; Tom Chudzynski, Assistant Surveyor; Jean Cloud, Drainage Board Secretary; Greg Heller, Drainage Board Attorney; and Jay Powlen. Chairman, Roger Rose, called the meeting to order at 9:07 A.M. D.S.T. Chairman, Roger Rose, asked for any additions or corrections to the August 11, 2008 Drainage Board minutes. Being no additions or corrections, Chairman, Roger Rose, entertained a motion to accept the August 11, 2008 Drainage Board minutes as presented. Richard Powell made a motion to accept the August 11, 2008 Drainage Board minutes as presented. Mark Rodriguez seconded the motion. Motion carried three to zero. IN REF: UPPER MILL CREEK CORRESPONDENCE CAUSE NO. 9-1998 Drainage Board Secretary, Jean Cloud, stated correspondence had been received from the Mill Creek Conservancy, stating they would pay for the approximately eighteen hundred (1800) feet to be cleaned which is west of the town of Fulton. IN REF: D MCMAHAN & GREEN OPEN ARM BIDS RECEIVED: CAUSE NO. 1-1992 #704 WORK AWARDED Drainage Board Secretary, Jean Cloud, stated the Surveyor’s estimate is $20,000.00 and the completion date for the project is April 15, 2009. There are three (3) bidders on the project. The Drainage Board determined that proper notice has been given to bid on this drain. Being no further discussion, Chairman, Roger Rose, entertained a motion to award the work on the Smith & Peterson Open to Ingram Excavating for their low bid of twenty-two thousand five hundred dollars ($22,500.00). Mark Rodriguez made a motion to award the work on the Smith & Peterson Open, Cause No. 2-1986, #655 in Newcastle Township; to Ingram Excavating for their low bid of twenty-two thousand five hundred dollars ($22,500.00). IN REF: UPPER MILL CREEK BIDS RECEIVED: CAUSE NO. 9-1999 #762 WORK AWARDED Drainage Board Secretary, Jean Cloud, stated the Surveyor’s estimate is $42,000.00 and the completion date for the project is April 15, 2009. There are three (3) bidders on the project. Fulton County Surveyor, Don Towne, stated his office sent out notices to the people in the Town of Fulton that we were going to clean out the ditch, and Don further stated he had received no response back from any of the landowners. The Drainage Board determined that proper notice has been given to bid on this drain. According to the Plans and Specifications set forth by the Surveyor, the following bids were opened and read aloud: CONTRACTORS LUMP SUM Ingram Excavating $35,750.00 Horn Development $43,900.00 Widner & Sons Excavating $38,700.00 Being no further discussion, Chairman, Roger Rose, entertained a motion to award the work on the Upper Mill Creek to Ingram Excavating with their low bid of thirty-five thousand seven hundred and fifty dollars ($35,750.00). IN REF: ROUCH DITCH #2 TILE UPDATE CAUSE NO. 4-1971 #604 Fulton County Surveyor, Don Towne, stated at last month’s meeting the hearing was held raising the maintenance rate, and the Board made the decision to remove the tree on Kathy Rentschler’s property. Don stated Kathy Rentschler was not at the hearing last month, Roger and himself went out and talked with Kathy at her request on Saturday. Don showed the Board an aerial showing where the tree was located on her property. Chairman, Roger Rose, stated they observed south of her property is a tree line, which is probably a fence line. Fulton County Surveyor, Don Towne, stated the old records states the tile goes parallel with the fence line just on the west side. Chairman, Roger Rose, stated the tree we are talking about is not a stately hundred year old oak tree. Roger further commented in terms of shade value, that is the landowner’s concern. Roger stated the landowner commented she would be willing to pay extra money in order to re-route the tile. Richard Powell asked if the proposal would be to install solid tile through the landowner’s property. Don Towne responded “yes”. Don further stated the proposal would be to put in solid tile until we get south and cross the road. There was discussion about the sandy soil in the area. There was discussion about the cost of solid tile and perforated tile. Fulton County Surveyor, Don Towne, commented there is no difference in cost. There was further discussion that there would be additional tile installed to save the tree. Fulton County Surveyor, Don Towne, stated the landowner would just like to save her tree. Chairman, Roger Rose, stated he made the observation and commented to the landowner that the tree did not have much of a future. Chairman, Roger Rose, also commented if the landowner loses the tree, she would like to have the ability to plant a tree in the same location, because it is directly west of her house. Roger stated the landowner must work around the leach field, so there are limited places where she can plant a tree. There was discussion about following the existing route of the tile. Mark Rodriguez commented if the landowner is not willing to pay the additional cost to save the tree, then we need to continue on with our decision that was made to last month’s meeting. Fulton County Surveyor, Don Towne, stated the landowner commented to him that she would be willing to spend extra money. There was discussion about going across the road. Fulton County Surveyor, Don Towne, stated is the past the county highway has always taken care of the road cuts. After further discussion, Jay Powlen, commented he does not feel the taxpayers should have to pay for the cut across the road. Fulton County Surveyor, Don Towne, commented we would have the go under the road no matter what we do. Don stated he would rather cross the road twice than go through the intersection. Mark Rodriguez commented at last month’s hearing the Board decided to take the tree down. Mark also commented the only thing that would sway him to change is if the landowner was at today’s meeting and say that she would cover the cost in order to save the tree. Mark stated the Board made the decision as being the best solution for the cause. Jay Powlen stated when he talked with Richard Powell, he mentioned about installing PVC. Jay commented that they would not pay the extra cost, but if we go out of our way to accommodate her, then she should have to pay for this. There was discussion on the PVC and HiQ solid tile. Don stated there are gasket seals available for the HiQ. Richard Powell commented if PVC was installed then that would guarantee whatever kind of trees are planted, it would not get in the tile. Richard Powell stated the best thing would be to get the tile completely out of her yard, but that is not one of the options and it would be very expensive. Chairman, Roger Rose, stated the landowner did commit to paying some extra money, but if it was two thousand dollars ($2,000.00) that would be beyond her means, but if we are looking at five hundred dollars ($500.00) then she could handle that. Roger stated we need to come up with a number and then let her decide. After further discussion, Mark Rodriguez commented there could be three (3) plans: Plan A would be go through her yard and take the tree out; Plan B would be the alternate route and maybe a Plan C. Don commented that the suggestion has been made to go the same route and put PVC in and leave the tree. Fulton County Surveyor, Don Towne, stated the PVC would not be much more than the HiQ tile. Don stated the twelve dollars ($12.00) per foot would be for twelve (12) inch HiQ tile. Don further explained the HiQ tile is what is used to cross the road. After further discussion, Chairman, Roger Rose, commented at the last month’s meeting, Jay Powlen’s concern was that if this fix did not work, and in a few years down the road it comes back to haunt us again, the Board members would be different at that time. Roger further commented that is how the Board came up with the decision of removing the tree, because it is in the tile right of way. After further discussion, Mark Rodriguez commented the Board is doing something beyond the normal to accommodate the landowners’ tree, and Mark feels that the landowner should have to bear the cost for that. Fulton County Surveyor, Don Towne, commented he is hearing from the Board to go the original route and use twelve (12) inch PVC, and see what the difference in cost is between tile and PVC and leave the tree. Don commented the PVC would be installed to the riser. Don commented once we are south of the road, then install perforated tile. Chairman, Roger Rose, asked Don if he would work up an estimate, and Don commented the PVC should be cheaper to lie than the tile, because it would not need to be backfilled with stone, except to bed in properly in the road for protection purposes. Richard Powell asked if there would something that could be added to the deed in order to protect us from more trees being planted in the easement of the tile. Drainage Board Attorney, Greg Heller, commented to protect the tree problem in the future, a contractual relationship with the landowner would need to be made and attached to the deed. This way when the property is transferred the agreement would stay with the property. Chairman, Roger Rose, commented the solution we have now protects the tiles interest with the existing tree and the trees in the vicinity. Fulton County Surveyor, Don Towne, stated if the existing tree would happen to come down and she planted another one, the tile would be protected in that particular area. There was further discussion about the property being transferred to a new landowner in the future, and this problem would exist at that time, and Drainage Board Attorney, Greg Heller, commented the tile would be covered under the State Statute at that time. After further discussion, Mark Rodriguez made a motion to amend the previous decision made by the Drainage Board in removing the tree on the property owned by Kathy Rentschler. Mark also included in the motion that the landowner in order to preserve the tree be responsible for the additional cost of installing PVC pipe instead of the normal HiQ tile in the existing route. Being no further discussion, Richard Powell seconded the motion. Motion carried three to zero. Chairman, Roger Rose, called for a recess at 10:10 A.M. Chairman, Roger Rose, called the meeting back to order at 10:15 A.M. IN REF: A.W. & A.H. GOOD TILE DISCUSSION Fulton County Surveyor, Don Towne, stated a hearing was held in 2003 to reconstruct the said drain and it did not go through at that time because the cost was excessive. The landowners want to try again to do reconstruction on the drain. Don further stated the proposed rate is twice the amount as what it was in 2003. Chairman, Roger Rose, asked, “What size tile is this?” Fulton County Surveyor, Don Towne, responded the tile is eighteen (18) inch to south of the road and then fifteen (15) inch. There was discussion about the swale that was put in a few years ago. It was discussed that a petition had been received from some of the landowners on the tile. Drainage Board Secretary, Jean Cloud, commented that the landowners that signed the petition are in Victory Garden, which is a subdivision off of County Road 200 N, between Old 31 and State Road 25. Fulton County Surveyor, Don Towne, commented that back in 2003 the proposed project was approximately eighty-nine thousand dollars ($89,000.00). Don further commented the proposed reconstruction rate was four hundred dollars ($400.00) per benefited acre with a fifteen hundred dollar ($1500.00) minimum. Fulton County Surveyor, Don Towne, stated today the proposed project is approximately one hundred and fifty-nine thousand dollars ($159,000.00) with a proposed reconstruction rate of seven hundred dollars ($700.00) per benefited acre with a twenty-four hundred dollars ($2400.00) minimum. There was discussion about the approved Drainage Plans for the subdivision. Fulton County Surveyor, Don Towne, commented at the time the Drainage Plans for the subdivision was approved by the Board, knowing there were potential water problems; and the Board made a condition on the plans that there be no basements in the homes constructed. After further discussion, the Drainage Board Attorney, Greg Heller, commented with the Area Plan being created, we will probably not have this type of situation in future. Fulton County Surveyor, Don Towne, stated he has a petition signed by seven (7) landowners. Drainage Board Attorney, Greg Heller, commented the statute reads the petition must reflect ten percent (10%) of the acreage or twenty-five percent of the assessed value. After further discussion, Drainage Board Secretary, Jean Cloud, commented that we do not use assessed values for ditches. After further discussion, Drainage Board Attorney, Greg Heller, stated he would do some further research on the statute requirements for the petition. IN REF: WILLOW CREEK-LITTLE MILL CREEK DISCUSSION CAUSE NO. 6-1995 #714 Fulton County Surveyor, Don Towne, commented Willow Creek is set up on maintenance in our county. Don further stated Pulaski County does not have the drain set up on maintenance in their county. Don stated approximately three (3) or four (4) miles into Pulaski County a landowner has put in the pipe in the ditch and it is backing up water. Don further commented on big rain events it blew it out, and they just filled it back in. Don stated that Mr. Krohn came in and is really concerned because it is backing up on him and the big muck farm on State Road 14. Don further explained that he had contacted Pulaski County Surveyor, Joyce Weaver, and discussed the situation with her and explained that when we had taken shots the pipe is too small. Don stated Joyce took this issue to their Board and they would not do anything until he had a petitioned signed to get the pipe taken out. Don stated Mr. Krohn is asking our Board to take some action on this, but Don stated he does not feel our county should get involved. There was further discussion on this issue, because it is a regulatory drain and State Statute 36-9-27-46 covers it. The petition is required when it is a mutual drain or a waterway. After further discussion, it was decided that the Drainage Board send a letter to Pulaski County Drainage Board explaining the statute 36-9-27-46, and that we have a concern with the obstruction, which could affect the drain in our county. IN REF: COUNTY LINE LANDFILL DISCUSS EXPANSION AND DRAINAGE PLANS Fulton County Surveyor, Don Towne, stated he had received drainage plans for the County Line Landfill. Don stated he has sent the drainage plans to Jeff Healy at Banning Engineering. Don stated that Jeff also has concerns with their drainage plans. Don explained that the landfill wants to redesign the area and put in a detention area and a wetland and bring all the water to an existing twelve (12) inch tile, which is over a hundred years old. Don further explained that the overflow will go into the side ditch along Old 31, which is an eighteen (18) inch tile, and it is not a ditch, but just a waterway. Don further explained that the landfill is proposing a twenty-four (24) inch orifice, which is bigger than anything we can handle. Don further explained at the top of the twenty-four (24) inch tile is a twelve (12) inch pipe, with an overflow to a thirty-six (36) inch pipe. Don stated the thirty-six (36) inch tile would be hitting the twelve (12) inch tile, plus the eighteen (18) inch pipe under the road. Don stated it would take five (5) eighteen pipes under the road to equal the thirty-six (36) inch pipe running full. Don further stated that gives you an idea of how much water will be hitting our twelve (12) inch pipe. Don commented that Jeff commented the landfill would need to redesign to let the water out slower, or reconstruct the tile. Don commented that he and Jeff would be meeting with the landfill people on September 18. Don also commented according to Statute, when moving water from one watershed to a neighboring watershed a hearing must be held to notify landowners. Fulton County Drainage Board Attorney, Greg Heller, stated 36-9-27-42 d covers the moving of water from one watershed to another watershed. After further discussion, Fulton County Surveyor, Don Towne, commented when the hearing is held he will have to sit out, because the tile goes through some of his property. IN REF: CHANGE MEMBERS REQUEST FROM OF DRAINAGE BOARD MARK RODRIGUEZ Mark Rodriguez commented he had asked Richard Powell and Roger Rose to consider the idea of changing the Drainage Board members. Mark commented he realizes that the one option is the Drainage Board being made up of the County Executive and then there is option, which requires one (1) County Executive. Drainage Board Attorney, Greg Heller, stated the Statute reads a three (3) or five (5) member board. Mark Rodriguez stated his preference would be not to be on the Drainage Board, but he would like to use his skills to be spent more on computerization concerns of the county and the law enforcement side. After further discussion, Chairman, Roger Rose, commented he is definitely a proponent for a smaller board, because the more people the lengthier the discussion and it is harder to come to a consensus. Chairman, Roger Rose, commented that in terms of accommodating Mark’s request, it is very reasonable and Mark does have substantial expertise in one area and we would be foolish not utilize him at his fullness extinct. There was discussion about doing this the first of the year, and Mark commented he would like to continue on for at least three (3) or four (4) months to bring some balance to the lack of experience. Mark further commented that he would look for a replacement with lot of knowledge. After further discussion, Drainage Board Attorney, Greg Heller, stated a Resolution would need to be made through the Commissioners changing the make up of the Drainage Board. IN REF: BOARD MEMBER CONCERNS Vice Chairman, Richard Powell, asked if Henry Smith was working on the projects that should have been completed. Fulton County Surveyor, Don Towne, responded “No. After brief discussion, Drainage Board Attorney, Greg Heller, suggested a letter be sent giving him ten (10) days to be out on the projects, or it will be turned over to the Attorney to proceed with legal action. The Board suggested the letter be sent certified, return receipt. Fulton County Surveyor, Don Towne, commented Bill Morris stated the work would be done after crops harvest.
