Meeting Called To Order: Council Members present at this meeting were Judy DeVries, Earl Gaerte, Gary Sriver, Christopher Sailors, James Widman, Dave Helt, Kathy Siders and Auditor Denise J. Chandler. Council Minutes: Council President Jim Widman referenced the minutes of the Council meeting on February 20, 2008, for any additions or corrections. Jim called for a motion to approve the minutes as corrected. Gary Sriver moved to approve the minutes of February 20, 2008, meeting as corrected. Earl Gaerte seconded this motion. Motion carried 7-0. Coroner Certification: Jim noted that the State notified the County that Coroner pay was to be withheld until he gained his Medico legal Death Investigator Certification. Notification has since been received that this has been accomplished. CAGIT Resolution Jim explained that this resolution will take money from the CAGIT funds to support the Solid Waste District, which is normally supported through the landfill. Jim read Resolution #031808. A RESOLUTION AUTHORIZING CAGIT DISTRIBUTION TO THE FULTON COUNTY SOLID WASTE MANAGEMENT DISTRICT RESOLUTION #031808 WHEREAS, INDIANA CODE 6-3.5-1.1-1.3 authorizes a County Solid Waste Management District to receive CAGIT funds upon the approval of a majority of members of the County Fiscal Body; and WHEREAS, the failure of the County Fiscal Body to pass a resolution approving the distribution will result in the Sold Waste Management district being omitted from the calculations performed by the State Board of Tax Commissioners in determining the governmental units eligible for the distribution of CAGIT, and WHEREAS, adoption of this resolution would result in CAGIT funds being paid to the Fulton Solid Waste Management district, at the expense of all other units of local government receiving CAGIT funding. BE IT THEREFORE RESOLVED: that the Fulton County Council, by this resolution, approves the distribution of County Adjusted Gross Income Tax (CAGIT) funds to the Fulton County Solid Waste Management District. Upon a vote of the County Council of 0 aye, 7 nay, 0 not voting, this resolution is rejected this 18th day of March, 2008. Wheel Tax Discussion: Chris Sailors explained that the committee appointed to review the Wheel Tax and Excise Tax found that 45 of the 92 Indiana counties currently impose that tax. Those close by are Carroll, Kosciusko, Tipton and St. Joseph counties. Carroll generates roughly $440,000 from the wheel tax; Tipton $449,000. Another option for supplement highway funding revenue is from the CEDIT tax, which Starke County has funded their highway department by about $625,000 from their CEDIT tax. Twenty-six counties use this option. Some counties supplement highway funding out of permits and user fees. He explained a couple of other means for funding. Chris favored using some funds from the CEDIT fund to help fund the highway department. Denise reported $409,000 in CEDIT with an additional $500,000 CD; in the Special CAGIT a $500,000 CD and $21,000 in cash; and $480,410.43 in the Rainy Day Fund. Commissioner reported that calculations show that $532,155 would be generated by the Wheel/Excise tax, of which the County would receive $404,000. The rest would be distributed to the city and towns of the County. There was significant discussion on this topic. If money were to come out of the CEDIT fund, a percentage would also be distributed to the city and towns of the County. Kathy Siders moved to take $350,000 out of the CEDIT fund to transfer to the County Highway and understand that we have to share that with the other agencies and reserve $100,00 of the CAGIT fund as a back up for the County Highway Department. Highway Department: Mike Clark reported that the highway department does not have the revenue at this time of the year to pay the department’s insurance premiums. In the past it was borrowed from the County and repaid within the year. Clark proposed borrowing it and paying back $30,000 in April, $30,000 in May and $30,864 in June. Chris Sailors moved to allow the borrowing to pay the insurance and approve the repayment schedule of $30,000 in April and May and remaining balance in June. Dave Helt seconded the motion. Motion carried 7-0. Sheriff: Sheriff Walker Conley reported receiving bids for the two new vehicles he’d like to purchase this year. Bids were for an Expedition for $29,766.12, an Explorer for $27,401.95, and a Crown Vic for $27,155. He explained that the Explorer is pretty cramped once all of the equipment is installed and the Explorer is not offered in the tan sheriff color. These prices from Rochester Ford include vehicle setup, radio and lights. The trade in offered is $1,200 for the 2003 Intrepid and $2,500 for the 2003 Durango. He said that Ford also offers free oil changes for as long as the County owns the vehicles, which would be 44 times (130,000 miles for 4 to 5 years) at $28 each time, totaling $1,232 per vehicle. He estimates the total cost to be $50,757.12. He also got a bid from Erik’s Chevrolet for an Impala at $25,180 with a $1,000 trade for the Intrepid. He reported problems the sheriff department experienced with Impalas in the past. Erik’s also offered a Tahoe for $32,543 with a $2,500 trade on the Durango. He reported that he preferred the Expedition and the Crown Victoria from Rochester Ford. The purchase of two vehicles was approved at a previous meeting. Jail: Commissioner Mark Rodriguez provided written information regarding the jail and its need for an indoor recreation area. A few years ago the former sheriff transferred the indoor recreation area into additional jail space. The State requires that jails have an indoor recreation area. One suggestion is to lease with option to purchase the Old Post Office at Eighth and Madison streets for utilization by jail administration and the 911 department. The owners would remodel to the County’s specifications. Conley said that the proposed floor plan would accommodate three or four more officers. The owners would provide a ten-year warranty on the roof. It was asked if the prevailing wage would be an issue, since the County wouldn’t be leasing the building until after all work was completed. The Council will refer to its attorney on that matter. Plan Commission: Plan Director Casi Cramer wanted to let the Council know the details of the issues raised regarding Dragon ESP and its neighbor’s complaints. She said that due to the most recent complaints, Fedco has offered to help with the cost of air monitoring, because one of the concerns is that there is something harmful emitted from the facility, though the facility meets IDEM standards. Fedco Director Shane Blair and Casi are working to find the best-qualified firm to perform air monitoring. This concluded the business transacted.
