D.S.T. in the Conference Room of the Fulton County Office Building. The following members were in attendance: Chairman, Roger Rose; Vice-Chairman, Sherry Fulton; and Stan Musgrave. Others in attendance were Fulton County Surveyor, Don Towne; Assistant Surveyor, Tom Chudzynski; Drainage Board Secretary, Jean Cloud; and Drainage Board Attorney, Greg Heller. Chairman, Roger Rose, called the meeting to order at 9:05 A.M. D.S.T. Chairman, Roger Rose, asked for any additions or corrections to the minutes of April 12, 2010. Being no additions or corrections, Chairman, Roger Rose, entertained a motion to accept the minutes of April 12, 2010 as presented. Sherry Fulton made a motion to accept the minutes as presented. Stan Musgrave seconded the motion. Motion carried three to zero. IN REF: WILLIAM WALSH OPEN BIDS RECEIVED: CAUSE NO. 1-2010 #805 WORK AWARDED Surveyor Estimate: $13,350.00 Completion Date: December 15, 2010 The following bids were received: Jim Ingram Excavating $12,000.00 Jesse Rude $14,741.00 Gudas Excavating $ 6,944.00 LDP Excavating $11,780.00 Overmyer Excavating LLC $11,680.00 Stan Musgrave made a motion to award the project to Gudas Excavating for his low bid and total bid of $6,944.00. Surveyor Estimate: $24,000.00 Completion Date: April 1, 2011 The following bids were received: Jim Ingram Excavating $12,000.00 Jesse Rude $21,445.00 Gudas Excavating $17,433.00 LDP Excavating $16,975.00 Overmyer Excavating LLC $16,780.00 Ramer Excavating $13,199.00 Prairie Marsh, Inc. $20,808.00 Chairman, Roger Rose, commented the low bidder is Jim Ingram Excavating, but there are some outstanding issues about billing not being received in a timely manner. After much discussion, Fulton County Surveyor, Don Towne, commented the contractor will have his invoices turned in by the next Drainage Board meeting. Sherry Fulton made a motion to award the project to Jim Ingram Excavating for his low bid and total bid of $12,000.00, with the condition that the Contractor has his invoices turned in by the next Drainage Board meeting. Stan Musgrave seconded the motion. Motion carried three to zero. IN REF: AW & AH GOOD TILE SET HEARING: RECONSTRUCTION CAUSE NO. 3-2010 # 787 AND ESTABLISH A MAINTENANCE RATE L N BAIR OPEN SET HEARING: RECONSTRUCTION CAUSE NO. 1-1970 #507 AND INCREASE THE MAINTENANCE RATE The tile starts at the railroad tracks and comes south through the subdivision, Victory Gardens. Reconstruction hearing back in 2003 was turned down, and in 2008 some landowners wanted to try again to have a reconstruction hearing, but nothing was done at that time. FEDCO is now proposing to extend sewer and water lines out Fourth Street. The new proposal for the Good Tile would be to run it to State Road 25, which will change the previous watershed. Some property west of State Road 25 and north of Fourth Street is now on the Plan Commission table to rezone to Commercial. The L.N. Bair Open will also need to be reconstructed at the same time. The proposed reconstruction of the open will start north of County Road 300 N in order to remove some silt from the open ditch. Every pipe south of the County Road 300 N will need to be lowered. The two (2) existing pipes at the railroad are too high, and will need to be taken out and put in one (1) pipe, or go north of the two (2) pipes and put in a forty-two (42) inch for forty-eight (48) inch pipe at grade and leave the two (2) existing pipes in, which has been approved by Jeff Healy of Banning Engineering. The railroad is used by WilsonТs and is not very active. The hearing in 2003 the cost of the pipes at the railroad crossing according to Statute would have been cost shared, half by the landowner and half by the maintenance fund. Chairman, Roger Rose, commented the landowner have concerns about the future of the railroad, and does not know where they would stand on this project. The tile project consists of 3200 feet of twenty-four (24) inch; 1850 feet of eighteen (18) inch; 2550 feet of fifteen (15) inch; and there will be risers installed. FEDCO has committed to $150,000.00 towards the project. The following are the proposed reconstruction rates for the A.W. & A.H Good Tile: Commerical $ 700.00 per benefited acre Light Commercial and Farm Plus (Commercial Potential) $ 500.00 per benefited acre Farmground $ 350.00 per benefited acre Residential (East of Petty Drive) $1,700.00 per lot Residential (West of Petty Drive) $ 850.00 per lot The east side of the subdivision will realize benefit quicker than the lots on the west side. Chairman, Roger Rose, commented at the hearing it needs to be emphasized that FEDCO is putting in a big chunk of money to make this project feasible. After further discussion, the watershed line will be changed, and the tile will be brought up into the proposed industrial area, in order for the commercial development to hook in to the tile. The consensus of the Board is to move forward. The proposed maintenance rates for the tile are as follows: Commercial $6.00 per benefited acre/$10.00 minimum Light Commercial and Farm Plus (Commercial Potential) $3.00 per benefited acre/$10.00 minimum Farmground $3.00 per benefited acre/$10.00 minimum Residential (East of Petty Drive) $10.00 per lot Residential (West of Petty Drive) $10.00 per lot L.N. Bair proposed reconstruction rate: $25.00 per benefited acre/$25.00 minimum L.N. Bair proposed increase of maintenance rate: $3.00 per benefited acre/$10.00 minimum The current maintenance rate on the L.N. Bair is $.90 per benefited acre/$5.00 minimum. FEDCO will be billed a Special Assessment on the Good Tile and the L.N. Bair Open. Recess at 10:50 A.M. D.S.T. Reconvene at 11:00 A.M. D.S.T. Sherry Fulton made a motion to set the L.N. Bair Open Reconstruction and Increase Maintenance Rate Hearing for July 12 at 10:00 A.M. at the discussed rates. Special Assessment to FEDCO in the amount of $10,000.00. Stan Musgrave seconded the motion. Motion carried three to zero. Stan Musgrave made a motion to set the A.W. and A.H. Good Tile Reconstruction and Establish a Maintenance Rate Hearing: July 12 at 10:30 A.M. at the discussed rates. Special Assessment to FEDCO in the amount of $116,000.00. IN REF: SYLVESTER S COLLINS OPEN SET HEARING: CAUSE NO. 2-2010 #806 ESTABLISH A MAINTENANCE RATE The Bailey Open makes up approximately 40% of the Collins watershed. The Bailey Open is approximately 38,000 feet of ditch and is already on maintenance with a rate of $2.19 per benefited acre. Surveyor Estimate for project is approximately $277,000.00, which the proposed rate would be $8.00 per benefited acre for three (3) years. There was discussion about most of the landowners will be paying on several drains that are already on maintenance. The Sylvester S Collins Open system includes Arm #2, #3, and #4. Arm #4 would be to the dam and not on the upside of the lake. The Collins is the outlet for the Bailey system. A permit will be needed for work to be done at Collins Pit and Lear Lake, and the paperwork has been submitted to the Army Corp of Engineers, DNR and IDEM. Being no further discussion, Sherry Fulton made a motion to set the hearing to establish a maintenance rate for the SS Collins, which includes Arm #2, #3 and #4 up to the dam for Monday, August 9 at 9:30 A.M. D.S.T. The proposed maintenance rate will be $9.00 per benefited acre with a $10.00 minimum. Stan Musgrave seconded the motion. Motion carried three to zero. IN REF: UPPER MILL CREEK REQUEST TO LOWER MAINTENANCE RATE CAUSE NO. 9-1999 #762 Fulton County Surveyor stated landowner, Mike Early, had requested the rate be lowered on said drain. After brief discussion, the consensus of the Drainage Board was to leave the rate as is.
