Meeting Called To Order: Council Members present at this meeting were Judy DeVries, Earl Gaerte, Christopher Sailors, David Helt, Harry Richter, James Widman and Gary Sriver; Also, County Auditor Denise J. Bonnell. President Chris Sailors called this December 14th, 2004 Meeting to Order asking all to stand for the Pledge of Allegiance to the American Flag. Council Minutes: Chris referenced the minutes of November 16th, 2004, for any additions or corrections. Chris called for a motion to approve the minutes. Harry Richter made a motion to approve the minutes of November 16th, 2004. James Widman seconded this motion. Motion carried 7-0. Ordinance #111604 Amendment to Inventory Deduction Ordinance: Chris briefly commented on this Ordinance; stating the Ordinance passed in 2002 basically shifts the Inventory Tax, as per the States revision. This amendment changes it to an allocation method instead of the uniform method making it more favorable to the taxing units that have more inventory missing from assessment than other units. Passing this Ordinance will make it effective as of January 1, 2005 (tax year 2005 payable 2006). Chris then read by Title Only Ordinance #111604, Amendment To Ordinance #11902-A Dated December 11, 2002 Amendment To The Ordinance Providing 100% Deduction For Assessed Value Of Inventory. Chris called for any further discussion on this Ordinance. Chris called for a motion to approve this Ordinance by the Third Reading. James Widman so moved; seconded by Earl Gaerte. ORDINANCE #111604 AMENDMENT TO ORDINANCE #111902-A DATED December 11, 2002 AMENDMENT TO THE ORDINANCE PROVIDING 100% DEDUCTION FOR ASSESSED VALUE OF INVENTORY WHEREAS, IC 6-1.1-12-41, as added by P.L. 192-2002 (ss) (Act) authorizes the adoption of an ordinance in a county to provide that a deduction applies to the assessed value inventory located in the county; WHEREAS, the Act provides that the deduction is equal to one hundred percent (100%) of the assessed value of inventory located in the county for the appropriate year of assessment; WHEREAS, the Act provides that inventory has the meaning set forth in IC 6-1.1-3-11; WHEREAS, the Act provides that an ordinance adopted in a particular year applies to each subsequent assessment year ending before January 1, 2006; WHEREAS, the Act provides that the entity that may adopt the ordinance is the county income tax council if the county option income tax (COIT) is in effect on January 1 of the year in which an ordinance under this section is adopted; the county fiscal body if the county adjusted gross income tax (CAGIT) is in effect on January 1 of the year in which an ordinance under this is adopted: or the county income tax council or the county fiscal body, whichever acts first, for the county not covered by (1) or (2). WHEREAS, CAGIT was in effect in Fulton County (County) on January 1, 2002, and the County Council (Council) is the entity authorized to adopt the ordinance under the Act; WHEREAS, the Council now desires to adopt an ordinance to provide that a deduction applies to the assessed value of inventory located in the County; and WHEREAS, the Council now desires to provide a deduction beginning with the 2003 assessment year. NOW, THEREFORE BE IT ORDAINED BY THE FULTON COUNTY COUNCIL: 1. A deduction equal to 100% of the assessed value of inventory located in the County and began with the 2003 assessment year. That the Fulton County Council has determined that it is in the best interests of the individual taxing units to have the CAGIT tax colleted under this ordinance to be distributed using the States Allocated method instead of the Uniform method. 3. The County Auditor is hereby authorized and directed to provide a certified copy of this ordinance to the Department of Local Government Finance and to the assessor of each township located in the County before January 1, 2005. He said he would review this with Attorney Wagoner before the January 2005 Meeting and he will probably have a report at that time. The discussion continued. Old Business: Director Casi Cramer said she wanted to update the Council on the Area Plan Commission and whats going on. Rochester did end up passing the enacting ordinance; Kewanna will be looking at their enacting ordinance in January. There has been conversation between Connie Hartman and Rich Powell, regarding the town of Fulton. Chris said he had met with Jim OKeefe, Woodlawn Hospital and Ellen Swan, who represents Zehner, Malloy & Associates, which are the Certified Public Accountants concerning the auditing of the EMS for the Council. A discussion followed. Dave Helt stated he attended the December 7th Meeting for the United Way Grant and told them, the Council would not be a partner, which he explained. Chris said that January 5th, 2005 at 5:00 p.m. would be the Organizational Meeting to elect officers and make appointments for 2005. This concluded all the business transacted.
