D.S.T. in the Conference Room. The following were present: Chairman, Roger Rose; Vice Chairperson, Sherry Fulton, Board Member, Stanley Musgrave; Fulton County Surveyor, Don Towne; Assistant Surveyor, Tom Chudzynski; Drainage Board Secretary, Jean Cloud; Drainage Board Attorney, Greg Heller; and Kerry Schoeph from MSKTD. Chairman, Roger Rose, called the meeting to order at 9:01 A.M. D.S.T. Chairman, Roger Rose, asked for any additions or corrections to the May 10, 2010 minutes. Being no additions or corrections, Chairman, Roger Rose, entertained a motion to approve the minutes as presented. Sherry Fulton made a motion to approve the May 10, 2010 minutes as presented. Stanley Musgrave seconded the motion. Motion carried three to zero. IN REF: KROGER EXPANSION DRAINAGE PLANS Kerry Schoeph from MSKTD & Associates, Inc. presented drainage plans for the expansion of the old Scotts building at Peace Tree Village, which is now owned by Krogers. Kerry explained they are doing the civil engineering for Krogers. Kerry explained Krogers is planning on doing renovation and expansion of the old Scotts store. The site was originally laid out for expansion at the north end of the building. Kerry explained there is an existing detention on the west side of the building. Kerry explained the documents for the project will be completed in July, and hopes to start construction in August and be completed in the spring 2011. Kerry stated he has run the numbers for the existing detention pond, and commented there is also an adjacent detention area on west on the neighboring property. Kerry also commented the plans are to renovate the parking lot with new lightning, but will not be increasing the size of the parking lot. Kerry also commented there will be a remote pharmacy installed in the parking lot. Kerry commented the expansion area will be approximately 19,900 square feet. Fulton County Surveyor, Don Towne, commented he had talked with Kerry and had him run numbers for all the water coming into the detention and the numbers are o.k. Kerry commented there is an eighteen (18) inch pipe that connects the two (2) ponds with an eighteen (18) inch outlet. Surveyor, Don Towne, stated there is an eighteen (18) inch orifice at the north end that outlets into Minnow Creek. Kerry commented he checked on the Rule 5 and the site is under an acre and has talked with IDEM and they would not require a permit. After brief discussion, Kerry commented even if a Rule 5 permit is not needed, the items required are on the drawings. Being no further discussion, Chairman, Roger Rose, entertained a motion to approve the Drainage Plans for the Kroger expansion. Stanley Musgrave made a motion to approve the Drainage Plans as presented. Sherry Fulton seconded the motion. Motion carried three to zero. Kerry commented the plans are not the final set. Kerry commented they do not sign the plans until Krogers officially puts the project out for bid. Kerry commented he will leave the two (2) sets of plans. Kerry commented the plans will not change, and when the final set is signed he will send a copy for the Drainage Board to sign. IN REF: UPPER MILL CREEK SECOND REQUEST TO LOWER CAUSE NO. 9-1999 #762 MAINTENANCE RATE The current rate on this drain is $3.00 per benefited acre and there is over $60,000.00 in maintenance fund. Surveyor, Don Towne, commented the entire drain was recently clean for a bid amount of approximately $35,000.00. Surveyor commented the Board could lower the rate to $2.00 per benefited acre, which would be sufficient to take care of the drain. Surveyor, Don Towne, commented Mike Early talked with neighbors, Ned Rentschler, Raymond Rentschler, Tim Rentschler and Oris Baker, and they would also like to see the maintenance rate lowered. After brief discussion, Chairman, Roger Rose, entertained a motion to lower the rate on the said drain to $2.25 per benefited acre. IN REF: GEORGE RENTSCHLER ARM #4 OPEN REMOVE ACRES FROM CAUSE NO. 10-1999 #763 WATERSHED Surveyor, Don Towne, stated landowner, Mike Early, reported he has tiled his property to a ditch to the west at his property line and therefore, needs to be removed from said drain watershed. Remove the following benefited acres: Tax ID # 005-105004-00 Benefited acres - 13.38 Being no further discussion, Chairman, Roger Rose, entertained a motion to remove 13.38 benefited acres from said watershed. Sherry Fulton made a motion to remove the 13.38 benefited acres from said watershed. Stanley Musgrave seconded the motion. Motion carried three to zero. IN REF: STORMWATER INFORMATION DISCUSSION Assistant Surveyor, Tom Chudzynski, drafted a specification or guideline for contractors to use for drawing up drainage plans for new developments. After further discussion, the comment was made that the County has never had a Stormwater Ordinance in the past. There will be further research done on this issue.
