Meeting Called To Order: Richard A. Powell called this Meeting to Order at 9:07 a.m., E.D.T. Present for this meeting were Commissioners Richard A. Powell; Roger D. Rose; Leslie R. Walters; Denise Bonnell, Auditor; and Greg Heller, County Attorney. Highway Department: Mike Clark presented to the Board Permit #13-06 from United Telephone Co. of Indiana. The permitee wants to bury 2,956 feet of telephone cable on County Road 400 South at 1000 West with no road bores. Roger Rose moved to approve Permits #13-06 as recommended by Scott. Leslie Walters seconded this motion. Motion passed 3-0. The Board said that it wants the highway department to supply gasoline to the maintenance department for the Courthouse lawn mowing and to bill the maintenance department for same. The Board inquired as to whether there is a speed limit on Olson Road at the Buskirk Addition before 200 West. Leslie Walters said that a couple of citizens from that area wanted to know about the speed limit. It was noted that if one doesn’t exist, there may be a need for a speed limit. If it’s merely not posted, it needs to be. Mike said that there are slow signs at the curves. The highway department will research that issue. The Board discussed with Mike the large right-of-way in Tiosa and the issues it may cause with the utilities. Animal Warden: The Board discussed the fact that animal issues are not being addressed, and they are receiving complaints regarding the issue. The Board feels that the animal issues are not being addressed as they should be. E911: Steve Reese reported that the Communications Department has remedied most of its problems with the eastern part of the County receiving pages. He said that both drives at the dispatch center that accommodate the entire County failed within the hour. He gave an update on the CAD software on the software project that the Communications Department has been working on with the Sheriff Department and the City. He said they have completed all of the administrative training (approximately 4 weeks’ worth). He said they would meet with the project manager and set a date for training all of the employees. He feels like it may be completed within a month. Citizen Inquiry: A Citizen asked about the house across the street from his residence. He said it hadn’t been mowed yet this year. He said there is a pile of junk behind the house. He said that he has spoken with the Health Department, Sheriff’s Department, Plan Commission, and the Building Inspector. He said the Building Inspector is attempting to find the owner to send a letter requesting it be cleaned up and mowed. Greg Heller will try to determine whether this is something that should be handled by the Township Trustee or the County and under what statute. Burn Ordinance: Richard Powell presented Ordinance # 061906 for its third reading. He noted that he had not received any calls or concerns regarding said ordinance. Rich read Ordinance #061906 by title. The Ordinance was reviewed and reads as follows: ORDINANCE #061906 AN ORDINANCE IMPOSING PENALTIES FOR UNCONTROLLEDOPEN BURNING WHEREAS, the Fulton County Board of Commissioners are empowered to protect the public health, safety and welfare; and WHEREAS, open burning in compliance with 326 IAC 4-1 and IC 13-17-9 is allowed throughout the County except during declaration of a fire emergency; and WHEREAS, uncontrolled, open burning causes a threat to the public’s health and safety. NOW, THEREFORE, BE IT ORDAINED by the Board of Commissioners of Fulton County, Indiana, as follows: That the term open burning shall be defined to mean the combustion of any matter in the open. That all open burning must comply with the following conditions: A person who open burns any materials shall extinguish the fire if the fire creates a nuisance or fire hazard. Burning may not be conducted during unfavorable meteorological conditions, such as high winds, temperature inversions, or air stagnation; or during a fire emergency as declared pursuant to Ordinance Number 121696. All fires must be attended at all times during burning until completely extinguished. All burning must comply with current Administrative, State and Federal laws. That in the event that the conditions of open burning are not complied with, the Fire Chief of a Fulton County Fire Department that is required to respond to an uncontrolled open burn may make the determination that the terms of this Ordinance have been violated. That in the event a person is found to be in violation of this Ordinance that person may be subject to the following: The cost to the responding Fulton County fire department to control the open burn, including, but not limited to the cost of manpower and equipment. The person who commits a violation of this Ordinance may be fined up to $2,500.00 for the first violation. Any person who commits a second or subsequent violation of this Ordinance may be fined up to $7,500.00. That the decision of violation by a Fulton County fire department Fire Chief may be appealed to the Fulton County Board of Commissioners. Said appeal shall be made in writing and filed with the Fulton County Board of Commissioners within thirty (30) days after the written violation has been issued to the person by the Fulton County fire department Fire Chief. That in the event any section, clause or portion of this Ordinance shall be declared invalid by and Court, the remaining portions or sections shall remain in full force and effect. Rich Powell asked if each fire chief could be sent a copy of the Ordinance for their information and records. IDEM Outreach Program: Michael Aylesworth, District Director of the Regional District Office for the Indiana Department of Environmental Management, was here to see if there are any problems of commonality between State and Local government. He said he served a couple of terms as a Porter County Commissioner and a couple of terms on the Porter County Council. He said this is a friendly outreach. He said IDEM has a corps of inspectors who inspect facilities to be sure they are in compliance regarding air, water and land issues. He asked if there were any questions that he could take back to IDEM or other State entities (DNR, INDOT, etc.). They discussed some issues with the landfill and complaints with its smell, as well as other issues. Attorney Greg Heller asked about the repair of the dam at Mt. Zion and its potential hazard to Lake Manitou. Aylesworth said that he would convey his inquiry to INDOT. Aylesworth introduced Jim Weingart, who specializes in pollution prevention and is working with communities on another program, the Indiana Clean Community Challenge. He discussed preparing a Quality of Life Plan for the County. It was suggested that this might be a good project for the Leadership Academy. Public Defender Board: Karin Fowler presented to the Board an additional appropriation totaling $27,063. These are $10,000 for conflict attorney fees, $15,000 for witness fund and $2,063 for a discrepancy in Dick Oren’s contract. Public Hearing on Zone Map Amendment: Richard Powell opened the public hearing. Glen Bode with Indiana Renewable Fuels requested the public hearing be postponed to obtain information regarding ground water requested by the Plan Commission. Casi Cramer reported that the Plan Commission is requesting an aquifer assessment to determine the potential impact on surrounding property wells be conducted at the expense of IRF. The Plan Commission also wants IRF to donate land for a right of way for 100 East not to exceed 100 feet and that lighting be maintained as down lighting. Leslie Walters moved to continue the public hearing to a date uncertain. Roger Rose seconded the motion. Motion carried 3-0. Emergency Management: Director Dave Tofson reported to the Board grant monies received and pending totaling $141,351.00. He also reported that the Dam Safety Partnership Workshop will be conducted July 19 in Wabash and July 27, 2006, in Huntington, Indiana. Tofson plans to attend the July 19 session. He also discussed an article in The Sentinel. The article reported that in the event of Avian Flu, the Centers for Disease Control would take over the hospital and dictate quarantine operational procedures. Tofson said he is told by the State and Feds that should this occur, the County is on its own-there will not be State or Federal aid. The article also said that the hospital has about 200 doses of the Avian Flu vaccine on hand. Tofson reported that there is no vaccine. He said that the County is not close to being prepared for this, though the article says, “We’re probably as prepared as we need to be.” It was noted that the day following this article there was a retraction in the paper and that the CEO of the hospital was most likely misquoted, but they are not sure. Short Recess Commissioner Meeting Minutes: The minutes of the June 5, 19 and 20, 2006, Board of Commissioners meetings were reviewed. Circuit Breaker Tax Credit: Denise Bonnell received an email from the Indiana Department of Local Government Finance. She believes this will cost the County extra money in order to know determine what people/parcels will be able to apply for a circuit breaker tax credit which prevent a taxpayer’s tax bill from going up more than two percent of their gross assessed value. They can apply for a circuit breaker tax credit, which would limit the increase of the tax bill to two percent annually. Sheriff’s Service Of Process Fee: Denise also received an e-mail regarding a new sheriff’s service of process fee. Grass Creek Lion’s Club: The Grass Creek Lion’s Club plans to erect a garage at the Grass Creek Lion’s Park and requested the location improvement permit fee of $20 be waived.
