D.S.T. in the Conference Room of the Fulton County Office Building. Board Members present were Chairman, Roger D. Rose; Vice Chairman, Richard A. Powell; and Board Member, Mark J. Rodriguez. Also present were Don Towne, Fulton County Surveyor; Tom Chudzynski Assistant Surveyor; Jean Cloud, Drainage Board Secretary; Steve Carter and Tony Veljanoski from Umbaugh and Associates. It is duly noted that Greg Heller Drainage Board Attorney arrived at 9:17 A.M. D.S.T. Chairman, Roger Rose, called the meeting to order at 9:15 A.M. D.S.T. Chairman, Roger Rose, asked for any additions or corrections to the March 10, 2008 Drainage Board minutes. Being no additions or corrections, Chairman, Roger Rose, entertained a motion to accept the March 10, 2008 Drainage Board minutes as presented. Richard Powell made a motion to accept the March 10, 2008 Drainage Board minutes as presented. Mark J. Rodriguez seconded the motion. Motion carried three to zero. IN REF: REVISED STORMWATER REVIEW FEASIBILTIY STUDY Steve Carter and Tony Veljanoski from Umbaugh Associates were in attendance to present the revised Stormwater Feasibility Study for the Town of Akron and Henry Township drainage project. Steve Carter gave a recap of the original report that was prepared and is contained in the report. Steve further stated the purpose of the report was to give the financial side of the feasibility study for the planning grant. Steve further stated they had run a couple different scenarios, with a grant and without a grant. Steve stated the project is approximately one point eight million dollars. Steve further explained how they arrived at the factors that they used in their reports. Steve explained that Jeff Healy from Banning came back to them with a summary. Steve stated that Banning came up with land use and ran co-effient factors and came up with categories which consists of residential, commercial and industry, and agricultural. Steve further explained that there was not exact breakdown on the categories, but did have the assessment role. Steve stated that Tony went back through the assessment role and to the best of their ability came up with new factors for planning purposes. Steve stated Banning came up with a method that residential could be divided into two (2) parts, anything with a third of an acre or less would be considered a lot; and anything above a third of an acre would be a multiple of that third of an acre. Steve gave an example, if there is one acre the rate would be three times of what the normal residential would be. The proposed rate would be $4.00 per lot (1/3 acre), per month. Steve stated Banning came up with a factor of $19.35 per acre for commercial and industry; and agriculture a factor of $3.93 per acre, per month. Fulton County Surveyor, Don Towne, commented that we normally consider a lot being an acre. After much further discussion, Steve Carter further explained that the Feasibility Study is a requirement for the completion of the planning grant. Steve further stated once the planning grant is closed out, then the next step would be to start the process of design, which would be both physical and rate. Steve stated at that point is when the type of methodology will be decided for the project. There was further discussion on the ERU, Equivalent Residential Unit. Chairman, Roger Rose, asked what needs to be done today. Drainage Board Secretary, Jean Cloud, stated we need to decide today if this report is acceptable so that we can proceed to setting a public hearing. Jean further stated the extension on the Planning Grant would end on April 30th. Mark Rodriguez asked if Umbaugh would be at the hearing. Jean Cloud stated Umbaugh, Banning and Shannon McLeod, which she will have the environmental report, will be at the public hearing. After further discussion, it was discussed as to when all the Board would be available for a public hearing. The Board agreed to the 30th of April as a date that they would be available for a hearing. Drainage Board Secretary, Jean Cloud, stated she would contact Shannon McLeod after the meeting, in order for her to coordinate this date with the Town of Akron and Banning Engineering. Jean stated she would let the Board know if this date works for all the other parties involved. IN REF: CLIFF MCGEE OPEN RIGHT OF WAY DISCUSSION CAUSE NO. 3-1969 #581 Fulton County Surveyor, Don Towne, stated at last month’s meeting we discussed Wheeler “Tim” Conley, Jr. encroaching on our seventy-five (75) foot right of way in order to put his leach field in for his new home. Don further stated Tim is asking for the right to encroach on our seventy-five (75) foot right of way. Don also stated when the ditch is cleaned we need to stay away from that area, or clean on the other side of the drain. Chairman, Roger Rose, stated if we allow a landowner to encroach on the right of way, does that not alter our easement? Roger stated if we damage his leach field with equipment, is that not his problem? Drainage Board Attorney, Greg Heller, stated the Drainage Board needs to have the landowner sign a hold harmless agreement. Greg stated if the Board agrees to allow him to encroach on the seventy-five (75) foot right of way, we need the agreement in case there is maintenance done on the ditch. Vice President, Richard Powell, asked if the agreement needs to be attached to the deed? Surveyor, Don Towne, stated the way he understands it, we cannot work over the leach field. Don further stated that is the reason the landowner wants an agreement with the Board that we will stay off of the leach field, and that is the reason he is asking for the additional footage in our right of way. Don stated if the right of way would be reduced down to twenty-five (25) feet, it would be tough to get a backhoe in the area and throw out spoil. Don further stated the work could be done on the other side of the drain; it is just that we have never worked on the other side in the past. Don stated he understands why he is asking for the reduction in the right of way, because he wants to get a permit to build the home and put a septic system in. Chairman, Roger Rose, stated he sees in the future someone with a backhoe doing maintenance on said drain and knows there is a seventy-five (75) foot of right of way. How would he know there is a leach field in the right of way. Don stated we would have to keep track of it, which would be another problem. Don further stated there would be all new faces in a few years. After further discussion, Drainage Board Attorney, Greg Heller, stated the hold harmless agreement would not allow the landowner to obtain a septic permit. It was stated that we have made these types of exceptions before. Chairman, Roger Rose, stated as a practical matter this will be forgotten about in the future. Fulton County Surveyor, Don Towne, stated when a ditch is going to be cleaned, landowners are notified and that is the time the landowner should call in and let us know there is a reason we cannot clean on their side of the ditch. Chairman, Roger Rose, stated as a matter of policy, the Board should not be doing this under any circumstances unless the person would sign a hold harmless agreement. Roger further stated we are creating liability for ourselves in the future, because we will not remember that the situation is there and we are allowing this to be done to accommodate people. After further discussion, the Board stated a hold harmless agreement needs to be drafted and sent to the landowner. IN REF: JUD L HUDKINS OPEN UPDATE CAUSE NO. 5-1998 #733 Fulton County Surveyor, Don Towne, stated he had not heard from Mike Lauher, Farm Manager for the John Hancock Life Insurance Company. Fulton County Surveyor, Don Towne, stated he did talk with Troy Cowles with IMI and he did not get his side filled in by the first of April, but with ditch situation Don stated he was not worried about that at this time because if we move the open ditch the area will be filled in. After further discussion, Don would like a letter sent to Troy Cowles at IMI giving him an extension to complete the work on their side of the drain. Chairman, Roger Rose, stated the Board would take a short recess. Chairman, Roger Rose, called the meeting back to order. The Board continued their discussion on how many months to give IMI to complete the work. The Board decided to give IMI until July 1, which in that period of time we should get an answer back from the John Hancock Life Insurance Company. IN REF: J DAY DITCH DISCUSS WORK TO BE DONE Fulton County Surveyor, Don Towne, stated this is a county drain of record. Don further stated this drains into the Bucher Open. Fulton County Surveyor, Don Towne, stated we are cleaning the Bucher ditch at this time. Don further stated that Henry Smith, O-Henry’s Excavating, has been working on it. Don stated the DNR permit would not allow us to do anymore work until July 1st, due to the fish spawning and bat habitat. Don further stated that the said drain is approximately seventeen hundred (1700) feet from the Bucher Open to State Road 14. Don stated in Kosciusko County the J Day ditch is set up on maintenance. Don further stated that the maintenance stops at our county line, which is State Road 14. Don stated the seventeen hundred (1700) feet of drain is filled in real bad. Don also stated when we clean the Bucher Open; we will be approximately three (3) feet below the ditch. Don stated there is approximately thirty (30) inches of fill in the ditch at the road. Don stated he has talked with Dick Kemper, Kosciusko County Surveyor, and stated they will look at the part of the ditch in their county and may have O-Henry go ahead and clean some of the ditch. Don stated the J Day Ditch is not on maintenance, but it is the outlet for Kosciusko County’s portion of the drain. Don commented he would like to use the fifteen hundred dollars ($1500.00) from the GDIF, and have Henry go ahead and clean the seventeen hundred (1700) feet while he is there. Don stated he has asked Kosciusko County if they would help money wise on cleaning our portion of the ditch. Dick Kemper, Kosciusko County Surveyor, stated he would run it by his Drainage Board in a couple of weeks. Don stated with it only being seventeen hundred (1700) feet, he does not want to have to set the drain up on maintenance, because all the Kosciusko County landowners would have to be billed and they are the only landowners using this as an outlet for their water. There was further discussion on this issue. Chairman, Roger Rose, stated we would be cleaning the seventeen hundred (1700) feet to protect the Bucher Open. Fulton County Surveyor, Don Towne, stated that Greg Groninger is the landowner on the J Day Ditch, and feels he would be willing to pay some on the cleanout of the drain. After further discussion, Richard Powell asked County Surveyor, Don Towne, what the cost would be to do the cleanout on the seventeen hundred (1700) feet. Don responded that he had talked with Henry Smith, O-Henry Excavating, and he stated he could do the work for twenty-five hundred dollars ($2500.00). Chairman, Roger Rose, stated the twenty-five hundred dollars ($2500.00) would be paid with the fifteen hundred dollars ($1500.00) from the GDIF and whatever Kosciusko County contributes and whatever Greg Groninger would be willing to pay. Being no further discussion, Mark Rodriguez made a motion to proceed and use the fifteen hundred dollars ($1500.00) from the GDIF, according to IC 36-9-27-44.-c to cleanout the J Day Ditch. Richard Powell seconded the motion. Motion carried three to zero. IN REF: WALSH – O’BRIEN UPDATE ON WORK CAUSE NO. 1-1979 #636 Fulton County Surveyor, Don Towne, stated the bid was awarded on August 13, 2007. Don showed the Board on an aerial where the work was done. Don further stated the bid came in low and when the contractor was out there working on the project, landowners wanted additional work done on the arms. Don stated he went ahead and had the contractor clean the arms. Don stated the contractor had the bid work and most of the arm work done on the drains and then we got all the rain in January and February, and the banks started sliding in. Don stated he had the contractor go back and do the banks, which the cost was time and material. Don stated the cost to do the ditch ended up to be double of what the bid was on the project due to the extra work that needed to be done. Don stated the contractor did a very good job on the ditch, and Don stated he has asked the contractor to get a price on seeding. Don stated the maintenance fund on this ditch would be in the red for at least three (3) years or a little more. Drainage Board Secretary, Jean Cloud, stated the bid came in at nineteen thousand eight hundred dollars ($19,800.00), and the extra work for the arms was eight thousand eight hundred and seventy dollars ($8,870.00), or a total of twenty-two thousand eight hundred and one dollars ($22,801.00). Jean further stated she has a claim for a little over thirteen thousand dollars ($13,000.00). Jean stated there is sixteen thousand three hundred and ninety-eight dollars ($16,398.00) in the maintenance fund at the present time. Jean further stated whenever billing is done for this year; there will be another ninety-seven hundred dollars ($9700.00) coming in for the year. Don stated the entire ditch is completely done, and the contractor is pulling the banks. IN REF: SURFACE DRAINS AND DISCUSSION TILE OUTLETS Fulton County Surveyor, Don Towne, stated since we have had all the rain, we are getting into situations where the banks are sliding in and surface drains are blowing out. Don further stated in the past we have always told the landowner it is their responsibility to take care of the surface drain. Don asked the Drainage Board if they would want to change that policy or do we want to look at it depending on the situation. Don further stated it varies from county to county as to how they handle surface drains and tile outlets. Don further stated that we do take care of the surface drains and outlet pipes on Willow Creek, because that originally started out as a joint with Pulaski County. Don stated Fulton County ended up with the drain up to the Fulton/Pulaski County Line, so in the Findings and Order we take care of the surface drains and outlet pipes. There was discussion that the surface drains and outlet pipes be fixed on a case-by-case basis. Deputy Surveyor, Tom Chudynski, suggested maybe an incentive could be given to the landowner, stating we will fix the surface drain or outlet pipe, if they put in filter strips or go into a program for the land next to the ditch bank. After further discussion on this issue, Chairman, Roger Rose, stated what if we offer to pay fifty percent (50%) of the cost to put in a new surface drain. There was discussion if the landowner does not pay their half of the cost, then it could be added as a surcharge on their tax bill. Don stated there would not be that many, so we could keep track of them. After further discussion, Drainage Board Attorney, Greg Heller, stated he liked the concept, but asked, “What is our authority to do this?” There was discussion about this issue being covered under IC 36-9-27-46, which is the Indiana Code that covers obstructions. Chairman, Roger Rose, stated it seems in maintaining the ditch the Drainage Board would have some latitude to exercise our discretion. After further discussion, Chairman, Roger Rose, entertained a motion to allow the Surveyor to talk with the landowner when a surface drain needs to be replaced and the maintenance fund will pay for fifty percent (50%) of the cost and the landowner will be responsible for the other fifty percent (50%). Richard Powell made a motion to allow the Surveyor to talk with the landowner when a surface drain needs to be replaced and the maintenance fund will pay for fifty percent (50%) of the cost and the landowner will be responsible for the other fifty percent (50%). Mark Rodriguez seconded the motion. There was further discussion about offering to pay one hundred percent (100%) of the cost to put in a surface drain, if the landowner would put the ditch bank into a filter strip program. After further discussion, the motion was amended to allow fifty percent (50%) of the cost to be paid by the maintenance fund and fifty percent (50%) to be paid to the landowner for surface drains and outlet drains. If the landowner puts the ditch bank into a filter strip program, then one hundred percent (100%) of the cost for a surface drain will be paid for out of the maintenance fund of the said drain. It is further stated that anything that does not fall into the categories mentioned will be done on a case by case basis upon the recommendation of the county surveyor. Being no further discussion, the amended motion carried three to zero. IN REF: STUMP HEIGHT DISCUSSION Fulton County Surveyor, Don Towne, stated at last month’s meeting the Board made a decision that the maximum height a contractor should leave a stump would be eighteen (18) inches. Don stated he feels eighteen (18) inches is not enough height for a contractor with chainsaw working on the slope of a ditch bank. Don recommends that the Drainage Board change the maximum height for a stump be changed to twenty-four (24) inches. Being no further discussion, Mark Rodriguez made a motion to change the maximum stump height to be up to twenty-four (24) inches. Richard Powell seconded the motion. Motion carried three to zero. Fulton County Surveyor, Don Towne, stated this would be added to our specs in our bid packets. IN REF: PRATER PROPERTY DISCUSSION Deputy Surveyor, Tom Chudzynski, stated Mr. Prater lives and has a used car lot on east Fourth (4th) Street, and he came into the office and stated there is a big area back behind his property, which he stated in the last two (2) years, has sunk four (4) to six (6) feet. Tom stated they went out and looked at the area. Tom further stated that this area is out of our jurisdiction, but we are bringing it before the Drainage Board in case you receive calls on it. Mr. Prater stated he had been told there was an old county tile that came from what use to be the old Armour Plant, which would be east of his property. Tom further stated there are two (2) outlet pipes into Mill Creek and Mr. Prater feels there is a breakdown in the tile somewhere. Tom stated the ground is saturated and we probed in the area and could not find anything. Tom further stated there is no county tile of record in that area. Fulton County Surveyor, Don Towne, stated there is something going on there and someone needs to be investigating. Tom further stated that Mr. Prater is concerned and he is going to go talk to the City. IN REF: CLAIMS Fulton County Surveyor, Don Towne, stated some of the claims for Ingram Excavating are turned in under James Ingram, which is Kirk Ingram’s brother. Don stated they work together and have for several years. IN REF: LUCINDA SMITH OPEN DISCUSSION Drainage Board Secretary, Jean Cloud, stated he had received a letter from Miami County Drainage Board, and they have appointed to Drainage Board members to the Joint Board. Jean stated at this time we need to come up with a date for a Joint Board meeting. Jean stated Roger Rose and Richard Powell are our appointments for the Joint Board. Miami County appointed Greg Deeds and Gary Hawley to serve on the Joint Board. Jean stated a date for an Organizational meeting followed by a regular meeting needs to be made. After brief discussion, it was decided to set the Joint Board meeting on Tuesday, June 17th at 9:00 A.M. Jean stated she would send a letter to Miami County. Jean also asked the Board for an alternate date, if the 17th of June does not work for them. The Board decided, Tuesday, June 24th would be the alternate date. Secretary, Jean Cloud, stated once a date is set, she would contact Pulaski County and ask them if they could have a member of their Drainage Board serve as a fifth member. IN REF: CONCERNS There was brief discussion about the Troutman Hogan. There was also discussion about the work that was to be done on County Road 100 South. There was also discussion on work that O-Henry Excavating has done and what needs to be done.
