E.S.T. in the Conference Room. The following were present: Chairman, Roger Rose; Vice Chairperson, Sherry Fulton, Board Member, Stan Musgrave; Fulton County Surveyor, Don Towne; Assistant Surveyor, Tom Chudzynski; Drainage Board Secretary, Jean Cloud; Bill Garman; Terry Weiss, R.E. Daake & Associates; Shannon Shepherd, Fulton County Health Department; Jerry Brown and Frederick Brown. It is duly noted that Drainage Board Attorney, Greg Heller, arrived at 9:17 A.M. E.S.T. Chairman, Roger Rose, called the meeting to order at 9:07 A.M. E.S.T. There were no minutes to review. IN REF: DRAINAGE PLANS WILLIAM GARMAN SHOREWOOD ESTATES Terry Weiss, R.E.Daake & Associates, presented drainage plans for the William Garman property at Shorewood Estates. Mr. Garman is requesting approval for an easement on the south side of his lot to run a pipe to a county drain of legal record (Holtz ditch), which would serve Mr. Garman’s lot. If the lots to the west of Mr. Garman are sold, then the landowners would not be allowed to tie into the pipe, unless approval is obtained from Mr. Garman. It was stated there is a recorded easement at the back of the lots, and there was discussion about a header system being installed so everyone could use it, but there were some issues between the installer and Health Department. Shannon Shepherd commented the Health Department did not say that a header system could not be put in, but they required the installer to install a six (6) inch pipe, and the installer was planning on installing a four (4) inch pipe. Since there was conflict between the plans and the installer, the Health Department would not issue a permit until the issue is resolved. Shannon further commented there is no issue with the pipe going down the center of the lots, but the issue is if the pipe is installed down the center of the lots and drained into a county drain of record, then the Drainage Board must approve the drainage plans before the septic permit can be issued. After much further discussion on this issue, Chairman, Roger Rose, stated he feels these plans are of a poor design, and the developer should be contacted and discuss with him about putting in a system that would serve the entire area. There was further discussion on this issue. Drainage Board Attorney, Greg Heller, advised the Drainage Board the issue could be tabled to a certain date or in the future when alternative Drainage Plans are submitted. Sherry Fulton made a motion to table the Drainage Plans for William Garman until alternative plans are submitted that will take care of the entire subdivision. Stan Musgrave seconded the motion. Motion carried three to zero. IN REF: WILLIAM WALSH OPEN HEARING PUBLISHED: CAUSE NO. 1-2010 #805 ORDER MADE Chairman, Roger Rose, opened the hearing at 9:55 A.M. E.S.T. Landowners/Representatives present: Jerry Brown and Frederick Brown. Purpose of Hearing: Establish a Maintenance Rate Benefited Acres in Watershed: 609.94 Proposed Maintenance Rate: $8.00 per benefited acre/$10.00 minimum Letter of Objection: Dorothy Warfield Mill Creek Conservancy Board of Directors has released the open drain to the Fulton County Drainage Board. Original letter is in Drainage Board office. Proposed Work to be done: Dredge the entire drain. – east arm is to be clean to the fence line – approximately 1800 to 1900 feet – heavy brush on the low end of said drain. Surveyor’s Estimate for work: $13,350.00 – 3 years at the proposed rate, at the end of three years the Board could review the maintenance fund and possibly lower the rate at the time. Being no further discussion, Chairman, Roger Rose, entertained a motion to establish the maintenance rate on said drain at eight dollars ($8.00) per benefited acre with a ten dollar ($10.00) minimum. IN REF: CHRISTINA KEHRER-SEIFERT TILE BIDS RECEIVED: CAUSE NO. 4-2009 #804 WORK AWARDED Surveyor’s Estimate: $26,000.00 Completion Date: April 20, 2010 Received the following bids: Ingram Excavating (James) $23,276.33 Gudas Excavating $23,466.20 LDP Excavating $20,360.00 Jesse Rude $18,831.16 Chairman, Roger Rose, entertained a motion to award the work on the Christina Kehrer-Seifert Tile, to Jesse Rude with his low bid of $18,831.16. Sherry Fulton made a motion to award the project to Jesse Rude for his low bid of $18,831.16. Stan Musgrave seconded the motion. Motion carried three to zero. IN REF: SURVEYOR’S REPORT SPRAY BID LETTING – APRIL 12, 2010 All ditches have money in the fund except for the Lucenia Smith Open. Eighty-three (83) miles of drains will be bid. IN REF: KEWANNA STORMWATER PROJECT Landowner, Joshua Martindale, had been asked by the contractor about putting the fill dirt in the low area on his property and the engineering company asked that the landowner make sure that the tile running through his property is not a county drain of record. First Deputy, Tom Chudzynski, stated he explained to the landowner’s mother that the tile was not a county drain of record, but the tile should be maintained. Tom further explained if they allow the contractor to fill in the low area with dirt, the water should not be backed up on the adjacent landowner. After brief discussion, a letter had been composed by the Surveyor’s office and will be sent to the landowner. IN REF: BELWOOD ACRES Drainage Board Attorney, Greg Heller, stated Dr. Bugno had contacted him about a condemned property and that the Health Department cannot issue a permit for a sub-standard septic system for the property. IN REF: CHIPPEWANUCK CREEK SURFACE DRAIN INFO CAUSE NO. 2-2009J #799 AND UPDATE ON WORK 1-24” surface drain at wetland area required by DNR permit. Maintenance fund pays for cost of installation at the following locations: Dale Smith property: Newcastle Township, W ž SE – Location: 36-31-3. Tom Weaver property: Henry Township, M Div, E ˝ NE & E ˝ NE – Location 7-30-4 1-15”, 1-18” and 1-24” surface drains installed Roy Fisher property,Rochester Township, W Div NE – Location: 35-31-3. Maintenance fund to pay for ˝ the cost. 1-15” surface drain installed on Mike Norman, Henry Township, NE, Location 17-30-4. Maintenance fund to pay ˝ the cost. Unless landowners want to do a cost share on surface drains, there will be no more surface drains installed. The contractor has all the brushing done. The big chipping machine is out on the job, and all the brush will be chipped and hauled away, which is how the contractor was able to bid so low on the project, because the brush does not have to be burned and buried. IN REF: FORM 96 There was discussion on whether or not these forms need to be used for our bidding process, as our projects are not Public Works projects. After further discussion, Drainage Board Attorney, Greg Heller, will do research on this issue and get back to the Board. IN REF: 4TH STREET SEWER PROJECT L.N Bair Open, Wagoner Schuler Tile and AW & AH Good Tile are county drains of record that are involved with the sewer project. Chairman, Roger Rose, commented FEDCO is going out for a Bond for the sewer project, and there was also discussion if there are grants available. Roger stated he would have further discussion with Shane Blair on this issue. Drainage Board Attorney, Greg Heller, excused himself at 11:08 A.M. E.S.T. IN REF: EDDY CREEK JOINT BOARD MEETING CAUSE NO. 3-1999J #756 Drainage Board Secretary, Jean Cloud, stated she had received a letter from Marshall County Surveyor, Larry Fisher, wanting to set up a Joint Board meeting to discuss work to be done on a portion of Eddy Creek in Marshall County that is not currently on maintenance. After brief discussion, a motion was made by Stan Musgrave to appoint Roger Rose and Sherry Fulton to serve on the Joint Board. Sherry Fulton seconded the motion. Motion carried three to zero. Sherry and Roger commented that Tuesday, March 16th is the best date for them in the morning. IN REF: JOHN BAKER OPEN CERTIFY TO AUDITOR CAUSE NO. 3-2009 #803 MAINTENANCE ASSESSMENT The undersigned of the Fulton County Drainage Board, do hereby certify the assessment for maintenance of the above captioned drain, in accordance with the Drainage Act of 1965, and as amended, to be placed on the Ditch Duplicate and to be collected by the County Treasurer. Such assessment to be first collected during the year 2010, and thereafter as required by law.
