D.S.T. in the Conference Room of the Fulton County Office Building. Board Members present were Chairman, Roger Rose; and Board Member, Mark Rodriguez. Also present were Don Towne, Fulton County Surveyor; Tom Chudzynski, Assistant Surveyor; Jean Cloud, Drainage Board Secretary; Greg Heller, Drainage Board Attorney; and Rick Berger, BSA Life Structures. It is duly noted that Vice Chairman, Richard Powell, was absent. Chairman, Roger Rose, called the meeting to order at 9:04 A.M. D.S.T. Chairman, Roger Rose, asked for any additions or corrections to the minutes of the July 7th Special Meeting and the minutes of the July 14th regular Drainage Board minutes. There were no corrections to the July 7th minutes and one correction to the July 14th minutes. Being no further additions or corrections, Chairman, Roger Rose, entertained a motion to approve the July 7th Special Meeting minutes as presented and the July 14th minutes as corrected. Mark Rodriguez made a motion to approve the July 7th Special Meeting minutes as presented and the July 14th minutes as corrected. Roger Rose seconded the motion. Motion carried two to zero. IN REF: WOODLAWN HOSPITAL DRAINAGE PLANS EXPANSION Rick Berger from BSA Life Structures presented drainage plans for the Woodlawn Hospital Expansion. Mr. Berger stated the drainage plans had been reviewed by the Fulton County Surveyor and the County’s reviewing agency. Mr. Berger stated the proposal is a two-story expansion to the south of the existing hospital. Mr. Berger stated the concept is that the majority of the drainage will be collected and go through a new retention basin to the south. Mr. Berger further stated the intent of the retention system is to infiltrate the water into the soil and there is an emergency spillway and another outlet that would tie into Mill Creek. Mr. Berger stated that this meets the requirements of the Drainage Board. Mr. Berger further stated the area to the north would drain into an existing wetland area. Mr. Berger stated the runoff is a minimal amount of increase to the area and would utilize the existing closed basin for detention, which will go through an existing culvert under the north drive. Mr. Berger stated as part of the review comments, one of the comments was making sure that we do not damage the integrity of the existing wetland. Mr. Berger explained they have constructed a sediment trap for a storm water quality best management practice, which would be native grass materials to allow the water to filter before entering into the wetland area. Mr. Berger stated they would also use a native species for the plantings at the retention pond to the south. Mr. Berger stated they will also make sure they have an adequate pond bottom, and does not end up being a mud bog. Mr. Berger stated they have addressed all the comments and issues that were submitted by Banning Engineering. Mr. Berger stated they are looking to start construction in September. Fulton County Surveyor, Don Towne, asked if there was a list of the plantings. Mr. Berger stated the species are all listed on the set of plans. There was discussion on the species to be used in the retention area. Chairman, Roger Rose, asked Mr. Berger, “How much of the time would there be standing water?” Mr. Berger replied, “ It would not be more than twelve hours.” Mr. Berger had a site plan of the project, which he explained to the Drainage Board. Being no further discussion, Chairman, Roger Rose, entertained a motion to approve the Drainage Plans for the expansion project of Woodlawn Hospital as presented. IN REF: COUNTY LINE LANDFILL DISCUSSION EXPANSION Fulton County Surveyor, Don Towne, stated he had received plans from Shaw Environmental and commented he also had several concerns. Don further stated he has sent the plans on to Jeff Healy at Banning Engineering to review. Don further stated he feels a letter needs to be sent, because they are not recognizing the need to get approval from the Drainage Board before proceeding with their expansion. Don stated his concerns are that the proposed plans indicate they are moving water from one watershed to another watershed. Don also stated he is concerned with the capacity of the tile being able to handle the additional water. Don also commented that Jeff Healy also feels a letter needs to be sent to them stating the Drainage Board must approve the plans. Chairman, Roger Rose, stated considering the circumstances, “Would it be more appropriate that the letter come from our Attorney?” Roger stated he is thinking in terms of what is going to get their attention, and a letter from the Attorney would raise the level of awareness. Mark Rodriguez commented that a letter from the Board be sent stating the issue had been brought to their attention, and it is the Drainage Board’s responsibility to approve drainage plans before a project moves forward. After further discussion, Chairman, Roger Rose, stated that a certified letter be sent to the County Line Landfill, Shaw Environmental and JFNew stating that Drainage Board approval is required before a project can move forward. Chairman, Roger Rose, stated they would take a short recess at 9:29 A.M. D.S.T. Chairman, Roger Rose, called the meeting back to order at 9:35 A.M. D.S.T. IN REF: ROUCH DITCH #2 TILE HEARING:ORDER MADE CAUSE NO. 4-1971 #604 NOTICE PUBLISHED Chairman, Roger Rose, opened the hearing on said drain at 9:36 A.M. D.S.T. The following landowner/representative was in attendance: Jay Powlen. Chairman, Roger Rose, read the following: The purpose of the hearing is to increase the maintenance rate. The landowner letters were mailed on July 8. The legal publication was on July 31. There are 245.72 benefited acres in the watershed. There are 13 parcels and 8 landowners. The present maintenance rate is $1.397 per benefited acre with a $5.00 minimum. The proposed rate is $5.00 per benefited acre with a $10.00 minimum. As of today there are no letters of objection. Chairman, Roger Rose, asked Fulton County Surveyor, Don Towne, to give the Board an overview of the project. Don presented an aerial and explained to the Board where the tile is located, and the tile needs to be replaced on Kathy Rentschler’s property. Don further commented the tile is plugged with tree roots. Don further explained this summer a contractor ran a jetter through the tile and got the water flowing some. Don stated the proposal is to replace the tile south of road, and Don explained there is a riser and catch basin in the landowner’s yard. Don further stated several years ago the County Highway took out some trees in her yard along the road. Don stated the landowner wants to save the tree in her yard. Don stated when we got the big rains in January and February; the water came across the road. Chairman, Roger Rose, asked if the tile would be rerouted. Don commented the tile would be put in the same place, but will be using solid tile around the tree. Don stated it would be better to go on the other side of the road, but the cost would be greater. After brief discussion, Don commented the tile is only about twenty (20) feet from the tree. There was discussion about the solid tile connections. Chairman, Roger Rose, asked Jay Powlen if he was in support of the project. Jay commented he was in support of getting the tile fixed, but not in support of the ideas of fixing the tile. Chairman, Roger Rose, asked Jay what his solution would be for the problem. Jay stated he would be all right with solid tile, if it could be sealed that the roots would not get into the tile. Don explained when the other trees were taken down back a few years ago, the neighbors did not want that tree taken down because of shade, and that is Kathy’s reason for not wanting the tree taken out. Don stated we normally just take the tree out, but since it is in her yard we did not go that route. Jay commented it is a soft maple, and as far as shading the house, in late afternoon it only shades the southwest corner of her house. Don commented on the south side of the road in the right of way is Fulton sewer discharge line, which is right above our tile. After further discussion, Jay Powlen commented we have always taken the position of trying to get along with the property owners and have bent over backwards, but this has been going on for approximately twelve (12), thirteen (13) years. Chairman, Roger Rose, asked, “How deep is the tile?” Don replied in Kathy’s yard the tile is not very deep, but on the south side of the road it is probably at least six (6) foot deep or more. Don further stated the soils are not good. Chairman, Roger Rose, asked, “How many linear feet are we replacing?” Don stated if we follow the other tile, it would be approximately one hundred seventy-five (175) to two hundred (200) feet of twelve (12) inch tile. Chairman, Roger Rose, asked Surveyor, Don Towne, “How secure will the seal be, are you concerned that the roots will find their way back into the tile?” Don commented they shouldn’t with the smooth flow pipe with a gasket seal and taped. Don commented the problem they normally have with the soils and wet ground, is keeping it afloat while installing it. Don stated that is the biggest obstacle. Chairman, Roger Rose, asked, “When would the work be done?” Don commented, “It could be done at any time”. Don asked Jay about crops on this property. Jay commented it didn’t make any difference, it could be fixed now. Don stated the tile is not too far on Jay’s property, it is right in the corner. It was stated there would be a cut in the intersection of the road. There was discussion about work being done in the right of way. Board Member, Mark Rodriguez, asked if the tree was in the right of way. Chairman, Roger Rose and Don Towne commented the tree is in the tile right of way. After further discussion, Chairman, Roger Rose, stated that brings up an interesting question, that we are going to spend additional money over time to accommodate this tree. Where does our obligation begin and end, because the tree is in the tile right of way? After further discussion, Chairman, Roger Rose, asked if what we are doing, “Is it going to be a long term fix. Chairman, Roger Rose, stated it could be anticipated that this tree is going to cost more money down the road, and the cost should not be borne by watershed. Chairman, Roger Rose, stated the dilemma is that we know there is a tree that is not working in the interest of the tile. Chairman, Roger Rose, commented that the Drainage Board has the authority to have the tree removed. Fulton County Surveyor, Don Towne, stated the landowner is aware of this issue. After further discussion, Chairman, Roger Rose, stated the Board must maintain a standard as to what can be allowed in the right of way. Roger further stated it seems that we have to our advantage that we allow this tree to continue to strive for twenty (20) some years and now it is costing us some money, and we know it is a particular species of tree that is not good to have over a tile because of the nature of its roots. Roger stated in order to see consistency in a policy; he would like to see the tree removed. There was further discussion on this issue. Jay Powlen commented that an option could be given to the landowner, if they want the tree saved, then the landowner pay for the rerouting of the tile. Jay further stated the other landowners should not have had to pay for the observation of the tile to find out if it was the tree causing the problem. Fulton County Surveyor, Don Towne, stated if we go ahead and do the work there are two (2) options, put in perforated tile and remove the tree or if the landowner wants to save the tree, then solid tile would be put in at the landowner’s expense. There was discussion about rerouting the tile. Fulton County Surveyor, Don Towne, commented it would be costly to reroute the tile. Mark Rodriguez commented he has not heard a good plan for a long term solution. Jay Powlen commented he would go along with putting in solid tile to save the tree, but if there are problems ten (10) to fifteen (15) years down the road, then it is time for the landowner to pay for the repairs, because the other landowners should not be responsible for their wants. After further discussion, Chairman, Roger Rose, entertained a motion to increase the maintenance rate from $1.397 per benefited acre with a $5.00 minimum to $5.00 per benefited acre with a $10.00 minimum on said drain. The tree, which is encroaching on the right of way of said tile, will be removed before proceeding with the work on said drain. IT IS NOW ORDERED, by the Fulton County Drainage Board that the Schedule of Assessment has been approved to increase the maintenance rate of the Rouch Ditch #2 Tile, Cause No. 4-1971, #604; in Liberty Township, Fulton County, Indiana. The said Board orders that one notice be published in this cause of action promptly in the Rochester Sentinel and the Observer, newspapers of general circulation throughout Fulton County, which notice shall properly identify the drainage proceedings and further state the Findings and Order of said Board has been filed and is available in the Office of the Fulton County Surveyor. IN REF: GRASSY CREEK/GAULT DITCH CORRECTION Fulton County Surveyor, Don Towne, stated he had reported last month that Randy Sommers had a portion of the open ditch dammed up on this property. Don stated the Board had given him approval to proceed with cleaning out the dammed portion. Don stated the actual work was done on the J Traverse Open and not the Grassy Creek. Fulton County Surveyor, Don Towne, commented that the Traverse Open is also set up on maintenance, therefore, the claim for the clean out will be taken out of that ditch fund. IN REF: C.B. MASTELLAR OPEN HEARING SET:INCREASE CAUSE NO. 19-1968 #689 MAINTENANCE RATE Fulton County Surveyor, Don Towne, stated the open drains into Lake Manitou, but the drain is only set up on maintenance in Henry Township. Don stated there is a lot of wooded area on said drain, and a portion of the open was cleaned out several years ago. Don stated the current maintenance rate on said drain is $.1375 per benefited rate with a five dollar ($5.00) minimum. Don is proposing to raise the maintenance rate and do the work this fall or before crops are planted next spring. Fulton County Surveyor, Don Towne, is proposing nine dollars ($9.00) per benefited acre with a ten dollar ($10.00) minimum for two (2) years or six dollars ($6.00) per benefited acre with a ten dollar ($10.00) minimum for three (3) years. Don stated the clean out would be from County Road 650 E and upstream to the end of the ditch. Don stated the money that has been spent on the drain is for removal of beaver dams. Don stated there would be approximately four thousand (4000) feet to clean at approximately two dollars and seventy-five cents ($2.75) a foot, or an estimated total amount of eleven thousand dollars ($11,000.00). Don commented the drain would not be cleaned through the wooded area at the outlet. Being no further discussion, Chairman, Roger Rose, entertained a motion to set the hearing to increase the maintenance rate on the C B Mastellar Open, Cause No. 19-1968; #689; Henry Township, Fulton County; to be held on Monday, November 10, 2008 at 9:30 a.m. D.S.T. in the Conference Room of the Fulton County Office Building. The proposed rate to be six dollars ($6.00) per benefited acre with a ten dollar ($10.00) minimum and be in affect for three (3) and then the Board review the ditch fund at that time. IN REF: DAVIS & BECK TILE INFORMATION CAUSE NO.13-1968 #529 STEINKE WILSON ARM #1 Fulton County Surveyor, Don Towne, stated both drains have been shot for reconstruction. Don has an estimated cost of over seven hundred dollars ($700.00) per benefited acre. Don stated he has given petitions to landowners and given them the estimate. Don stated he does not know if the petitions will come back in or not. IN REF: SILVER MAPLE DRIVE UPDATE Fulton County Surveyor, Don Towne, commented there was to be a swale put on the north side of the drive. Don stated when the sewer project was put in, the contractor put a ditch on that side of the drive with twelve (12) inch pipes under the driveways and the ditch is deep. Don stated that Norm Steigley is very happy, but the neighbors on the north side of the street are furious. Don talked with the representative from Wightman Petrie. Don stated the representative stated that was not the specifications of the work to be done. Don stated the landowners on the north side had a tile with stone backfill originally on the north side of the road. Don stated he asked the representative to put the tile back to its original state and put a swale over the top of the tile. Don also asked that a catch basin be put in, in front of Norm Steigley’s. There was further discussion on this issue. IN REF: FRANK SPERRA TILE DISCUSSION CAUSE NO. 31-1967 #622 Fulton County Surveyor, Don Towne, stated part of this drain is open and part of it is tile. The portion of the drain we are concerned about is the open stretch. Don further explained the entire drain outlets into an open ditch. Don explained it is tile from the road to the railroad and an open drain to Summit Lake. The landowner at Summit Lake has commented that the ditch is blocked off enough the water is above his pier. Don stated they could see that the ditch does need cleaned from the railroad upstream. Don further explained they would need to go across other people’s property to get to the drain to clean it out and the landowner that wants the work done on the drain and the other landowner are not getting along. Don explained the landowner’s whose property we have to go back through to get to the drain, does not want us to help the other landowner. After further discussion, Don stated he has talked with the lady and she was to talk to her husband about us crossing their property, but have not heard from them. Drainage Board Attorney, Greg Heller, stated according to IC 36-9-27-33 we have the right to enter on private property in order to get to our right of way and oral or written notice must be sent to the landowner notifying them that we are going to be coming on their land to get to the legal drain. Greg further stated the Statute says we do not commit criminal trespass by doing this. Greg further stated a reason for why we want to do this must be included in the notice. Greg also stated if there is resistance from the landowner, we may have to petition with the court. Fulton County Surveyor, Don Towne, stated not to send a letter at this time.
