Meeting Called To Order: Richard A. Powell called this Meeting to Order at 6:05 p.m., E.S.T. Present for this meeting were Commissioners Richard A. Powell, Roger D. Rose and Leslie R. Walters; and Denise Bonnell, Fulton County Auditor. County Attorney, Gregory L. Heller, was absent. Fulton County Highway Department: Superintendent Scott Tilden gave an update of the construction on Bridge #88. Scott Tilden presented Ordinance #020705 for stop sign placement for its third reading. Ordinance #020705 Amendment of Ordinance 041894A Amendment to ordinance 041894A establishing Уstop signsФ for the intersections listed in Subsection I. Whereas, the Fulton County Highway Department and Fulton County Sheriff Department have completed a traffic study of this intersection, It is therefore ordained that the stop signs set forth in Subsection I, supersedes all prior signage at these locations, It is further ordained that, Fulton County Highway Department will install the stop signs in accordance with Subsection I. Roger Rose moved to adopt Ordinance 020705-A, an amendment to Ordinance 041894A. Leslie Walters seconded the motion. Motion passed 3-0. Scott Tilden pointed out the excessive wear and tear from the weather on the countyТs roads. He noted that the highway department would need the extra money that has been given from the landfill fees that are to terminate in April. One black top road, 600 West between 100 and 200 North, was closed due to its condition. Purdue Road School is March 29, 30 and 31, 2005 this year. SheriffТs Department: Sheriff Roy Calvert reported that the department has taken possession of one of the new vehicles. Sheriff Calvert asked for approval of the Agreement For Inmate Health Services. Richard Powell signed the contract on behalf of the County. Sheriff Calvert reported to the Commissioners that the SheriffТs Department has a Taser gun, and he has officers certified in its use. He presented his policy and procedures for the Taser guns. Calvert and the Commissioners discussed the use, training and effects of the Taser gun. Sheriff Calvert discussed the growing population of the jail and the possible need for more room and additional part-time jailers. Sheriff Calvert described the cost of transferring a suicidal inmate to Four County Counseling Center for treatment. He noted that the departmentТs medical costs are high. Sheriff Calvert discussed All Terrain Vehicles being ridden on private property. He noted that ATVs and snowmobiles can be ridden on US and state highway right of ways, but county roads arenТt wide enough to provide room for riders. John Brock: John Brock asked the Commissioners to lend their support in providing free training and certification in the proper installation of child passenger seats. The 32-hour course will be conducted in Rochester on May 9, 10, 16 and 17. He described the new Indiana Child Passenger Law going into effect on July 1, 2005. The GovernorТs Commission will pay for 15 officers to be trained in each of three statewide trainings taking place. Sheriff Calvert noted that he will have two officers in attendance at the training. CASA: John Cook, CASA Board of Directors member, asked to use the Fulton County Courthouse parking lot to conduct its port a pit chicken fundraiser on June 25, 2005, from early morning until mid-afternoon. The board approved the use of the parking lot. Mark Gundrum: Mark Gundrum had previously shown the Commissioners a map of Indiana counties where it is legal to ride ATVs and snowmobiles, such as Miami and Kosciusko counties. He had also presented a petition with over 300 names asking for it to be legalized here. Lawrence and Johnson counties have also legalized riding. Sheriff Calvert recommends an ordinance doing the same in Fulton County. He noted that a state officer could stop and arrest a rider and confiscate the machine. Discussion ensued regarding what vehicles would qualify (i.e., dirt bikes), money that could be generated, people who would benefit, etc. Commissioners tabled any decision at this time. Fulton County Park & Recreation Board: Walt Talbott described to the Commissioners the steps the Park Board is taking to apply for a grant in order to improve the park boardТs land for public use. CommissionersТ Minutes: The minutes of February 7, 2005, minutes were reviewed. Leslie Walters moved to approve the February 7, 2005, minutes as presented. Roger Rose seconded this motion. Motion carried 3-0. Circuit Court: Fulton Circuit Court Judge, Douglas Morton, sent a letter to the Commissioners requesting that the probationary period be waived and his new employee go directly into full pay under his employment as Court Reporter as she is transferring form the ClerkТs office. Roger Rose moved to waive the 8% reduction in pay for Sandy Thomas to begin working as Court Reporter per the recommendation of Judge Morton. Leslie Walters seconded the motion. Motion passed 3-0. Claims and Payroll: The Commissioners reviewed the Payroll and all Claims and signed them for payment. County Funding Agreements: Commissioners signed the following County Funding Agreement: Crime Stoppers for $2,000.00. County Animal Warden: Gene Baker submitted a letter of resignation dated February 16, 2005. Roger Rose moved to accept this resignation. Leslie Walters seconded the motion. Motion passed 3-0. Burn Ban: Mike Gearhart requested a burn ban from the second week of March through the first week of May. Richard Powell believes that this needs to be done by individual townships and not a countywide mandate. Rich will talk to county attorney Greg Heller before any decision is made. This subject was tabled until the next meeting. Easement issues: This will also be tabled until the next meeting. PETABOA Appointment: Bob Leavell had been appointed to the PETABOA Board but he is unable to continue to serve. He recommended Harry Richter for the position. A decision regarding this appointment was tabled until the next meeting. Old Business: Leslie Walters received estimates for all the county buildings from the Nipsco representative concerning the difference gas rates for the county buildings. New Business: Roger Rose felt there needed to be some official discussions regarding what Fulton County plans to do in the way of planning for the historic event that will transpire in ten to twelve years from now. He believes that a plan regarding the 31 Corridor needs to be made to maintain proper traffic flow in the county with closures of some of the intersections with 31. He suggested a committee from the Fulton County Plan Commission review the situation and develop a plan. The Commissioners decided to talk to the county attorney before making a decision on the issue. This concluded the business of this meeting of the Fulton County Board of Commissioners.
