Meeting Called To Order: Council Members present at this meeting were Judy DeVries, Earl, Gaerte, Christopher Sailors, David Helt, Harry Richter, James Widman and Gary Sriver; also, Auditor Denise Bonnell and Attorney Ted Waggoner. President Christopher Sailors called this February 18, 2004, Meeting to Order, asking all to stand for the Pledge of Allegiance. Council Minutes: The Minutes of the previous Meeting, January 21st, 2004 were reviewed. Jim Widman made a motion to approve the January 21st, 2004 Minutes. Harry Richter seconded this motion. Motion carried 7-0. Susan Griffith: Assistant Director Position should be restructured to pay more per hour and since it is part time there would be no benefits involved. The hours would be 29 hours per week instead of the full time position she had previously requested. She needs this additional position and cannot afford to do without the part time secretary to continue to do the day to day tasks. The Council asked Susan if the Commissioners had approved this increase in her employee number of positions. Susan answered that they told her to go ahead and ask Council since they are the ones that have to find the funding to pay for the position and amend the Salary Ordinance. The Council agreed that she needed to go back to the Commissioners so that they could give their recommendation to the Council in the appropriate manner. Susan said she would go back to them then. WTH Data sharing Ordinance #021704: JOINT ORDINANCE #021704 An Ordinance of the Fulton County Board of Commissioners and Fulton County Council establishing fees for electronic map data created and maintained by Fulton County and restricting certain commercial reproduction of said electronic map data. WHEREAS, Indiana Code 36-1-3-8(a)(6) and Indiana Code 5-14-3-8(j) provides that a public agency may establish a fee for the provision of copies of electronic map data; and, WHEREAS, Indiana Code 5-14-3-8.5 provides that the fiscal body of a political subdivision may adopt an Ordinance to establish an electronic map generation fund for the deposit and use of funds collected for the provision of electronic map data; and, WHEREAS, Indiana Code 5-14-3-2 defines direct cost that may be charged by a public agency for providing a duplicate of electronically stored data onto a disk, tape, drum, or other medium of electronic data retrieval; and, WHEREAS, Indiana Code 5-14-3-2 defines electronic map as copyrighted data created and provided by a public agency from an electronic geographic information system; and, WHEREAS, Indiana Code 5-14-3-2 defines personas an individual, a corporation, a limited liability company, a partnership, an unincorporated association, or a governmental entity; and, WHEREAS, Indiana Code 5-14-3-3(e) provides that a political subdivision may enact an ordinance prescribing the conditions under which a person who receives electronic data may or may not use that information for commercial purposes; and WHEREAS, it is in the best interests of the citizens of Fulton County that both the Fulton County Board of Commissioners and Fulton County Council approve the terms of this Ordinance to conform to the terms of Code 5-14-3. IT IS THEREBY ORDAINED by the Board of Commissioners of Fulton County and the Fulton County Council as follows: 1.Title and Definitions This Ordinance and any parts herein shall be known as the Fulton County Electronic Map Ordinance. In accordance with Indiana Code 5-14-3-2. person as used in this Agreement is defined as an individual, a corporation, a limited liability company, a partnership, an unincorporated association, or a governmental entity, and electronic map data as used in this Agreement is defined as copyrighted data created and provided by a public agency from an electronic geographic information system. 2. Fee Schedule Pursuant to Indiana Code 5-14-3-8(j) the County may charge a fee, uniform to all persons for providing electronic map data that is based upon a reasonable percentage of the Countys direct cost of maintaining upgrading and enhancing the electronic map and for the direct cost of supplying the electronic map in the form requested by the person(s). In the case where disclosable and nondisclosable electronic map data are combined, Indiana Code 5-14-3-6 provides that the County may charge a reasonable fee for the Countys direct cost of computer programming to separate disclosable from nondisclosable electronic map data. It is hereby established by the Fulton County Commissioners and County Council that the initial fee schedule for the transmission of electronic map data is as set forth in an attached Fee Schedule that is incorporated by reference herein. If the County contracts with a third party contractor to handle the transmission of County electronic map data, the third party contractor shall receive 2/3, and the County 1/3 of the fees charged the person for electronic map data. This fee schedule shall be reviewed on an annual basis and may be changed on an annual basis to reflect the change in the cost in providing the electronic map data. 3. Exceptions to Fee Schedule Pursuant to Indiana Code 5-14-3-8(k) the fee charged by a County to cover the costs for maintaining, upgrading, and enhancing an electronic map may be waived by the Board of Commissioners, in whole or in part at its discretion if the use of the electronic map data will be used for a noncommercial purpose, including the following: Public agency program support, Nonprofit activities, Journalism, and/or Academic research. 4. Third Party Contractor In accordance with Indiana Code 5-14-3-3.6, electronic map information may be provided to person(s) through the Countys own computer gateway, or by agreement through a computer gateway of a third party contractor. Indiana Code 5-14-3-3.6(e) provides that a contract entered into under this section may require the payment of a reasonable fee to either the third party contractor, the County or both. In accordance with Indiana Code 5-14-3-4, neither the County nor the third party contractor shall disclose electronic map data that is specifically excepted from disclosure requirements. 5. Payment Where the County is using its own computer gateway for the provision to person(s) of electronic map data, payment shall be made by the person(s) at the time of delivery. Where the County has entered into an agreement with a third party contractor to provide electronic map data through the third party contractors computer gateway, the third party contractor shall handle the billing and invoicing of the fees charged and shall agree to send by U.S. mail that portion of the fee due the County to the Countys Electronic Map Generation Fund within 10 business days of the receipt of payment of fees to the third party contractor by the person(s) making the purchase. 6. Compliance with State Statues Nothing herein shall compel any office or their contracted third party contractor to charge a fee for copies if the fee imposed by this Ordinance is contrary to state law. In the event the fees in this ordinance are contrary to any charges established by State statue, the Statue shall apply. 7. Use Restrictions and Notice Pursuant to the provisions of Indiana Code 5-14-3-3(e) no person, other than those authorized in writing by the Board of Commissioners, may use the electronic map data provided by the County for commercial purposes, including to sell, advertise, or solicit the purchase of merchandise, goods, or services, or sell, loan, give away, or otherwise deliver the information obtained by request to any other person for these purposes. This includes the repackaging or assimilation of electronic map data for a commercial purpose in paper or electronic media. A person who uses information in a manner contrary to this Ordinance or a rule or ordinance adopted under Indiana Code 5-14-3-3 may be prohibited by the County from obtaining any electronic map data. The following notice regarding data ownership, restrictions, and qualifications shall be provided to every person that receives a copy of the Countys electronic map data. Fulton County electronic map data is the property of Fulton County, Indiana. All electronic map data supplied by Fulton County has been derived from public records that are constantly undergoing change and is not warranted for content or accuracy. The County does not guarantee the positional or thematic accuracy of the data. The cartographic digital file server is not a legal representation of any of the features depicted, and the County disclaims any assumption of the legal status they represent. Any implied warranties, including warranties of merchantability or fitness for a particular purpose, shall be and/or expressly excluded. The data represents an actual reproduction of data contained in the Countys computer files. This data may be incomplete or inaccurate, and is subject to modifications and changes. Therefore, the County cannot be held liable for errors or omissions in the data. The recipients uses and reliance upon such data is at the recipients risk. By using this data, the recipient agrees to protect, hold harmless and indemnify Fulton County and its employees and officers. This indemnity covers reasonable attorneys fees and all court costs associated with the defense of Fulton County arising out of this disclaimer. The recipient may copy this data into computer memory or onto computer storage devices and prepare derivative works from it for the recipients own use. Pursuant to the provisions of Indiana Code 5-14-3-3(e), no person, other than those authorized in writing by the Board of Commissioners may use the electronic map data provided by the County for commercial purposes, including to sell, advertise, or solicit the purchase of merchandise, goods, or services, or sell, loan, give away, or otherwise deliver the information obtained by request to any other person for theses purposes. A person who uses information in a manner contrary to a rule or ordinance adopted under Indiana Code 5-14-3-3(e) may be prohibited by the Board of Commissioners from obtaining any electronic map data. Please refer to Fulton County Ordinance #021704 for any other restrictions on the use of electronic map data or penalties for the misuse electronic map data. A copy of the language contained in this section shall be conspicuously posted in all offices where electronic map data is sold in the County, and shall be provided to any person(s) (as defined by Indiana Code 5-14-3-2) who desires to purchase electronic map data from the County. 8. Use Violation Penalty Any person(s) who violates the terms and conditions of this Ordinance by failing to pay for purchased electronic map data shall be liable for total fee charged for the electronic map data plus attorneys fees and the cost of collection. Any person(s) who violates the restrictions on the use of electronic map data as set forth in Section 7 of this Ordinance shall be guilty of an infraction and may be fined by the County up to Two Thousand Five Hundred ($2,500), and each violation shall be deemed a separate offence. Also, in the event that there is an improper use of electronic map data as set forth in Section 7 of this Ordinance or in violation of State or Federal Law, the County may prohibit the person(s) (as defined by Indiana Code 5-4-3-2) from obtaining any electronic map data and seek injunctive relief from any misuse of electronic map data by the person(s) who originally purchased the electronic map data or any other person(s) who has received a copy of the electronic map data. 9. Electronic Map Generation Fund Pursuant to Indiana Code 5-14-3-8.5, the Fulton County Council hereby establishes the Fulton County Electronic Map Generation Fund. The Electronic Map Generation Fund shall consist of fees charged for providing electronic map data to person(s) in accordance with Indiana Code 5-14-3-8(j) and be subject to the appropriation by the Fulton County Council. In accordance with Indiana Code 5-14-3-8.5(b), all funds collected in the Electronic Map Generation Fund shall be specifically dedicated to the following purposes: The maintenance, upgrading, and enhancement of the electronic map. The reimbursement of expenses incurred by a public agency in supplying an electronic map in the form requested by the person(s). 10. Dispute Resolution Any person who has a dispute, or seeks relief from the terms of this Ordinance may seek resolution of that dispute or relief from the Board of Commissioners of Fulton County. 11. Ordinance Codification The Auditor of Fulton County shall cause a copy of this Ordinance to be codified in the Fulton County Code. 12. Effective Date This Ordinance shall be effective on the ___ day of _________, 2004, and all Ordinances in conflict herewith are repealed. Council President, Chris Sailors asked the Auditor what the plan was to pay for this contract, and if County Assessor, Sandy Owens was in agreement with the new aerials? Auditor, Denise stated that Sandy will ask for an additional appropriation out of the Re-Assessment Fund to pay for this contract. Since this was agreeable with both the Auditor and the Assessor and a benefit to the county, the Council was in agreement to proceed. Gary Sriver made a motion to accept the proposed contract. Ordinance #021704-A Fee Schedule Electronic Map Data The fee Schedule for the transmission of Fulton County electronic map data, effective as of the 16th day of March 2004, is as follows: 1. Complete Map Data Layers: An annual fee of $1,500, paid in advance, for the continuous transmission of available and disclosable countywide non-photo electronic map data layers. A fee of $750, paid in advance for a one time delivery of available and disclosable countywide non-photo electronic map data layers delivered on a CD. A fee of $750, paid in advance, for a one time delivery of a Countys most recent aerial photo layer delivered on CDs. 2. Subsets of Map Data Layers (for less than countywide areas) A fee of $75 per hour for the preparation of one time specifically requested subsets of County electronic map data. 3. Separating Disclosable and Nondisclosable Data A fee of $150.00 per hour for computer programming required to separate disclosable and nondisclosable electronic map data if this is required as part of a one time map data request. Rainy Day Fund Amendment #021804: Attorney, Ted Waggoner read the following proposed Ordinance #021804 AMENDED FULTON COUNTY RAINY DAY FUND ORDINANCE # 021804 WHEREAS, Common Council of Fulton County adopted the Fulton County Rainy Day Fund Ordinance #052102-C; and WHEREAS, the Indiana Legislature thereafter amended the state law pertaining to Rainy Day Funds by Public Law 173-2003, Section 19 and by Public Law 267-2003, Section 15; and WHEREAS, it is appropriate to state the purpose of the Fulton County Rainy Day Fund; BE IT THEREFORE ORDAINED: That the County Council of Fulton County hereby ratifies the Fulton County Rainy Day Fund established under the previous Ordinance and amends the fund as follows: 1. The Fulton County Rainy Day Fund shall receive transfers of unused and unencumbered funds pursuant to order of the County Council after December 31 and before March 1 of the subsequent calendar year, unless a statute or the enabling ordinance provides that such funds be transferred otherwise, or that the unused funds are in a non-reverting fund; and 2. That in any fiscal year, the Council may transfer not more than 10% of Fulton Countys total budget for the fiscal year to the Rainy Day Fund; and 3. That the Council shall review the financial report of the funds of the county, and shall make such transfer to the Fulton County Rainy Day Fund; and 4. Before the County Council shall spend any funds transferred into the Fulton County Rainy Day Fund, the Council shall follow the appropriation process used with other funds that receive tax money; shall make specific findings for the proposed use of funds, pursuant to this ordinance; and 5. The specific purposes for the use of the Fulton County Rainy Day Fund may include, but shall not be limited by, the following: Purchase of real estate or construction of buildings for county business; Purchase of real estate or construction of buildings for economic development purposes; Purchase of personal property which qualifies as a capital fund purchase; Operating expenses, where such funds are needed due to unexpected loss of tax revenue or receipts; 6. The Fulton County Rainy Day Fund shall not be used for the following purposes: Wages, withholding obligations or fringe benefit for employees; Judgments or necessary expenses of county litigation; Health care expenses of elected officials or employees. Sheriffs Department: Sheriff Roy Calvert informed the Council that the Double Bunking should be done by the end of March 2004. Roy said the locks are going to be replaced; also, he said there are four companies bidding on the lock work. There was a discussion on reimbursement from the inmates and how this is based on the individuals income. They are using Federal figures, for instance, one-person family, approximately $12/13,000.00 and a family of four, somewhere in the range of $18/19,000.00. The Sheriff feels they would be indigent, as the Judge would in court, its a separate finding. As this was discussed, Roy stated he felt it was worth looking into. Roy stated the money is put into a Non reverting Fund to be used for maintaining food and expenses, etc. within the jail. Sheriff Calvert said Attorney Howard Williams represents about sixty Counties regarding Jail issues would be the one working on it, as it is all by Indiana Code. As the discussion continued Roy stated it is just another avenue, not necessarily the answer. Sheriff Calvert presented his Monthly Activity Report. Chris commented on the number of bookings, 877 in the Yearly Report for 2003. Sheriff Calvert said it is anyone that is mugged and printed; however, they may bond right back out. This was discussed. County Clerk: Clerk Karen Miller was asked about a Sheriffs Retirement Fund? Karen said pertaining to fees-IC.33-19-7, collection of fees-IC.33-19-5, the distribution of fees, which she stated came from the State, was on the fee schedule that she had handed out last month. She explained that State Statue sets the fees collected and the distribution as to where it goes; she went back into the 1980s and those fees are still coming back to the County, but are rolling over into the Pension Fund automatically as opposed to each $12.00 amount being apparently assessed for the Sheriffs Office for their pension plan, she is not sure of just what had happened. Sheriff Calvert told of the forming of a Merit Board in the mid-eighties, this Board is still in existence. The fee comes from Civil Process Papers being served, this was discussed. Auditor Denise stated in her first year of office the amount for the Sheriffs Retirement Plan was budgeted around $7,390.00. The next year it was about the same and then last year it jumped up; next year it will be 9 1/2% of whatever the salaries are, because she has just recently received that information for budget purposes. She went on to explain there is a mention in the Minute Book about a Merit Board being formed and we do receipt in Civil Process Fees. She continued to explain. She said there is a Line Item in the Sheriffs Budget that whatever the Trustee McKready & Keene determine what is needed for the Countys contribution, and they just recently sent the amount it will be next year. Attorney Waggoner then commented. Clerk Karen stated she and the Election Board did a site check of the Polling places on Tuesday. They are looking to change two sites, which they will take before the Commissioners at their March Meeting. She stated they are being hit heavily with handicap assessable requirements that are to be in place by 2006. She said by our County filling out the forms for reimbursement monies we will be having a survey team going out on Election Day to check assess ability for the handicap. She explained all that is required to bring the polling places up to these standards. Karen said they have adopted an Order for sixteen/seventeen year olds to allow them to be able to assist as either Clerks or Judges at the Polling Sites. She explained there are strict requirements on this as well. Attorney Waggoner spoke about fee issues stating the County Treasurer would have a fee requiring an Ordinance. He said there is an over-all copying fee ordinance that covers all the offices and made the suggestion that a check be made to be certain each office is covered with an Ordinance. Harry reported that he had made contact with the Treasurer and told her to contact Ted and have him write the Ordinance, which he also told Judy. The Ordinance for the Treasurers Office will be handled at the March Meeting. New Business: Fulton County Financial Information: Chris referred to the Budget Information provided to them from the Auditor for the years 1995 through 2003, what the amounts were, the actual distribution, receipts and the difference. As the report shows, Fulton County has on half of those years spent more than it took in, thereby showing that the County has spent what reserves they had built up in the other years. The cash on hand as of January $1,368,409.00. Budget Plans: Chris said Harry had a proposed resolution and everyone was given a copy. Chris read the Proposed Resolution. Chris commented following the reading. It was noted the Office Holder would have to be very careful as far as the Job Descriptions that have been written for each office. It was also noted the Office Holder should be doing their Annual Review with each employee, if this is enacted. This was discussed and the Auditor was asked if there were forms for the review. She said yes, she has them in her office, but only one office has asked for them. This was thoroughly discussed. The Personnel Policy that was rewritten, states there should be Annual Job Reviews. Rich was asked if this is something the Commissioners needs to enforce from this standpoint? Rich said he felt it was a gray area as to who would have that call. The Auditor said, according to the law and the Policy Manual it says the Supervisor/Office Holder, unless otherwise designated, is the one responsible for their employees. This was discussed and the consensus was the Office Holder should be the responsible person to do the evaluation. The Auditor was asked regarding the form, the categories for review. Denise replied, there are several, on a scale of one to five, five or six categories, e.g. appearance, communications skills, job performance, punctuality. She stated five being the highest and one lowest, each individually pertaining to their job, thats how she did it in her office, and of course, confidentially. The discussion continued. Harry said another thought he had was he would like to see throughout the county, is the use of volunteers, for extra office help, and he explained. Harry asked if all had received the letter from the Fulton Fire Department? They need an antenna to go on their tower. Harry said, Leslie Walters did some checking, the cost of the antenna was about $27,000.00; is there anyway we could encourage our 911 Office Director to start accumulating some funds to buy them this antenna? Chris continued this discussion; the thought was when he talked with Steve was to look and see what kind of costs could be associated getting them service. Chris said towers are very expensive but they have procured an agreement with RTC, that the old library, which is the Masonic Lodge Hall, they can come in and maintain it. They have room on that tower and they would be willing to allow the county to put an antenna up there for a repeater that would help keep the costs down considerably. What you have now as costs is merely the repeater equipment and Steve is now working that out. The discussion continued as to costs. Chris said there was a light out on the tower at the jail, just to change that light bulb, which Steve said it would take all of 5 minutes to crawl up and back down, would cost $2500.00. The height of the towers was discussed. Chris said the system now is based on a VHF radio signal, which is predominately what radios are based on. The discussion continued. Steve said they talked about sending a letter to the Fulton Board but he called Brian Richter and left him a message that they were working on it and just give them some time. Chris said that was fine. There will be a Joint Council & Board of Commissioners Meeting with the Hospital on March 3, 2004, at 7:00 P.M. in the Hospital Cafeteria. The topic for discussion will be the First Responder Task Force. Rich wanted to bring the Council up to-date on the personnel issues that the Commissioners had recommended to the Council eliminating somebody in the Surveyors Office and going to part-time on the Maintenance-man issue. Rich said that the Commissioners Attorney and the Councils Attorney said that its the Councils call on the Surveyors Office because it involves the number of employees and the Commissioners can take care of the maintenance man, that is the conclusion on that. So it is back to the Council if they want to do anything in the Surveyors Office. The questions was asked isnt that the Officer Holders option? The answer was yes, they can get rid of whomever they want, but they cannot add an employee without the Councils approval. This was discussed. This concluded all the business transacted.
