Meeting Called To Order: Richard A. Powell called this Meeting to Order at 6:09 p.m., E.S.T. Present for this meeting were Commissioners Richard A. Powell; Roger D. Rose; Leslie Walters; Denise Chandler, Auditor; and Gregory Heller, attorney. Highway Department: Superintendent Scott Tilden discussed with the Board the bids received for Bid Item #1, one single axle dump truck with dump body, hoist, hydraulics and underbody scraper. Tilden recommended the Board accept the bid by Vomac Truck Sales, New Haven, for a total of $116,645, which includes a $12,000 trade-in allowance. This is a 2008 Mack GU 712 with a W.A. Jones body and equipment package. Roger Rose moved to award the single axle truck to Vomac Truck Sales in New Haven for a total price of $116,461.00 per the recommendation of Tilden. Leslie Walters seconded the motion. Motion carried 3-0. The bids received for Bid Item #2, one tandem axle dump truck with dump body, hoist, hydraulics and underbody scraper, were also discussed. Tilden recommended the Board accept the bid by Wiers International, Logansport, for a total cost of $115,066.00, which includes a $22,500 trade-in allowance. This is a 2008 International 7600 SBA 6 x 4 with a W.A. Jones body and equipment package. Leslie Walters moved to award Bid #2 to Wiers International of Logansport for a tandem axle truck 7600 SBA 6x4 cabin chassis for $115,066.00. Roger Rose seconded the motion. Motion carried 3-0. Tilden expects the International will be built in May or June and received with the dump body in August. He thought the Mack would be built in June or July and then actually on the road in August or September. He anticipates coming before the Board again in May to discuss financing the trucks. Jail Health Service Contract: Commander Jeff Berlasty presented a contract with Health Professionals for medical services for the inmates. This would go through September 2009 at an annual cost of $55,380. Roger Rose moved to renew the agreement with Health Professionals through September 2009 at an annual cost of $55,380 plus an increase based on CPI as determined on the third quarter of the year. RESOLUTION #121206 RESOLUTION OF THE COUNTY COMMISSIONERS OF FULTON COUNTY RE: THE PUBLIC DEFENSE FUND WHEREAS, the right to effective assistance of counsel is guaranteed by the Constitution of the United States and the Constitution of the State of Indiana; and WHEREAS, the right to counsel is essential to the fair administration of justice; and WHEREAS, Indiana General Assembly created the Public Defense Fund in 1989 for the purpose of assisting counties in providing indigent defense services; and WHEREAS, all counties in Indiana are eligible for 50% reimbursement in capital cases if the services comply with Criminal Rule 24; and WHEREAS, any county is eligible for 40% reimbursement in certain non-capital cases if the services meet standards adopted by the Public Defender Commission; and WHEREAS, 53 of the 92 Indiana counties have elected to be eligible for 40% state reimbursement of non-capital cases; and WHEREAS, the current annual appropriation for the Public Defense Fund it $10 million; and WHEREAS, the total request for reimbursement from the Public Defense Fund in capital and non-capital cases for FY 2007 is projected to be approximately $16 million; WHEREAS, the Indiana Supreme Court has submitted a biennium budget request for the Public Defense Fund of $16 million for FY 2007-08 and $17 million for FY 2008-09. Motion carried 3-0. Akron Property: Ken Gentry told the Board the he has some people who are interested in purchasing the property where the old Masonic Lodge was previously. It is a second floor and third floor attic. Denise reported that this property went up for tax sale several times and then became a Commissioner property and has been on Commissioners Sale. She said it was sold at Commissioner Sale on September 15, 2005, but the sale was deemed invalid. It, therefore, is eligible for Commissioner sale under the old laws. Due to advertising and other requirements, the next sale would be approximately late February or March. The Board discussed what could be done within the parameters of the law. Denise will determine how quickly this property can go up for sale by Commissioner Sale. Claims and Payroll: The Commissioners reviewed Payroll and all Claims and signed them for payment. Wellness Program: Diane Jones discussed a proposed wellness program for county employees. She said that the number of times per week of exercise necessary depends upon the reason a person is exercising. She said that any amount of exercise is better than none and recommended requiring one time per week to get employees in the program. The Board discussed the number of times per week/month to actually provide benefit. Recess Reconvene Public Hearing: Richard Powell opened the public hearing regarding the sewer treatment and collection service for Bruce Lake. It was explained that a revision was made in the plan, whereby there would be two pump stations. A proposal for the grant would be submitted in January, a site inspection would occur in February, and the application will be submitted in March. Roger Rose moved to close the hearing. Leslie Walters seconded the motion. Motion carried 3-0. New Business: The Board reviewed the Veteran Service Officer monthly report. The Board reviewed the Weights & Measures monthly report. Roger reported a complaint regarding the limited number of handicap parking spaces at the Courthouse. There is one space. The Board discussed providing an additional space. The Board discussed that the Sheriff’s service revolver has traditionally been transferred to the outgoing sheriff. Old Business: Greg Heller reported that he spoke with the collection person at Pioneer Products. He told her that the Council and Commissioners disagree on the issue at this point, so no action will be taken to give them time to sort it out. Denise said she thought that the Council gave her approval to pay the invoice but to send a letter from attorney Heller with it. Greg Heller also reported that the IRS would be conducting a complete audit in January going back 2004. Roger Rose expressed that he had misgivings about the rezone of the acreage for the proposed ethanol plant. He said he had some serious reservations about the long-term development plans of the area. He wants to know that the development would be limited and that the intention of the Plan Commission for the rezone be in the meeting minutes. Leslie Walters concurred that this was his belief of the vision of long-term development and questioned the need to include it in the minutes. Roger said he wanted to see the comprehensive plan adhered to and big industrial development to be situated in and around cities and towns. Richard Powell said that he also felt it was rezoned specifically for the ethanol plant but, also, didn’t want to be limited if something were proposed.
