D.S.T. in the Conference Room of the Fulton County Office Building. Board members present were Chairman, Roger D. Rose, Vice Chairperson, Sherry S. Fulton and Board Member, Stanley Musgrave. Also present were: Don Towne, Fulton County Surveyor; Tom Chudzynski, Assistant Surveyor; Jean Cloud, Drainage Board Secretary, and Steve Furnivall. It is duly noted that Greg Heller, Drainage Board Attorney, arrived at 9:14 A.M. D.S.T. Chairman, Roger Rose, called the meeting to order at 9:06 A.M. D.S.T. Chairman, Roger Rose, asked for any additions or corrections to the Drainage Board minutes of March 9, 2009. Being no additions or corrections, Chairman, Roger Rose, entertained a motion to approve the March 9, 2009 Drainage Board minutes as presented. Sherry Fulton made a motion to approved the March 9, 2009 Drainage Board minutes as presented. Stan Musgrave seconded the motion. Motion carried three to zero. IN REF: DRAINAGE ASSESSMENTS ERIE LACKAWANNA RR Fulton County Treasurer, Lorie Hurst, had written a letter to the DNR in reference to delinquent ditch assessments. Lorie explained that DNR responded with a copy of a court case signed by Judge Morton in 1985, which the property was abandoned. A copy of the letter and court case document had been given to the Board members. Lorie stated this is the first a copy of the court case has been given to the Treasurer’s office. Lorie is asking that the Drainage Board allow all ditch assessments be removed since it is impossible to determine how much and to whom the bill should be forwarded to. Lorie further explained that she and the Auditor could agree to remove all penalties and ad fee. Lorie further explained certificate of errors need to be made up to remove billing and penalties. After further discussion, Lorie commented DNR has been assessed and they do not own the property, and we do not know who the owner is at this time. There was further discussion on this issue. Chairman, Roger Rose, entertained a motion to remove the ditch assessments from the DNR properties as mentioned. Sherry Fulton made a motion to remove the ditch assessment from the DNR properties that was presented by Treasurer, Lorie Hurst. Stan Musgrave seconded the motion. Motion carried three to zero. IN REF: KINGS LAKE OUTLET DISCUSSION TO REMOVE TREE JAM Fulton County Surveyor, Don Towne, explained the outlet is not set up on maintenance. Don commented claims in the past have been paid out of General Drain Improvement Fund. Don stated the open ditch was cleaned out north of the road, and beaver dams and logjams have been taken out. Don stated since that portion of the ditch is not set up on maintenance, statute allows us to go in one time a year and spend not more than fifteen hundred dollars ($1500.00) a year. Don stated the lake is backed up about two (2) foot because of tree jams. After further discussion, Chairman, Roger Rose, entertained a motion to allow the Surveyor to contact a contractor to remove the trees in the outlet and spend no more than five hundred dollars ($500.00). Sherry Fulton made a motion to allow the Surveyor to contact a contractor to remove the trees in the outlet and spend no more than five hundred dollars ($500.00). Stan Musgrave seconded the motion. Stan asked if this portion of the ditch benefited the people at Kings Lake. Don explained it does benefit the landowners around Kings Lake. Don commented the lake for at least a mile affects the grade of our county ditch, because it is so flat. Don stated it would greatly help the outlet for the Ball Ginther Shadel. Stan asked if there is a reason why this portion of the ditch is not set up on maintenance. Don responded that everyone around the lake would be on maintenance, and most the properties are on tax sale every year. Jean Cloud, Drainage Board Secretary, commented it is easier to use GDI money to take care of the problem. Being no further discussion, motion carried three to zero. IN REF: LITTLE YELLOW CREEK TREE IN DITCH CAUSE NO. 1-2000J #768 Fulton County Surveyor, Don Towne, commented Sandra Smythe came in the office and stated the neighbor’s trees fell across the ditch into their yard and the water in the ditch is going around the trees. Don commented the ditch is set up on maintenance but the portion along their property is not on maintenance. There was discussion of where the money would come from. Drainage Board Secretary, Jean Cloud, commented since this portion of the ditch is not on maintenance, we normally pay the claim out of GDI. Jean commented there is $34, 985.87 in the maintenance fund, but there is a claim for bid work coming out of the fund. Sherry Fulton asked about the neighbor paying for the removal, and Don commented that Mrs. Smythe stated he would not pay for it. Don commented the work would have to be in Smythe’s yard, and there could be some damage to the yard. Chairman, Roger Rose, asked whom is the tree affecting. Don responded the tree is affecting the Smythe’s yard because the water is washing around the tree and affecting the bank. After further discussion, Chairman, Roger Rose, entertained a motion to pay fifteen hundred dollars ($1500.00) out of GDI to remove the obstruction on Little Yellow Creek, which is not on maintenance. Sherry Fulton made a motion to pay fifteen hundred dollars ($1500.00) out of GDI to remove the obstruction on Little Yellow Creek, which is not on maintenance. Stan Musgrave asked if an agreement needs to be made with the landowner if damage is done to their property and the excess of the fifteen hundred dollars ($1500.00) would be the landowner’s responsibility. Fulton County Surveyor, Don Towne, stated he would talk to the landowner’s about that and also advise them they would be responsible for cost exceeding the fifteen hundred dollars ($1500.00). Drainage Board Attorney, Greg Heller, commented a Hold Harmless Agreement should be sent to the landowners. Stan Musgrave seconded the motion. Motion carried three to zero. IN REF: CHARLES TOWN TILE CONTINUED HEARING CAUSE NO. 2-2008 #800 CHARLES TOWN OPEN CAUSE NO. 3-2008 #801 Chairman, Roger Rose, opened the continued hearing for said drains at 9:48 A.M. D.S.T. Drainage Board Attorney, Greg Heller, distributed the draft of the agreement he had prepared for County Line Landfill/Shaw Environmental. Chairman, Roger Rose, commented that they had met with Shaw Environmental and the County Line Landfill in January and this agreement is the outcome of the meeting. There was discussion about changing the number of years from five (5) to two (2) years for completion of work. After further discussion, Drainage Board Attorney, Greg Heller, suggested that a Hold Harmless Agreement would need to be included. There was discussion that no reconstruction work shall be performed during the crop-growing season between May 1 and November 1, unless there is landowner approval. After much further discussion, Drainage Board Attorney, Greg Heller, commented he would make the changes to the agreement and email to Drainage Board Secretary, Jean Cloud, and she in turn can email to Jeff Healy, Shaw Environmental and County Line Landfill. Chairman, Roger Rose, entertained a motion to continue the hearing on said drains to Monday, July 13 at 9:30 A.M. D.S.T. IN REF: LUCENIA SMITH OPEN UPDATE CAUSE NO. 1-2008 #797 Fulton County Surveyor, Don Towne, commented Dale Overmyer wants to pile the brush on said ditch and burn this fall. Don further commented the work would be done on the ditch through the summer. The Board was ok with this. IN REF: AMMON BUCHER OPEN STEVE HARTZLER PROPERTY CAUSE NO. 27-1981J #521 Fulton County Surveyor, Don Towne, commented Steve Hartzler had a ford in the ditch and with the big rain event it took out boulders and there is a large log in the middle of his ford. Don stated Steve is going to have to put in a pipe or bridge and is asking for financial assistance from the Drainage Board. Don commented we have never helped on private crossings in the past. After brief discussion, the consensus of the Board is not to help financially on private crossings. IN REF: JOE LEASURE MAIN TILE HEARING SET: CAUSE NO. 5-1983 #577 RECONSTRUCTION Fulton County Surveyor, Don Towne, stated the profile and plans are the same as for the last hearing. Don stated the cost has changed because of price increases. Don commented at the last hearing the proposed reconstruction rate was three hundred dollars ($300.00) per benefited acre. The proposed reconstruction cost for the hearing to be set will be three hundred sixty-five dollars ($365.00) per benefited acre. It was stated the hearing on this was last year (2008). Don commented the estimated cost for the project last year was approximately one hundred and three thousand dollars ($103,000.00). The estimated cost for the project for this year is approximately one hundred and twenty-five thousand dollars ($125,000.00). Chairman, Roger Rose, called for a short recess at 10:20 A.M. D.S.T. Chairman, Roger Rose, called the meeting back to order at 10:32 A.M. D.S.T. Fulton County Surveyor, Don Towne, explained the plan to the members of the Board. Don stated the proposed reconstruction would be from the open ditch to the existing twenty (20) inch concrete tile on Bruce Beehler’s property. Don further explained the proposal is to bring a fifteen inch (15”) tile to hook into Bruce’s pump area, which is where his tile drains. Don commented this would have a natural gravity flow out, so that he would not have to pump. Chairman, Roger Rose, asked if the tile would be lowered. Don responded it would be lowered approximately five foot (5’). Don stated it would be a deep cut through the hill, and Bruce would not have to pump. Don explained that the outlet is a twenty-four inch (24”) tile, but the records show the old tile is only a twenty inch (20”) tile. Stan Musgrave stated he went down to the area after the big rain event and the outlet was only running about a fourth full. Stan asked if that indicates the tile is broken down or is that expected. Don explained at the outlet pipe and then not too many feet over from that is a surface drain, where water will hit and run into the open also. Don explained an outlet would not run full, unless there is a tremendous amount of head pressure. Don explained when new tiles are installed we need to put in more risers so they get air and make the water move more freely through the tile. Don commented most tiles would not run full because there is not that much pressure. After further discussion, Stan commented the proposal is to install a fifteen inch (15”) tile over to Bruce’s low area. Stan asked if the landowner should pay for this portion of tile. Don stated that could be used as a negotiation. Chairman, Roger Rose, asked, “How long is that stretch?” Don responded commented it would be approximately four hundred and twenty feet (420’), or approximately seventy-one hundred dollars ($7100.00). After brief discussion, Don commented we always try to meet everyone half way. Chairman, Roger Rose, commented the fact that he will have an outlet would be doing a big favor to him. After further discussion, Don commented that the majority of the job would be a deep cut. Don commented he calls any job a deep cut if it is over six foot (6’). Don commented most tile machines could go six foot (6’). After further discussion, Don commented there would be no work done on the upper end of the tile. Stan asked if the proposed work downstream would help the landowners on the upper end. Don commented that the proposed work would be their outlet, and Don commented there is quite a bit of fall on the upper end, but the tile is a hundred years old plus. After further discussion, Chairman, Roger Rose, commented maybe after next month’s Board Meeting we could make arrangements to visit the area. COMES NOW, the Fulton County Surveyor presents to the Drainage Board a report for Reconstruction of the Joe Leasure Tile, Cause No. 5-1983, #577 in Wayne Township. Chairman, Roger Rose, entertained a motion to set the proposed reconstruction rate at three hundred and sixty-five dollars ($365.00) per benefited acre with a three hundred and sixty-five dollar ($365.00) minimum. Sherry Fulton made a motion to set the proposed reconstruction rate at three hundred and sixty-five dollars ($365.00) per benefited acre with a three hundred and sixty-five dollar ($365.00) minimum. Stan Musgrave seconded the motion. Motion carried three to zero. The Drainage Board now prepares its Schedule of Assessments which schedule contains a description, which has been taken from the Surveyor’s Report. The said Schedule of Assessments as passed by the Drainage Board in the captioned drain, which is attached hereto and made part hereof, shows the percent of estimated cost for the reconstruction for the landowners of the drain to be assessed of each tract of land for such proposed reconstruction rate. The percent allocated to all land benefited totals one hundred percent. Notices to be sent as per Indiana Statute, the hearing date to be set for Monday, July 13, 2009 at 10:30 A.M. D.S.T. in the Commissioners/Council Room in the Fulton County Office Building. IN REF: GOSS AND ROUCH OPEN HEARING SET: CAUSE NO. 1-2009 #802 ESTABLISH A MAINTENANCE RATE Fulton County Surveyor, Don Towne, commented the drain is in Liberty Township. Don further commented the drain north of County Road 550 South and County Road 350 West is already on maintenance, which is the Grube Open. Don commented the drain was a tile ditch years ago and the landowners took the tile out and made it an open ditch. Don stated a signed petition has been received from the landowners. Don commented Scott Hizer carried the petition. Drainage Board Secretary, Jean Cloud, commented Hizer’s do not own ground on the drain, but farms Darla Greer’s property, which is on the drain. Don commented there is hardly any brush on the drain; the main work would be dredging the drain. Don commented he would like to set the proposed maintenance rate at six dollars ($6.00) per benefited acre for three (3) years, then the Board could review the fund at that time and possibly lower the rate. Don commented his estimate would be approximately twelve thousand dollars ($12,000.00) for dredging and spray for at least two (2) years. The length of the drain is sixty-nine hundred feet (6900’). Don further commented if there is opposition at the hearing, we could propose lowering the rate to five dollars ($5.00) and go another year. Don also commented the work could be done for approximately a dollar and fifty cents ($1.50) per foot. Don stated he is planning on cleaning out five hundred (500) to six hundred (600) foot on the outlet to the Grube Open. Being no further discussion, Chairman, Roger Rose, entertained a motion to set a hearing to establish maintenance on the Goss and Rouch Open, Cause No. 1-2009, #802 in Liberty Township. The proposed rate to be six dollars ($6.00) per benefited acre with a ten dollar ($10.00) minimum. Don stated his proposed maintenance rate is three dollars and fifty cents ($3.50) per benefited acre with a ten dollar ($10.00) minimum. Don commented the old records indicate there are forty-four (44) benefited acres in the watershed, but the acres need to be corrected. Don commented the benefited acres should be increased by approximately eighty-eight (88) acres. Don commented the annual assessment would be approximately three hundred dollars ($300.00). Don commented the said drain is a twelve (12) inch tile. Don commented there has never been any maintenance work done on the tile. Chairman, Roger Rose, entertained a motion to set a hearing to increase the maintenance rate and correct the watershed on said drain. The proposed rate to be set at three dollars and fifty cents ($3.50) per benefited acre, and also correct the watershed by adding approximately eighty-eight (88) acres. Drainage Board Secretary, Jean Cloud, commented we could set up a date for June 8, 2009 at 1:00 P.M. D.S.T. Jean commented we need to appoint two (2) members from our Board, and then Kosciusko County needs to be contacted to see if that date works for them, and they would also need to appoint two (2) members. Jean commented a fifth member would be needed to serve on the Board, which we normally have a Drainage Board member from Pulaski County. Chairman, Roger Rose, commented he would serve on the Joint Board and Sherry Fulton commented she would be the other Board Member. Fulton County Surveyor, Don Towne, commented we have over twenty-two thousand benefited acres in the watershed, and Kosciusko County has over fifty-seven hundred benefited acres in the watershed. Being no further discussion, Chairman, Roger Rose, entertained a motion to set a Joint Board Organizational meeting with Kosciusko County for the Chippewanuck Creek to be held on Monday, June 8, 2009 at 1:00 P.M. D.S.T. in the Conference Room of the Fulton County Office Building. Roger Rose and Sherry Fulton will serve on the Joint Board. Sherry Fulton made a motion to set up a Joint Board Organization meeting with Kosciusko County for the Chippewanuck Creek to be held on Monday, June 8, 2009 at 1:00 P.M. It is duly noted that Drainage Board Attorney, Greg Heller, excused himself from the meeting at 11:25 A.M. D.S.T. IN REF: DAVIS & BECK TILE DISCUSSION CAUSE NO. 13-1968 #529 Fulton County Surveyor, Don Towne, commented the C B Mastellar Open maintenance rate was increased and the work was awarded and has been completed. Don further commented the Mastellar Open continues on to Lake Manitou, but that portion of the drain is not set up on maintenance, so no work can be done on it. Don commented that some of the landowners in the Davis & Beck Tile watershed would like to do a reconstruction on the low end of the tile, but the outlet, which is the Mastellar Open, is filled in considerably. Don stated the tile is eighteen inches (18”) and the open ditch is actually eighteen inches (18”) above the tile on a good day, on a bad day it is way above that. Don commented the maintenance on the Mastellar Open stops at the township line. Don commented he thought about cleaning a portion of the open and just charge the people on that section of drain, but that might be the only way to get it set up. Don commented where Rochester put in the wetland, we went in and took a beaver dam and people were upset because we had lowered the level of the area. Don further commented if the open ditch is not cleaned out, there is no reason to reconstruct the tile, because it would be a waste of time. Don commented he needs to work up a watershed, but we just raised the maintenance rate on the Mastellar on the upper end and then they would have to pay on this portion also. Don commented he estimates the cost of the project to be approximately eleven (11) or twelve thousand dollars ($12,000.00). Don also commented that DNR would be involved because the ditch needs to be cleaned within a half mile of Lake Manitou. Don stated he does not need any action on the project today; he will bring it back in at a later date. IN REF: BALL GINTHER SHADEL SPRAY BIDS CAUSE NO. 1-2006 #790 AMMON BUCHER SYSTEM (ISREAL LANDIS) CAUSE NO. 27-1981J Drainage Board Secretary, Jean Cloud, stated the spray bids for these two (2) drains were awarded to Right of Way Management at the March 8, 2009 Drainage Board meeting. Chadd Baker from Right of Way called on March 26th and stating he is going to give up the award of these two (2) projects. Jean commented she called Oscar Wells, Prairie Marsh, Inc. and he has agreed to accept the projects at his bid, which he is was second lowest bid. IN REF: KING – SHRIVER DITCH DISCUSSION Fulton County Surveyor, Don Towne, commented that Kirk Ingram submitted a claim for work that was done last year. Don commented the County Highway had contacted him because the road was flooded. Don commented the ditch was filled in so he had Kirk take out about five (5) foot of silt and the county highway then put in a new culvert under the road. Don stated he had approval to do the fifteen hundred dollars ($1500.00) last year. Kirk did not turn the claim in last year, and this year we had to send him out to do leveling on the drain. The total claim will be coming out of General Drain Improvement.
