D.S.T. in the Commissioners/Council Room of the Fulton County Office Building. The following members were present: Chairman, Roger Rose; Vice-Chairperson, Sherry Fulton. Chairman, Roger Rose, called the meeting to order at 9:07 A.M. D.S.T. Chairman, Roger Rose, asked for additions or corrections to the July 12, 2010 minutes. Sherry Fulton commented she had given Secretary, Jean Cloud, a minor correction prior to the meeting. Being no further additions or corrections, Chairman, Roger Rose, entertained a motion to approve the amended minutes of July 12, 2010. Sherry Fulton made a motion to approve the amended July 12, 2010 minutes. Roger Rose seconded the motion. Motion carried two to zero. IN REF: FIRST PRESBYTERIAN CHURCH DRAINAGE PLANS Drainage Plans were presented for the construction of a new First Presbyterian Church. The old church will be torn down, and the drainage plans shows the drainage system will be put under the parking area. Terry Weiss commented there is no place to tie into storm sewers. There will be twelve (12) laterals on the new system, and part of the laterals will be where the old church sets. Normally the drainage is put in first, but in this case the new church will be constructed, then all the other buildings will be torn down and the area brought up to specs and the drainage put in. Terry Weiss commented a notation will be put on the plans. At present time all the water drains to the street and that will continue until the drainage system is put in place. Terry Weiss asked if the contractors could start immediately on the project and keep the old church in place. It was stated as soon as the new church is up; Jackson’s will start taking down the old church. The contact person for the church project is Charlie Dreibelbis After brief discussion, Sherry Fulton made a motion to approve the drainage plans for the First Presbyterian Church. Roger Rose seconded the motion. Motion carried two to zero. Drainage Board Secretary, Jean Cloud, will type up a letter for the Area Plan Commission and get a copy of the letter to Terry Weiss. IN REF: ALLEN AND COPLEN OPEN & TILE LOWERING CAUSE NO. 23-1968 #690 MAINTENANCE RATE Fulton County Surveyor, Don Towne, stated landowners had contacted him about lowering the maintenance rate on said drain. The work is completed and the said ditch fund is now in the black. The open will need to be sprayed and if any cleaning needs to be done, it will have to be done as a one step removal. The tile should not need any work for quite some time. After brief discussion, Sherry Fulton made a motion to lower the maintenance rate on said drain to the following: landowners on the tile be lowered from $75.00 per benefited acre to $8.00 per benefited acre with a $10.00 minimum; and lower the maintenance rate on the open from $15.00 per benefited acre to $5.00 per benefited acre with a $10.00 minimum. Roger Rose seconded the motion. Motion carried two to zero. IN REF: LANDOWNER COMPLAINT REPLACING PIPE UNDER ROAD There was discussion about an equalizer pipe under a roadway replaced by the County Highway and the landowner had called in and was complaining. After brief discussion, the pipe was bad and that is routine for the highway to replace bad or damaged pipes under roadways. IN REF: SS COLLINS OPEN SYSTEM HEARING PUBLISHED: CAUSE NO. 2-2010 #806 ORDER MADE Chairman, Roger Rose, opened the hearing at 9:35 A.M. D.S.T. The purpose of the hearing is to establish a maintenance rate on a legal drain of record. Landowner’s Letters were mailed on July 6. There are 347 parcels, and 11544.30 Benefited acres in the watershed. Proposed maintenance rate: $9.00 per benefited acre with a $10.00 Minimum Surveyor Report of Project: Proposal is to do the Collins Main, which starts at Mud Creek, upstream to the south;Arm #2, which goes down through Collins pit and continues on the south side of the pit;Arm #3; and Arm #4, outlet of Lears Lake and up to the dam at Lears Lake. Work will stop at the private crossing a few hundred feet from the dam. Permits have been obtained for the project. The arms into Lears Lake are not included in the proposal. Brush one side and put on a spray program. Dredging the entire drain, taking out approximately 3 ˝ feet down to a foot. Two crossings will be lowered: (1) 650 West south of State Road 14 on Arm #3; (2) north of State Road 14 on Arm #3, a private drive going back to Lears Lake, the private crossing pipe will be lowered. The Bailey Open is currently on maintenance and drains into the Collins ditch about 8000 feet upstream of the outlet, just south of County Road 200 North. The Bailey watershed is approximately 5,000 acres. A petition is on file to establish a maintenance rate on said drain. The drain was dredged in 1975 or 1976. The ditch is brushy, filled in and has logjams. The permit only allows brushing one side of the drain. Chairman, Roger Rose, opened the floor for public comments. Rodney Hawkey commented he had sent a letter and also a copy of a letter from Dan Rosswurm stating approximately 66 acres of their 85 acres is in a WRP program, not farmable land. Feels the land in the WRP should be excluded from the assessment. Dave Smith asked if this was a one time assessment. Surveyor, Don Towne, responded the proposal is to have the assessment at $9.00 per benefited acre for three (3) years, then the Board can review after the third year and lower the rate. Bryce Shaffer commented he has never seen a rate lowered and asked about only one side of the ditch being cleaned. Surveyor, Don Towne, commented the farmer can clean the other side, and we also encourage the farmer to put their land in a CRP program. Steve Brown commented he feels the $9.00 is excessive for no more benefit they will receive. Steve commented the Bailey ditch runs through their ground and Collins ditch also runs through them and has been cleaned on the north and west side ever since he has lived there. Steve further commented his land on the west side is in the CRP program, and if the ditch is cleaned on that side it will destroy the cover crop, and he will have to put it back at his cost. Steve asked if the fish ponds would be maintained or taken out. Steve explained those ponds were put in when Mud Creek was cleaned years ago. Surveyor, Don Towne, commented that DNR does not require the ponds be maintained, so the ditch will be dredged to grade and the riprap will be used to line the bank or be buried. Steve commented he preferred the riprap be buried deep. Steve commented the gravel pit used the ditch more than the landowners in the past years, and feel they should be charged more for their usage. Steve commented he had two (2) proposals: The landowners in the Bailey should only be charged from Mud Creek to the Bailey outlet, and the landowners on south pay on the Collins. Surcharge the gravel pit Steve asked if the Bailey and Mud Creek rates would be lowered, because the majority of the landowners are currently paying on the Bailey and Mud Creek. Ken Gudas commented that is also his objection of paying on three (3) ditches, and everyone is paying the same even though they are several miles from the drain. Ken commented their property is closer to the river and does not feel it is fair, and feels the watershed needs to be changed or rearranged so people are not penalized, because their land is situated in several watersheds. Walt Talbott asked for the Indiana Code that allows the Drainage Board to charge three (3) maintenance fees on one acre. Drainage Board Attorney, Greg Heller, responded it falls under IC 36-9-27-39,40 & 41. Greg further commented there is not particular section that actually states it specifically, but the codes mentioned explains the establishing of a maintenance rate. Walt commented his property is already on two (2) ditches and the third one will not benefit his land. After brief discussion, Chairman, Roger Rose, commented the Board makes policy decision on what is legally allowed by the Drainage Code and our Attorney’s interpretation. Don Metzger commented this would not benefit his land. Chairman, Roger Rose, commented the Drainage Laws are to provide drainage infrastructure to landowners and the landowners are assessed in order to maintain the infrastructures. Albert Gudas commented their land did not benefit from the maintenance of Mud Creek and do not see any benefit from the establishing a maintenance rate on the Collins Ditch. Albert further commented they will also be paying on three (3) ditches and sees no benefit. Albert also commented the time should be taken to make sure it is done as fair as it can be done. There was discussion about pro rating land according to the benefit the landowner is receiving. There was discussion about combining drains. There was discussion about the money collected on the drain. It was explained the money collected is specifically used for that particular drain, no other drain. The interest money earned on the maintenance money is put in the General Drain Improvement Fund. The money in the General Drain Improvement Fund is used to pay a contractor for work done on a drain before the maintenance money is collected. The maintenance fund for said drain then pays back the General Drain Improvement Fund when maintenance money is collected. Jeff Grube commented if the work stops before the dam, then it will not benefit him. Russell Koebcke commented he is on the north side of Lears Lake, and feels he will not see that much benefit, most of his water drains into Arm #4, and unless the lake is lowered he will not benefit. Chairman, Roger Rose, commented there is water runoff from every property and it goes some place. Gene Reinholt commented he has paid on the Bailey for years and why do they have to help pay on the Collins. Gene further commented he does not feel this is fair to pay on three (3) ditches, and also commented he is not in favor of combining the Bailey and Collins as one watershed. Albert Gudas commented he is not in favor of combining the watersheds. Terri Schmidt commented she has small acreage compared to some of the others here, but she has spent thousands of dollars to have the water flow through her property so that it will not flood her basement. Terri commented she had contacted the county, because the water in the ditch in front of her house was backed up, but was told it was not a county drain, so they could not help her. There were further comments and questions from the landowners. Phyllinga Jackson asked the Board with what has been heard from landowners today, what will be the possible outcome or conclusion. Chairman, Roger Rose, responded the action the Board today will be to accept the proposal as presented or make amendments to the proposal. It was asked if the Board would continue the hearing to another day. Chairman Rose commented we do not normally do that. Drainage Board Attorney, Greg Heller, commented if the Board is contemplating combining drains then that would require another hearing. After further questions and comments, Surveyor, Don Towne, commented the proposal is to assess the landowners in the Collins watershed, and the Bailey watershed is also in the Collins watershed, so the landowners would be paying two (2) assessments. Larry Leasure asked about the grade from State Road 14 to back behind John Anderson’s home. Beverly Jackson commented she has to leave but feels the assessment is too high and is not fair. Dave Smith was asked about the petition, and Dave responded he carried the petition in order to get a hearing set up and he had 10% of the landowners sign the petition. Walt Talbott asked about dredging from the river upstream on Mud Creek. Don stated it could be done, but it would require more permits and it would have to be floated and pumped to an upland site. There was discussion on how far out on the ditch bank will the contractor need to do the work. It will be left up to the contractor in order to burn and bury the brush. Most of the project should be able to be done in the seventy-five foot (75’) right of way, unless the contractor needs more area, and it depends on how big the trees are, but must have sufficient area to burn and bury. Steve Brown commented it will take his CRP area and could even take part of his crop, and asked if there were provisions for damages included in the proposal. The work is usually done in the off-season if possible. The contractor will not be able to do work on the drain from April to September because of bat habitat and fish spawning. Dave Smith asked if the State Highway pays an assessment. Don replied “yes and also the County Highway.” Mr. Reinholt asked if this is a done deal and the two drains combined. Chairman, Roger Rose, commented the two (2) drains are not being combined, but one watershed is within the other watershed. There would be two (2) different assessments. Final comments from the public: Rodney Hawkey asked about his wetlands again, and Don Towne commented he had talked with Dan Rosswurm and he was not concerned even if the ditch was cleaned by the property. Ken Gudas commented he does not see any fairness being charged three (3) times. Albert Gudas stated from the comments he has heard, he does not feel there is a lot of support for this project, and does not want to deny drainage, but it is all about the who is going to pay what. Albert feels the system needs be broken up according to what each is using. Steve Brown would like to see it pro-rated. Dave Smith commented he feels everyone agrees that the ditch needs to be cleaned, just need to spread the cost over more years. The comment was made the permits allow cleaning on one side, does the farmer/landowner need a permit to clean the other side. Don responded the farmer/landowner does not need a permit. Being no other public comments, Chairman, Roger Rose, closed the public comment portion of the hearing. Chairman, Roger Rose, stated the Board would take a break and 11:10 A.M. D.S.T. Chairman, Roger Rose, called the hearing back to order at 11:40 A.M. D.S.T. Chairman, Roger Rose, stated the Board has considered all the comments and is considering the following: Eliminate the $2.19 assessment on the Bailey Lower Mud Creek maintenance rate to $1.00 Consider a surcharge to IMI Amend the proposed rate to $9.00 for three (3) years and $3.00 for the 4th year and subsequent years or $7.00 for four (4) years and $3.00 on the fifth (5th) year and subsequent years Include the Branch to the Collins Arm #2 in the project, which would be approximately 3,350 feet Chairman, Roger Rose, asked for further public comments. There was discussion about surcharging IMI based on volume. The comment was made IMI is not doing anything now, but it would be at the Board’s discretion in the future to assess IMI properly. Albert Gudas commented there is nothing being done on the Bailey; you are just spreading it out. Albert commented they do not benefit from Mud Creek and will not benefit from Collins. There was further discussion and comments. Being no further comments, Chairman, Roger Rose, entertained a motion to drop the existing $2.19 per benefit acre assessment on the Bailey Ditch, lower the proposed Collins rate to $7.00 per benefited acre for four (4) years and lower to $3.00 on the fifth and subsequent years; add Branch to the Collins Arm #2, approximately 3350 feet to the project; and determine an appropriate surcharge to IMI for additional usage of the open ditch. IN REF: MUD CREEK LOWER MAINTENANCE RATE CAUSE NO. 10-1980 #723 Surveyor, Don Towne, commented there is approximately a hundred thousand dollars worth of work to do this fall and there will be a balance in the fund when the work is completed. After brief discussion, Chairman, Roger Rose, entertained a motion to lower the maintenance assessment on said drain by $1.00 per benefited acre. Sherry Fulton made a motion to lower the maintenance rate on Mud Creek to $1.00 per benefited acre. Roger Rose seconded the motion. IN REF: BABCOCK OVERMEIER OPEN SET HEARING: CAUSE NO. 5-2010 #807 ESTABLISH A MAINTENANCE RATE SURVEYOR MAINTENANCE REPORT: Petition received Drain located in Richland Township. The proposal is to establish a maintenance rate on the upper end of said drain. The drain has approximately four (4) foot of fill at the pipe at the road. The proposed maintenance would start at County Road 250 West and go upstream to the end of the open, approximately 9200 feet. Surveyor’s Estimate: $14,250.00 There is approximately 1602 acres in the watershed. Surveyor, Don Towne, commented he has acreage in watershed. Replacing 2100 feet of 18 inch tile; 2300 feet of15 inch tile; 1000 feet of 10 inch tile. Approximately 267 acres in the watershed. Surveyor’s Estimate: $83,400.00 Proposed reconstruction rate: $325.00 per benefited acre with a $325.00 minimum. The drain is currently on maintenance and there will be no change in the maintenance rate. IN REF: LAUTENHIZER DITCH DISCUSSION Surveyor, Don Towne, commented this is a county drain record that drains into Rock Lake. The drain is not on maintenance. The drain is filled in at the outlet and backs up water on the road and when there is a big rain event the water comes across the road and washes out a landowner’s drive. The County Highway would like to have it fixed also. The Drainage Board agreed to fix the problem if it could be done for $1500.00, and the County Highway would work with us on the project. A contractor with a small track excavator has given an estimate, which is over the $1500.00. After further discussion, it was stated unless the ditch is set up on maintenance or the landowner is willing to help pay to correct the problem, the work cannot be done for the $1500.00 the Board agreed to pay, which is according to Statute. IN REF: JOSEPH LEASURE MAIN TILE UPDATE ON TILE RECONSTRUCTION CAUSE NO. 5-1983 #577 Surveyor, Don Towne, commented contractor, Kirk Ingram, installed the tile across State Highway 17 in the three (3) days and the highway was reopened. The tile was ran up to the concrete tile, which was the stopping point and at that point there had to be some decisions made at that time. The existing concrete tile did not lay the way the plans were drawn up back in 1983 or 1985. Since the situation was different than the plans, Don stated he contacted Mike Smith and the decision was made at that time to run the twenty-four (24) inch tile on over to Bruce Beehler’s property. The concrete tile was taken out. The ditch fund will pay the difference in the cost between the twenty-four (24) inch tile and the fifteen (15) inch tile and Bruce will pay the remainder. The twenty-four (24) inch tile will extend approximately fifty (50) feet past the property line on grade and hook to the existing tile and that will complete the project. Don commented then Bruce will be on his own, since the twenty-four (24) inch tile main was extended.
