E.S.T. in the Conference Room of the Fulton County Office Building. The following members were present: Chairman, Roger Rose; Vice Chairperson, Sherry Fulton; Member, Stanley Musgrave. Others in attendance were Fulton County Surveyor, Don Towne; Assistant Surveryor, Tom Chudzynski; Secretary, Jean Cloud; Drainage Board Attorney, Greg Heller; Ted White; Matt Christman and Dan Butler from IMI. Chairman, Roger Rose, called the meeting to order at 9:10 A.M. E.S.T. Chairman, Roger Rose, asked for any additions or corrections to the October 11, 2010 minutes. Being no additions or corrections, Sherry Fulton made a motion to approve the minutes as presented. Stanley Musgrave seconded the motion. Motion carried three to zero. IN REF: DAVIS & BECK TILE DISCUSSION CAUSE NO. 13-1968 Surveyor Towne commented at 575 East and 150 South, everything drains into the Mastellar Open. On a big rain event the intersection floods. Surveyor Towne explained to the Board that Brad Good built a pond and put a spoil around it, which did not create any additional flooding. The Surveyor made a comment that on a big rain event the pond does flood. The neighbor to the north of the area is complaining there is not an equalizer pipe under the road. The neighbor feels the County should put in an equalizer pipe and Good should remove some dirt so the water will drain down to the area, which Good already has a swale down through that area. The Surveyor commented if a fifteen (15) inch tile is installed under the road there would need to be twelve (12) to fifteen (15) inches of cover, and then Good would need to dig the ditch deeper, because the dirt is built up in the area due to his pond. After further discussion, the Surveyor commented there is really nothing we can do to stop the flooding. The Surveyor commented the water in the open ditch is approximately two (2) feet above the tile, so there is not a good outlet. There is constant repair on the tile with blowouts. The Surveyor commented the Mastellar Open is not on maintenance. There are wetlands, woods and pasture on both side of the open ditch. Board member, Stan Musgrave, asked who was unhappy. The Surveyor replied “Jim Ramsey wants equalizer pipes, and wants Good to change his side ditches. The Surveyor commented the flooding does not affect Ramsey’s property. After brief discussion, Chairman, Roger Rose, commented after looking at the situation he sees no real benefit of putting in an equalizer pipe. The consensus of the Board was to not go the expense of putting in the equalizer pipe, which would be the cost of the county highway. Chairman, Roger Rose, called for a short recess at 9:35 A.M. IN REF: BURNS & HENDRICKSON TILE ARM #1 HEARING PUBLISHED: CAUSE NO. 1-1980 #522 ORDER MADE Chairman, Roger Rose, opened the Burns & Hendrickson Tile Arm #1 Reconstruction Hearing. Landowner present: Ted White Purpose of the Hearing: Reconstruction Signed Petition: Received August 16, 2010 Landowners Letters: Mailed October 4, 2010 Legal Publication: October 29, 2010 Watershed: 185 Benefited Acres Proposed Reconstruction Rate: $390.00 per benefited acre w/$390.00 minimum Current Maintenance Rate: $3.00 per benefited acre w/$3.00 minimum No Letters of Objection Surveyors Report: Approximately a year ago, Angela Miles and Mary Ditmire replaced approximately 760 feet of tile on their property with 10-inch tile, which is the high end of the tile. Ted White owns property below and above the existing tile system, and he is all right with the 10-inch tile that was put in on the Miles and Ditmire farm. The Surveyor commented the new tile will be hooked into the new 10-inch tile, which was put in by the landowner. The original estimate for the project was approximately $80,000.00. The Surveyor commented the landowner will be reimbursed for the portion of tile installed and be a part of the reconstruction. The Surveyor’s revised estimate will be approximately $72,782.00. The project will be replacing the tile from the outlet, and replacing the tile on the arm to the north, plus reimbursing the landowner approximately $4,000.00 for the replacement of the tile on her property. The Surveyor commented the landowner’s assessment is $23,400.00 for her benefited acres. The Surveyor commented if we had done the work, the cost would have been greater because the tile would have been put in deeper, stoned, and HQ smooth flow tile would have been used. Sherry Fulton asked if this is adequate. The Surveyor commented it is new 10-inch tile. The Surveyor further commented smooth flow tile would handle more water, but Ted White, the other property owner, is all right with what was installed. The Surveyor further explained the project, and commented Landowner, Ted White, ask about a low spot, which we will check. The north arm is on a four tenths grade, but the grade could be lessened and the tile run deeper. The Surveyor commented Landowner, Nancy Plummer Crow, had done some lateral tile work hooking into a main and running it north, which reduces their benefited acres from 34 acres to 13.6 acres on parcel number 013-116009-00. Ted White asked when the project would be done. Surveyor Towne commented he could take bids at the next meeting and try to have it done by spring planting season. After brief discussion, Drainage Board Secretary, Jean Cloud, commented historically the landowner is not reimbursed until the total project is paid by the affected landowners. Jean commented if all the landowners pay their assessment the first year after certification, there will be no interest collected, so the money may have to be taken out of the maintenance fund. Being no further discussion, Chairman, Roger Rose, entertained a motion to take action on the said project. Sherry Fulton made a motion to proceed with the reconstruction of said drain finding that the costs, damages and expenses of the reconstruction will be less than benefits accruing to the owners of land likely to be benefited with a proposed reconstruction rate of $390.00 per benefited acre with a $390.00 minimum. IN REF: BABCOCK OVERMEIER TILE DISCUSS CAUSE NO. 6-2010 #502 BID LETTING JOHN M MILLER TILE CAUSE NO. 7-2010 #591 Secretary, Jean Cloud, stated the bid letting will be Monday, November 29 at 11:00 A.M. Surveyor, Don Towne, commented at the Babcock Overmeier hearing, the landowners asked that Dale Overmyer not be allowed to bid. Surveyor Towne asked if a contractor owns ground on an open ditch and bids are being taken on maintenance work, could the contractor bid on the project. After further discussion, Drainage Board Attorney, Greg Heller, commented the conflict of interest goes to whether there is a direct or indirect financial impact. Surveyor Towne asked if the contractor could bid on maintenance work. Drainage Board Attorney, Greg Heller, commented the type of work is not a conflict of interest. It is whether or not there is a financial gain. The Statute states if there is a direct or indirect financial interest. Greg commented he gives the Board his legal opinion, and then it is always “tweaked” to fit the circumstance. Greg commented he does not look at it as the type of project and that is not the way the law looks at it. Surveyor Towne commented the contractor owns several acres of ground in the area, and that could eliminate him from bidding on projects or even doing repair work. Greg commented if the contractor is artificially lowering his bid, and he is gaining benefit from the work, that is the issue, not the type of work it is. After further discussion, Chairman, Roger Rose, commented he felt the Board did the right thing by excluding the contractor from bidding on the project. IN REF: BEAVERS DISCUSSION Surveyor Towne commented beaver trapping season will be in the next week or so, and a young man wants to trap the beaver. Surveyor Towne commented Chris Brown tore the beaver dam out of Minnow Creek near Olson Road, and the beaver built the dam back in the pipes. Towne commented the beaver needs to be trapped before tearing out the dam. IN REF: CHIPPEWANUCK CREEK UPDATE ON WORK CAUSE NO. 2-2009 #799 Surveyor Towne told the Board LDP Excavating is still working on said drain, and the contractor is doing a good job. IN REF: JOSEPH LEASURE MAIN TILE UPDATE ON RECONSTRUCTION CAUSE NO. 5-1983 #577 Surveyor Towne commented Ingram turned in a final invoice for bid work, extra work and hooking up laterals and retainage was held. Ingram asked if he could be released on his bonding. Surveyor Towne stated the tile is placed on grade, all laterals are hooked up and everything is done except for final leveling. Secretary, Jean Cloud, commented a letter of credit is being held for the bonding. Jean commented the bank had called and asked if the work was completed. Chairman, Roger Rose, asked, “What is the historic practice?” Surveyor Towne responded, “Usually it is leveled and completely done.” Towne further commented since there has not been much rain, the contractor would like to wait until March or April to do the final leveling. Towne commented the work is all done for Bruce Beehler, and Bruce had Ingram do his lateral work. Secretary, Jean Cloud, asked about the dollar amount for Bruce Beehler. Jean commented she will need the figure before billing can be done. Surveyor Towne commented he would look up the information. IN REF: CHRISTINA KEHRER SEIFERT TILE CERTIFY TO AUDITOR CAUSE NO. 4-2009 #804 MAINTENANCE The undersigned of the Fulton County Drainage Board do hereby certify the assessment for maintenance of the above captioned drain, in accordance with the Drainage Act of 1965, and as amended, to be placed on the Ditch Duplicate and to collected by the County Treasurer. Such assessment to be first collected during the year 2011, and thereafter as required by law. IN REF: CHRISTINA KEHRER SEIFERT TILE CERTIFY TO AUDITOR CAUSE NO. 4-2009 #804 RECONSTRUCTION The undersigned of the Fulton County Drainage Board, do hereby certify the assessment for reconstruction of the above captioned drain, in accordance with the Drainage Act of 1965, and as amended, to be placed on the Ditch Duplicate and to be collected by the County Treasurer. All Assessments for the Reconstruction shall be collected over a five (5) year period as provided by law. Said Assessments to be first collected in 2011. IN REF: FORM 96 DISCUSSION Drainage Board Attorney, Greg Heller, commented the Statute reads if the cost of the project is more than a $100,000.00, which Greg stated he feels this would be the estimate of the project. Greg further stated the Statute reads: If the cost of the project is $100,000.00 or more, the Board shall require the bidder to submit a financial statement, statement of experience, a proposed plan or plans for performing the public work and the equipment that the bidder has available for the performance of the public work. The statement shall be submitted on Forms prescribed by the State Board of Accounts. Greg again stated, “It would be the estimate of the project”. Chairman, Roger Rose, commented the previous issue was the estimate was over $100,000.00, but the bid was under $100,000.00. Greg further commented if the estimate is more $100,000.00 then the bid must be submitted on Form 96. Chairman, Roger Rose, asked the reason the Form 96 is included. Drainage Board Attorney, Greg Heller, commented because of State Statute. After further discussion, it was decided the Form 96 must be included in the bid notice and also in the bid specifications. Drainage Board Attorney, Greg Heller, stated until legislation clarifies whether drainage projects are public works that will be our legal position if the issue of Wage Committees comes up again. Chairman, Roger Rose, commented our interpretation would be our drainage project is not a public works project. Greg commented that was the position we took, because the money is coming from the affected property owners, not from a general tax base. IN REF: L N BAIR OPEN JUDICIAL REVIEW CAUSE NO. 1-1970 #507 FILED A.W. AND A.H. GOOD TILE CAUSE NO. 3-2010 #787 Drainage Board Attorney, Greg Heller, stated a judicial review was filed on the project, and he has responded. Surveyor Towne commented he is meeting with Jeff Zent and FEDCO Director Terry Lee to discuss the railroad crossing. IN REF: SYLVESTER S COLLINS OPEN SYSTEM UPDATE CAUSE NO. 2-2010 #806 The Surveyor has talked with Gudas’, but have not heard back from them. After further discussion, Drainage Board Attorney, Greg Heller, commented he will contact their attorney. IN REF: IRVING MATERIALS INC DRAINAGE PLANS Dan Butler and Matt Christman representatives from IMI presented the drainage plans. Matt presented revised drainage plans. Matt explained there is a county tile under the county road, which there were two (2) mounds and the gap has been filled in where the tile comes across the road from Sisinger’s property, and the proposal is to put in a tile inlet at the flat spot of the road, which will drain to the pond. IMI’s proposal is to strip the area and the only improvements will be a drive. Surveyor Towne commented there is no reason for them to design a detention pond, as everything they are dredging will drain back into the wet pond. The drainage plans are part of the process required by the Area Plan Commission. There was discussion on the IDEM permits. Matt Christman explained normally this type of project usually requires two (2) types of approval from IDEM. One would be for water quality certification, which would be required if we were working in a wetland or in water of the State, which is not the case with the project we are doing. The second would be erosion control, Rule 5, and for the aggregate industry, Rule 12. Matt further explained in 2004 IDEM issued Indiana aggregate companies a guidance document. The document states if the aggregate company is draining into their own pond, an isolated pond not connected with waters owned by the State, Rule 5 is not needed, because that is the erosion control. Matt Christman also commented IMI does not need a permit for this project, and Plan Director is wanting a letter of approval from IDEM, but Matt commented he does not feel IDEM is set up to do that. Matt Christman further commented he has emailed the plans to Liz Pelso with IDEM in hopes she can provide the information needed in order for them to proceed with the project. Matt also commented they are in total compliance with IDEM’s rules and regulations. After further discussion on the issue, Dan Butler commented he was informed the Technical Review Committee meeting scheduled for today has been canceled until the Plan Director receives the information needed from IDEM. Chairman, Roger Rose, asked what would be done with the top soil that is stripped off the area. IMI representatives responded that IMI does not own the property; they are leasing the property from John and Sherry Anderson. The reclamation plan will be up to the landowners, and the Plan has been submitted to the Area Plan Commission. There was brief discussion about doing mitigation on the Jana property. There was again discussion back on the pond area. Being no further discussion, Chairman, Roger Rose, entertained a motion to approve the Drainage Plans for IMI Expansion subject to full compliance with IDEM permits as applicable.
